Abstract
Pada skripsi ini penulis mengangkat permasalahan terkait dengan pengawasan dan pengendalian dalam pengelolaan irigasi sebagaimana disebutkan di dalam Pasal 38 ayat (1) Peraturan Daerah Kabupaten Lamongan No.14 tahun 2007 tentang Irigasi. Tema tersebut di latar belakangi adanya penyelewengan fungsi Irigasi sebagai lahan pertanian di Kabupaten Lamongan sebagai lahan pertanian. Kegiatan tersebut sudah menjadi kebiasaan bagi masyarakat setempat, dan Pemerintah Daerah Kabupaten Lamongan dianggap membiarkan adanya hal tersebut karena sampai saat ini masih banyak di jumpai. Dari hal itulah adanya pertentangan antara peraturan yang ada dengan kondisi sosial yang terjadi. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah: (1) Bagaimana implementasi Pasal 38 ayat (1) Peraturan Daerah KabupatenLamongan No. 14 tahun 2007 tentang Irigasi? (2) Apa faktor-faktor yang menghambat dalam implementasi Pasal 38 ayat (1) Peraturan Daerah Kabupaten Lamongan No. 14 tahun 2007 tentang Irigasi dan apa solusi yang dilakukan untuk mengatasi hambatan tersebut? Karya tulis ini menggunakan Metode penelitian empiris dengan pendekatan yuridis-sosiologis (sociology legal research). Lokasi penelitian ini yaitu di Dinas Pekerjaan Umum Pengairan Kabupaten Lamongan. Adapun Data yang di peroleh baik data primer dan sekunder yang diperoleh penulis yaitu dengan cara pedoman wawancara, tabulasi data serta studi kepustakaan. Dari hasil tersebut akan di analisis dengan teknik deskriptif-kualitatif. Deskriptif kualitatif merupakan pemaparan hasil penelitian dengan tujuan agar diperoleh suatu gambaran terhadap permasalahan yang akan diteliti dimana penulis sebagai instrument kunci. Penulis memperoleh jawaban atas permasalahan yang ada bahwa implementasi Pasal 38 ayat (1) Peraturan Daerah Kabupaten Lamongan Nomor 14 Tahun 2007 tentang Irigasi Yaitu dilaksanakan oleh Dinas Pekerjaan Umum Pengairan Kabupaten Lamongan dengan melakukan pengendalian dan pengawasan secara preventif dan represif. Secara umum pengendalian dan pengawasan masih terfokus pada pengendalian banjir dan kegiatan fisik. Sedangkan terkait dengan pengendalian perilaku masyarakat masih lemah dalam hal penertiban.Hal itu disebabkan karena adanya faktor yang menghambat yaitu Sumber Kewenangan, Anggaran Daerah, Fasilitas, Sumber Daya Manusia, Perilaku Masyarakat. Dari beberapa hambatan tersebut, maka ada beberapa solusi yang dilakukan oleh Dinas Pekerjaan Umum Pengairan Kabupaten Lamongan antara lain mengajukan rekomendasi ke Pemerintah Pusat, pengalihan Tindakan, menggunakan fasilitas Pribadi, pegawai merangkap tugas, melakukan Sosialisasi seoptimal mungkin, membuat kebijakan secara teknis terhadap jaringan irigasi
English Abstract
In this study, the researcher raised the issues related to the supervision and control in irrigation management as stated in Article 38 subsection (1) of Lamongan District Regulation No.14 year 2007 aboutirrigation. The topic is based on the misappropriation of irrigation for agriculture in Lamongan as agricultural land. This has already become a habit for the local community, and Lamongan District Government is considered letting this to happen since there are still many cases found to present. Starting from this matter the conflict between the existing regulations and the social conditions prevailing happened. Based on the above statement, this paper raises the formulation of the problem: (1) How is the implementation of Article 38 subsection (1) of Lamongan District Regulation No.14 year 2007 aboutirrigation?; (2) What are the factors that hinder the implementation of Article 38 subsection (1) of Lamongan District Regulation No.14 year 2007 aboutirrigation and what is the solution to overcome these obstacles? This study used empirical research method with sociology legal research approach. The research site wason the Department of Public Work Irrigation, District of Lamongan. Both primary and secondary data were obtained through interview, data tabulation, and literature study. The data were analyzed using descriptive qualitative technique. Descriptive qualitative is the presentation of research results with the aim to obtain an overview of the issues being investigated where the researcher become the key instrument. The results of this study show that the implementation of Article 38 subsection (1) of Lamongan District Regulation No. 14 year 2007 aboutirrigationthat is enacted by the Department of Public Work Irrigation of the district of Lamongan is done by controlling and supervising in preventive and repressive way. In general, the control and supervision are still focused on flood control and physical activity. Meanwhile, controlling the behavior of society is still weak in terms of enforcement. It is due to the factors that hinder namely resource authority, local government budget, facilities, human resource, and society behavior. For some of the obstacles, there are several solutions conducted by the Department of Public Work Irrigation Lamongan, among others, making recommendations to the central government, doing diversion of action, using private facilities, having employees taking more tasks at the same time, performing socialization as optimally as possible, and formulating technical policy on the irrigation network.
