Abstract
UNICEF diberi kewenangan oleh PBB untuk melakukan pencegahan perekrutan tentara anak yang dilakukan oleh ISIS khususnya diwilayah Irak dan Suriah. Namun, UNICEF akan menghadapi faktor-faktor yang dapat menghambat program kerjanya yang juga merupakan bagian dari pelaksanaan kewenangannya. Dari penjelasan tersebut, maka penulis megangkat beberapa rumusan masalah yakni (1) Bagaimana UNICEF menjalankan kewenangannya atas dasar mandat yang diberikan oleh PBB dalam melakukan pencegahan perekrutan tentara anak (child soldier) yang dilakukan oleh kelompok separatis ISIS di Irak dan Suriah?; (2) Apa faktor-faktor yang menghambat UNICEF dalam melakukan pencegahan perekrutan tentara anak (child soldier) oleh kelompok separatis ISIS di Irak dan Suriah?; (3) Apa upaya yang dilakukan oleh UNICEF terhadap faktor-faktor yang menghambat pencegahan perekrutan tentara anak (child soldier) oleh kelompok separatis ISIS di Irak dan Suriah?. Tujuan penulisan skripsi ini adalah untuk bahan rujukan pengembangan ilmu organisasi internasional dalam melaksanakan kebijakannya, dan berguna sebagai referensi mahasiswa yang melakukan kajian kinerja UNICEF sesuai kapasitas mandat yang telah diperoleh dari PBB, dengan permasalahan perekrutan tentara anak (child soldier). Jenis penelitian skripsi ini adalah normatif-yuridis dengan pendekatan historis (historical approach), pendekatan kasus (case approach), dan pendekatan undang-undang (statute approach). Dari hasil penelitian penulisan skripsi ini dapat ditarik kesimpulan, yang pertama adalah bahwa dasar kewenangan UNICEF terdapat pada pasal 45 huruf (a) dan (b) Konvensi Hak Anak 1989 (CRC), sebagaimana dalam pasal tersebut dijelaskan bahwa UNICEF berhak untuk melakukan tindakan sesuai kapasitas mandat yang diberikan oleh PBB atas dasar Konvensi Hak Anak 1989 (CRC). Kedua, dalam melaksanakan kewenangannya UNICEF menghadapi faktor struktur hukum, faktor substansi, dan faktor budaya hukum yang berdampak pada pelaksanaan pencegahan perekrutan tentara anak yang telah dilakukan oleh ISIS di Irak dan Suriah. Ketiga, UNICEF bekerjasama dengan mitra PBB seperti Office of the Special Representative of the Secretary General for Children and Armed Conflict (OSRSG-CAAC), NGO, serta kelompok masyarakat sipil setempat, juga entitasentitas PBB lainnya untuk mengatasi faktor-faktor yang menghambat program kerjanya.
English Abstract
United Nations give authority for UNICEF to prevent child soldier recruitment by ISIS especially in Iraq and Syira. But, UNICEF will facing factors that could hamper work program which is also part of the exercise of its authority. From the explanation, then author make some formulation of problem, the among others is (1) How UNICEF exercised with authority on the basis of the mandate given by the United Nations to perevent child soldier recruitment by ISIS in Iraq and Syira?; (2) What the factors can hamper UNICEF for do preventing child soldier recruitment by ISIS separatist group in Iraq and Syira?; (3) What efforts have UNICEF made to the factors can hamper the preventing child soldier recruitment by ISIS separatist group in Iraq and Syira?. The purpose of this thesis is refer to the development of the science of international organizations in carrying out its policies, and useful as a reference of students who conduct the UNICEF performance assessment in accordance with the capacity of the mandate that has been obtained from the United Nations, with the issue of child soldier recruitment. The research type of the thesis is Normative-Juridical with historical approach, case approach, and statute approach. From the results of research writing this thesis can be concluded, the first is that the legal basis contained in article 45 letters (a) and (b) Convention on the Rights of the Child 1989 (CRC). Such as in the article it is explained that UNICEF entitled to take action in accordance with the capacity of the mandate granted by the United Nations under the Convention on the Rights of the Child 1989 (CRC). Second, in exercising its authority UNICEF faces legal structural factors, substantive factors, and legal cultural factors that impact on the implementation of prevention of child soldiers recruiting by ISIS in Iraq and Syria. Third, UNICEF works with United Nations partners like as Office of the Special Representative of the Secretary of General for Children and Armed Conflict (OSRSG-CAAC), NGOs, as well as local civil society groups, as well as other United Nations entities to address the factors that hinder the program it works.
