Abstract
Penelitian ini bertujuan untuk menganalisis pemindahan Kedutaan Besar Amerika Serikat dari tel Aviv ke Yerusalem menurut Resolusi Dewan Keamanan PBB No. 478 tahun 1980 sehingga bisa diketahui apakah pemindahan kedutaan tersebut sesuai dengan isi dari Resolusi Dewan Keamanan PBB No. 478 Tahun 1980 dan apa implikasi yuridis untuk perbuatan yang dilakukan oleh Amerika tersebut. Jenis penelitian ini menggunakan penelitian hukum yuridis normatif dengan metode pendekatan hukum dan perjanjian internasional dan pendekatan kasus. Sumber bahan hukum yang diperoleh berupa bahan hukum primer melalui resolusi dan prinsip, bahan hukum sekunder melalui studi kepustakaan yang relevan dengan permasalahan yang diteliti dan bahan hukum tersier. Penulis menggunakan teknik analisis menggunakan metode deskriptif normatif. Hasil yang di peroleh dalam penelitian ini menunjukan bahwa Amerika Serikat telah melanggar isi Resolusi Dewan Keamanan PBB No. 478 tahun 1980 karena status dari kota Yerusalem dan isi dalam resolusi yang tidak memperbolehkan suatu negara membuka perwakilan diplomatik di kota tersebut dan melanggar prinsip non-intervensi karena telah membuat aturan yang menentukan permasalahan di negara lain, serta Dewan Keamanan PBB dapat menjatuhkan sanksi sebagai implikasi yuridis yang harus di terima Amerika Serikat menurut Piagam PBB.
English Abstract
The purposed of this study is to analyzed the relocation of the United States of America Embassy from Tel Aviv to Jerusalem according to UN Security Council Resolution 478 in 1980 so that we can known wether the relocation of US Embassy due to the United Nations Security Council 478 in 1980 and what the juridicial implications for what deeds conducted by the United States of America, This type of research uses a legal juridical normative research with a statute approach method. Sources of legal material obtained in the form of primary legal material through the Act and Agreement, secondary law material through library studies relevant to the problems studied and tertiary legal matter. The author uses the analytical technique using normative descriptive method. The results obtained in this study indicate that America have been violated the UN Security Council Resolution 478 in 1980 because of the status of Jerusalem is a holy city and the content of the resolution that not allowed any country to open their diplomatic mission in Jerusalem and America also violated the nonintervention principle because they made an act that determine other country issues, because of that UN Security Council can drop a sanctions as a juridical implication that the United States must accept according to the United Nations Charter
