Abstract
Pada skripsi ini, penulis mengangkat permasalahan Tinjauan Yuridis Kebijakan Pemerintah Dalam Perubahan Penerapan “ Masa Berlaku Kartu Tanda Penduduk Elektronik (KTP-el) ” Berdasarkan Pasal 64 Ayat (7) “ UU Nomor 24 Tahun 2013 Tentang Administrasi Kependudukan. Pemilihan tema tersebut dilatarbelakangi oleh adanya perubahan kebijakan peraturan pada Kartu Tanda Penduduk elektronik khususnya dalam hal masa berlakunya. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : Apa urgensi kebijakan pemerintah dalam perubahan penerapan masa berlaku e-KTP berdasarkan pasal 64 ayat (7) UU “ nomor 24 tahun 2013 tentang administrasi kependudukan? ” Kemudian penulisan karya tulis ini menggunakan metode yuridis-normatif karena cara yang digunakan dalam penelitian yaitu dengan menelaah bahan hukum baik primer, sekunder, maupun tersier untuk menjawab permasalahan yang menjadi fokus penelitian. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa pemerintah dalam perumusan perubahan kebijakan terkait masa berlaku ktp-el yang sebelumnya 5 tahun sekali menjadi seumur hidup tidak dijelasakan secara rinci baik dalam Surat Edaran Mendagri maupun di dalam Undang-Undang Nomor 24 tahun 2013 tentang administasi kependudukan itu sendiri. Sehingga menimbulkan kekosongan norma dimana tidak ada pasal yang dapat mejelaskan mengapa terjadi perubahan kebijakan masa berlaku tersebut. Dalam hal perubahan tersebut, penulis menganalisis bahwa adanya kebijakan tersebut untuk menghemat biaya dalam pencetakan kartu tanda penduduk itu sendirii. Selain itu, penerapan hal tersebut juga dikarenakan sering terlambatnya proses pembuatan mapunn pencetakan. Untuk mengurangi hal tersebut yang sering terjadi pada waktu 5 tahun sekali, maka pemerintah mengeluarkan kebijakan tersebut. Dengan harapan tidak ada lagi masyarakat yang terlambat atau tidak memiliki tanda pengenal kartu tanda penduduk tersebut.
English Abstract
In this thesis, the authors raised the issue of Judicial Review of Government Policy in the Change of Application of "Applicability Period of Electronic Population Card (KTP-el)" Under Article 64 Paragraph (7) "Law Number 24 Year 2013 About Population Administration. The selection of the theme is motivated by the change of regulation policy on electronic identity card especially in terms of its validity period. Based on the above, this paper raises the formulation of the problem: What is the urgency of government policy in changing the application of the validity period of e-ID card under article 64 paragraph (7) Act "number 24 of 2013 on population administration? " Then the writing of this paper using the method of juridical-normative because of the way used in research that is by reviewing the legal materials both primary, secondary, and tertiary to answer the problems that became the focus of research. From the results of research with the above method, the authors get the answer to the existing problems that the government in the formulation of policy changes related to the validity period ktp-el previously 5 years to be lifetime is not elucidated in detail both in the Circular Letter of the Minister of Home Affairs as well as in Law Number 24 of 2013 on the administration of population itself. So it creates a void of norms where there is no article that can explain why such policy changes occur. In terms of these changes, the authors analyzed that the existence of such policies to save costs in printing the identity card itself. In addition, the implementation of this is also due to frequent late creation of mapunn printing process. To reduce this often happens once every 5 years, then the government issued the policy. In the hope that there will be no people who are late or do not have the identity card identification.
