Abstract
Pada skripsi ini, penulis mengangkat permasalahan EFETIVITAS PASAL 10 AYAT (1) PERATURAN DAERAH KOTA MALANG NOMOR 6 TAHUN 2006 TENTANG PENYELENGGARAAN USAHA PEMONDOKAN (Studi Kasus di Kota Malang). Pilihan tema tersebut dilatar belakangi oleh adanya Peraturan Daerah Kota Malang Nomor 6 Tahun 2006 Tentang Penyelenggaraan Usaha Pemondokan tentang larangan adanya usaha pemondokan campuran. Kota Malang merupakan Kota dengan banyak pengusaha pemondokan dikarenakan banyak Universitas. Fokus penelitian yang dilakukan peneliti ialah di Kecamatan Lowokwaru dikarenakan di kecamatan ini memiliki tingkat pelanggaran terhadap usaha pemondokan campuran yang tinggi. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : (1) Bagaimanakah Efektivitas Pasal 10 Ayat (1) Peraturan Daerah Kota Malang Nomor 6 Tahun 2006 Tentang Penyelenggaraan Usaha Pemondokan? (2) Apa hambatan dan upaya dalam penegakan Pasal 10 Ayat (1) Peraturan Daerah Kota Malang Nomor 6 Tahun 2006 Tentang Penyelenggaraan Usaha Pemondokan? Kemudian penulisan karya tulis ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis sosiologis. Lokasi penelitian dilakukan di Kecamatan Lowokwaru. Data primer berupa wawancara, sekunder, dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis data deskriptif kualitatif. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa problematika mengenai Efetivitas Pasal 10 Ayat (1) Peraturan Daerah Kota Malang Nomor 6 Tahun 2006 Tentang Penyelenggaraan Usaha Pemondokan terkait pelanggaran usaha pemondokan campuran. Ditemukan fakta hukum bahwa terdapat 620 pemondokan yang berada di Kota Malang. Khususnya terdapat 522 pemondokan yang berada di Kecamatan Lowokwaru yang mana menjadi fokus penelitian yang dilkaukan oleh peneliti. Berdasarkan hasil survey yang dilakukan, terdapat kasus pemondokan campuran yang mana melanggar ketentuan pasal 10 ayat (1) Peraturan Daerah Kota Malang Nomor 6 Tahun 2006 Tentang Penyelenggaraan Usaha Pemondokan. Jumlah pemondokan yang melanggar ketentuan larangan pemondokan campuran ialah 270 pemondokan yang mana jika diakumulasikan dalam persen ialah 51,7%. Jadi, kesimpulan nya adalah bahwa unsur pertama efektifitas peraturan tidak dapat dipenuhi atau jika dikaitkan dengan problematika yang ada dan Pasal 10 Peraturan Daerah Kota Malang No 6 Tahun 2006 Tentang Usaha Pemondokan tidaklah efektif

(2) What is the bottleneck and the efforts from the in enforcing of article 10 verse (1) Peraturan Daerah Kota Malang Nomor 6 Tahun 2006 Tentang Penyelenggaraan Usaha Pemondokan? Then the writing of a piece of writing is provided by way of a method of empirical legal information about with the methods of an approach to a juridical sociological perspective .The location of the research conducted in districts lowokwaru .The primary data was in the form of the objective of the interview , secondary , and tertiary bni offered for its shares will be analyzed writer with uses the technique of the data analysis descriptive of qualitative.. From the research with the methods above , writer elicit a response for the matter that problems it was about Efectifity of article 10 verse (1) Peraturan Daerah Kota Malang Nomor 6 Tahun 2006 Tentang Penyelenggaraan Usaha Pemondokan Of the prohibition of the clarification a mixture of business. A fact found that the of the law that there have been instances of 620 clarification who are located in the miserable and to be pitied .Especially there are lodging 522 two kecamatan that is in lowokwaru which is hard for are a focus of this study which was conducted by researchers .Based on the results of various surveys show signs of that have been undertaken by , there have been cases lodging a mixture of which is hard for the violation of the provisions of article 10 verse (1) Peraturan Daerah Kota Malang Nomor 6 Tahun 2006 Tentang Penyelenggaraan Usaha Pemondokan. The number of clarification goes beyond the limits of the law that prevents lodging a mixture of is among the more conservative 270 clarification which is hard for if used to purchase is among the more conservative 51,7 % percent .So , the conclusion of it is that the first element the effectiveness of rules designed to weed out can not be covered or if it is associated with problems it was there are any and article 10 verse (1) Peraturan Daerah Kota Malang Nomor 6 Tahun 2006 Tentang Penyelenggaraan Usaha Pemondokan is not efektive
