Abstract
Pada skripsi ini, penulis mengangkat permasalahan Implementasi pasal 44 ayat (3) Peraturan Daerah Kota Malang Nomor 4 Tahun 2011 Tentang RTRW Kota Malang Terkait Bangunan kawasan Cagar Budaya Jalan Ijen 75C sebagai Tempat Usaha. Dilatarbelakangi peraturan walikota yang menyebutkan bahwa jalan ijen termasuk kawasan Cagar Budaya Berdasarkan hal yang disebut di atas, karya tulis ini mengangkat rumusan masalah : (1) Bagaimana implementasi pasal 44 ayat (3) Peraturan Daerah Kota Malang Nomor 4 Tahun 2011 Tentang RTRW Kota Malang Tahun 2010-2030 di jalan Ijen Nomor 75C sebagai tempat usaha? (2) Apa hambatan Barenlitbang dalam melindungi bangunan Cagar Budaya dan solusi yang diberikan berdasarkan Peraturan Daerah Kota Malang Nomor 4 Tahun 2011 Tentang RTRW Kota Malang Tahun 2010-2030? Tujuan penelitian ini adalah untuk mengetahui pengimplementasian permasalahan kawasan cagar budaya di jalan Ijen nomor 75c dijadikan tempat usaha dan untuk mengetahui hukum dalam menghadapi hambatan Badan Perencanaan, Penelitian dan Pengembangan Daerah Kota Malang dalam melindungi kawasan cagar budayadi Jalan Ijen Penulisan karya tulis ini menggunakan metode yuridis empiris dengan motode pendekatan yuridis sosiologis. Jenis data primer, sekunder yang diperoleh penulis akan dianalisa dengan menggunakan teknik analisis yuridis sosiologis, yaitu dengan melihat peraturan perundang-undangan dan kemudian dianalisis berdasarkan keadaan yang sebenarnya, literatur, jurnal, skripsi, yang dijadikan rujukan dalam menyelesaikan permasalahan hukum yang menjadi objek kajian. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada, untuk membangun rumah tersebut harus dengan kebijakan pemerintah dengan rekonstruksi dengan mengambil refrensi bangu nan disekitarnya. Agar bangunan tersebut tetap lestari pemerintah meningkatkan fungsi bangunan tersebut.Cara ini menggunakan mekanisme adaptive re-new.Dan membentuk Tim Ahli Cagar Budaya (TACB) untuk mengatasi dan menganalisa permasalahan bangunan cagar budaya Kota Malang.
English Abstract
In this thesis, the authors raised the problem of Implementation of Article 44 paragraph (3) of Malang Regional RegulationNo. 4 year 2011 Malang Related Building Area of Cultural Heritage Area ofIjen number 75C as Place of Business. Against the mayor's regulation stating that the street of ijen includes the area of Cultural Heritage. Based on the things mentioned above, this paper raises the formulation of the problem: (1) How the implementation of Article 44 paragraph (3) of Malang City Regulation No. 4 of 2011 on RTRW Malang City 2010-2030 in the street Ijen Number 75C as a place of business? (2) What Barenlitbang barriers to protect the Heritage Buildings and solutions provided based on Malang District Regulation No. 4 of 2011 on RTRW Malang Year 2010-2030? The purpose of this research is to find implementation of the area of cultural heritage problems in the way of ijen number 75c becomes business place and well aware of the law in the face of obstacles to planning board , research and development of the area of a city malang in protecting heritage area budayadi the way of ijen The writing of a piece of writing it uses a method of juridical empirical with motode sociological juridical approach .Types of data on primary , secondary obtained will be analyzed by the writer with using a technique juridical sociological analysis , namely by look at the rules statutory and then analyzed in order based on the state of being actual , literature , a journal , a thesis , reference hospitals in resolving problems the law who are the objects of the study The research by the above , writers have answers to the existing problems , to build a house has to be with government policy with reconstruction by taking refrensi bangu nan around him .To preserve the building governments improve function building this tersebut.cara re-new adaptive using mechanisms .And build a team of cultural heritage ( TACB ) to overcome and analyzes the problems poor city heritage buildings
