Abstract

Masuknya fenomena transportasi online di Kota Malang telah menimbulkan konflik terhadap transportasi konvensional. Hal ini disebabkan karena belum ada regulasi yang mengatur fenomena transportasi online. Padahal, peran pemerintah sebagai penyedia fasilitas publik bagi masyarakat termasuk melindungi haknya dari pengaruh monopoli perusahaan. Namun pada tingkat pemerintah daerah memiliki keterbatasan kewenangan yang di atur dalam UU. 23 Tahun 2014 tentang Pemerintah Daerah. Sehingga, pemerintah daerah memerlukan kekuatan hukum yang kuat untuk menyelesaikan konflik transportasi di Kota Malang. Penelitian ini menggunakan metode deskriptif kualitatif yang berfokus pada analisis peran pemerintah daerah dalam penyelesaian konflik antara transportasi konvensional dan transportasi online melalui Instrumen Kebijakan Howlett dan Ramesh. Hasil dari penelitian ini bahwa Pemerintah Kota Malang lebih condong kearah Instrumen Wajib dengan menerapkan PM No.108 Tahun 2017 sebagai landasan hukum dalam menyelesaikan konflik antara transportasi konvensional dan transportasi online di Kota Malang.

English Abstract

The entry of online transportation phenomenon in Malang City has caused conflict to conventional transportation. This is because there is no policy regulating the phenomenon of online transportation. Moderation, the role of government as a provider of public facilities for the community including protecting its rights from the influence of corporate monopoly. But at the level of local government has limited authority that is set in the Act. 23 of 2014 on Regional Government. Thus, strong local government to solve transportation problems in Malang. This research uses descriptive qualitative method that gives a good influence on environment and online transportation through Howlett and Ramesh policy instruments. The results of this study that the Government of Malang City is more inclined towards the Compulsory Instrument by applying PM No.108 Year 2017 as the legal basis in the settlement of conflict between conventional transportation and online transportation in the city of Malang.
