Abstract
Skripsi ini di latar belakangi oleh perkembangan aturan pemilihan umum yang sampai pada penggunaan syarat presidential threshold dengan menggunakan tolak ukur ambang batas hasil pemilihan umum legislatif periode sebelumnya. Dalam penelitian juga membahas bagaimana seharusnya pengaturan syarat pencalonan presiden berdasarkan perspektif kedaulatan rakyat. Tujuan penelitian ini adalah untuk menganalisis dan mengetahui dasar penggunaan syarat Presidential Treshold berdasarkan perolehan suara Pemilihan Umum sebelumnya, serta menganalisis dan mengetahui bagaimanakah pengaturan tentang Presidential Treshold dalam sistem Pemilihan Umum di Indonesia yang sesuai dengan prinsip kedaulatan rakyat. Hasil yang diperoleh dari penelitian ini menunjukkan bahwa ketentuan presidential threshold yang sesuai dengan prinsip kedaulatan rakyat adalah yang digunakan dalam Pemilu dua tahap. Sebab ketentuan yang demikian itu sesuai dengan cita-cita perwakilan yang diamanatkan para founding fathers dan juga telah menyesuaikan dengan tuntutan reformasi yang telah mengubah pemegang kedaulatan rakyat itu dan menghendaki penerapan sistem pemerintahan presidensial. Jika tetap digunakan dalam Pemilu serentak, maka presidential threshold sebenarnya telah mendegradasi fungsi untuk memperbesar kemungkinan memperkuat sistem pemerintah presidensial dan lebih tepat digunakan untuk fungsi memperkecil biaya Pemilu akibat calon perserta Pemilu presiden dan wakil presiden yang dapat menjadi sangat banyak.
English Abstract
This thesis is in the background by the development of general election rules that arrive at the use of the presidential threshold conditions by using a benchmark threshold for the results of the previous period legislative elections. In the study also discussed how to regulate the terms of the presidential nomination based on the perspective of popular sovereignty. The purpose of this study was to analyze and find out the basis for the use of Presidential threshold requirements based on the previous General Election votes, as well as analyze and find out how the arrangements for Presidential Traditions in the General Election system in Indonesia are in accordance with the principles of popular sovereignty. The results obtained from this study indicate that the provisions of the presidential threshold in accordance with the principle of popular sovereignty are those used in two-stage elections. Because such provisions are in accordance with the ideals of the representatives mandated by the founding fathers and also have adjusted to the demands of reforms that have changed the people's sovereignty holders and want the application of presidential government systems. If it is still used in simultaneous elections, then the presidential threshold has actually degraded the function to increase the possibility of strengthening the presidential government system and is more appropriate to be used to reduce election costs due to the large number of candidates for the presidential and vice presidential elections
