Abstract
Penelitian ini bertujuan untuk menganalisis mengenai kekuatan hukum Resolusi Nomor 2371 United Nations Security Council terkait pelarangan hubungan ekspor dengan Korea Utara dalam perspektif Hukum Ekonomi Internasional sehingga nantinya diperoleh penjelasan bagaimana kekuatan hukum Resolusi Nomor 2371 United Nations Security Council terhadap pelarangan hubungan ekspor dengan Korea Utara dan Implikasi Yuridis Resolusi Nomor 2371 United Nations Security Council terhadap hubungan perdagangan Indonesia dengan Korea Utara dalam perspektif Hukum Ekonomi Internasional. Jenis penelitian ini menggunakan penelitian hukum Yuridis normatif dengan metode pendekatan perundang-undangan. Sumber bahan hukum diperoleh berupa bahan hukum primer melalui Undang-Undang dan Perjanjian, bahan hukum sekunder melalui studi kepustakaan yang relevan dengan permasalahan yang diteliti dan bahan hukum tersier. Penulis menggunakan teknik analisis menggunakan metode deskriptif normatif Hasil yang di peroleh dalam penelitian ini menunjukan bahwa kekuatan hukum Resolusi Nomor 2371 United Nations Security Council berbentuk sumber Hukum Sekunder, serta Implikasi Yuridis Resolusi Nomor 2371 terhadap hubungan perdagangan Indonesia dengan Korea Utara adalah menjadi Hak Indonesia dalam melakukan penghormatan terhadap Resolusi tersebut. Hal ini sesuai dengan keberadaan atau kedudukan Resolusi sebagai sumber hukum sekunder dalam hukum internasional maupun sumber hukum ekonomi internasional serta pemberlakuan prinsip non-diskriminasi dalam prinsip umum yang terkandung dalam Hukum Ekonomi Internasional
English Abstract
This study purposed to analyze the Force of Law of the United Nations Security Council Resolution Number 2371 regarding the prohibition of export relations with North Korea in the perspective of International Economic Law so in the advance matter obtained an explanation how the Force of Law of the United Nations Security Council Resolution Number 2371 against the prohibition of export relations with North Korea and Juridical Implications on the United Nations Securtiy Council Resolution Number 2371 on Indonesia's trade relations with North Korea in the perspective of International Economic Law. This type of research uses a legal juridical normative research with a statute approach method. Sources of legal material obtained in the form of primary legal material through the Act and Agreement, secondary law material through library studies relevant to the problems studied and tertiary legal matter. The author uses the analytical technique using normative descriptive method. The results obtained in this study indicate that the Force of Law of the United Nations Security Council Resolution Number 2371 to position the Resolutiono in to the form of Secondary source of International Law (Secondary Law), as well as the Judicial Implication of the Resolution Number 2371 on Indonesia's trade relations with North Korea are to shift the paradigm from obligation in to the right of Indonesia to respect the Resolution. This is in accordance with the existence or position of the Resolution as a secondary source of law in international law as well as the source of international economic law and the enactment of the principle of non-discrimination in general principles contained in International Economic Law
