Abstract
Penelitian ini dilatar belakangi oleh Efektivitas Hukum Pelaksanaan Kerjasama dilingkungan Pemerintah Kota Tarakan melalui Satuan Kerja Perangkat Daerah dengan Lembaga Pemberdayaan Masyarakat Kelurahan (LPM Kelurahan) dalam Pemberian Hibah. Berdasarkan hal tersebut diatas, Penelitian ini mengangkat rumusan masalah : (1). Bagaimana Efektivitas Hukum Pelaksanaan Kerjasama antara Satuan Kerja Perangkat Daerah dengan Pihak Ketiga ? (2). Faktor - faktor apa saja yang mempengaruhi Efektivitas Hukum Pelaksanaan Kerjasama antara Satuan Kerja Perangkat Daerah dengan Pihak Ketiga dan diantara faktor-faktor tersebut faktor mana yang paling dominan pengaruhnya terhadap Efektivitas Hukum Pelaksanaan Kerjasama tersebut serta apa saja hambatan dan solusinya? Kemudian penelitian ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis sosiologis (socio legal research). Bahan hukum primer dan sekunder yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis deskriptif kualitatif Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa Efektivitas Hukum Pelaksanaan Kerjasama Pemerintah Kota Tarakan dengan Lembaga Pemberdayaan Masyarakat Kelurahan dapat dilihat dari daftar penerima hibah dan daftar penerima hibah yang direalisasi pada tahun 2012 dan tahun 2013. Kemudian faktor-faktor yang mempengaruhi efektivitas hukum pelaksanaan kerjasama tersebut yaitu faktor hukum, faktor penegakan hukum, faktor sarana atau fasiltas yang mendukung, faktor masyarakat dan faktor budaya. Faktor yang paling dominan yaitu faktor hukum. Dalam Efektivitas Hukum Pelaksanaan Kerjasama tersebut menemui hambatan yaitu kurang tegasnya sanksi hukum dalam Peraturan Walikota, Minimnya Dana dan Staf dalam Penunjang Operasional untuk melakukan Monitoring dan Evaluasi, Tidak adanya Struktur Kelembagaan yang Khusus Menangani Monitoring dan Evaluasi Pelaksanaan Kerjasama antara Satuan Kerja Perangkat Daerah dengan Pihak Ketiga, dan Kurangnya Pemahaman Lembaga Pemberdayaan Masyarakat atas Peraturan yang Berlaku. Solusi untuk meminimalisir hambatan tersebut yaitu dengan melakukan sosialisasi, menambahkan anggaran operasional dan staf, mempertegas sanksi dan menambahkan struktur kelembagaan pada Bagian Kerjasama.
English Abstract
This study was motivated by Law Implementation Effectiveness Cooperation environment Tarakan City Government through the regional work units with the Institute for Community Empowerment Village (Village LPM) in Grants. Based on the above, this study raised the formulation of the problem: (1). How Effectiveness Law Implementation Cooperation between regional work units with Third Parties? (2). Factors - factors that influence the effectiveness of the Implementation of the Law of Cooperation between regional work units with Third Parties and among those factors which are the most dominant factor of influence on the Effectiveness of the Implementation of the Law of the cooperation and what are the barriers and solutions? Then this research using empirical juridical with sociological juridical approach (socio legal research). Primary and secondary legal materials obtained by the author will be analyzed using qualitative descriptive analysis technique From the results of the study with the above method, the authors obtained the answers to the problems that exist that Law Implementation Effectiveness Tarakan City Government Cooperation with the Institute for Community Empowerment Village can be seen from the list of grant recipients and a list of grant recipients are realized in 2012 and 2013. Then the factors which affects the effectiveness of law enforcement cooperation is a factor of law, law enforcement factors, factors which support means or facility, community factors and cultural factors.
