Abstract
Pada skripsi ini, penulis mengangkat permasalahan Dasar Dan Pertimbangan Hakim Dalam Menerima Permohonan Pengangkatan Anak yang Tidak Memenuhi Syarat-Syarat Calon Orangtua Angkat. Pilihan tema tersebut dilatarbelakangi oleh adanya permohonan pengangkatan anak yang dikabulkan oleh hakim tercatat dengan register perkara No. 1019/PDT/P/2013/ PN.PBR, walaupun tidak memenuhi syarat calon orangtua angkat seperti yang terdapat dalam Pasal 13 huruf g Peraturan Pemerintah Nomor 54 Tahun 2007 Tentang Pelaksanaan Pengangkatan Anak yaitu calon orangtua angkat tidak atau belum mempunyai anak atau hanya memiliki satu orang anak, sedangkan calon orangtua angkat di kasus ini telah mempunyai 3 orang anak sebelumnya. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah: Bagaimana kesesuaian antara dasar dan pertimbangan hakim dalam Penetapan No. 1019/PDT/P/2013/ PN.PBR dengan Pasal 13 Peraturan Pemerintah Nomor 54 Tahun 2007 tentang Pelaksanaan Pengangkatan Anak? Kemudian penulisan karya tulis ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis dianalisis dengan menggunakan teknik analisis gramatikal, yaitu suatu metode analisis bahan hukum dengan cara menafsirkan kata-kata dalam undang-undang sesuai kaidah bahasa dan kaidah hukum tata bahasa, atau merumuskan suatu peraturan perundang-undangan menggunakan bahasa yang dipahami oleh masyarakat yang menjadi tujuan pengaturan hukum tersebut. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa dasar dan pertimbangan hakim dalam Penetapan No. 1019/PDT/P/2013/ PN.PBR sebenarnya tidak sesuai dengan Pasal 13 huruf g Peraturan Pemerintah Nomor 54 Tahun 2007 tentang Pelaksanaan Pengangkatan Anak. Tetapi, karena peraturan perundang-undangan tersebut tidak tepat dengan permasalahan dalam kasus ini,dikarenakan ibu kandung anak angkat tersebut adalah ibu tunggal, maka hakim dapat menemukan sendiri hukumnya. Meskipun tidak sesuai dengan Pasal 13 huruf g Peraturan Pemerintah Nomor 54 Tahun 2007 tentang Pelaksanaan Pengangkatan Anak mengenai syarat-syarat calon orangtua angkat, permohonan pengangkatan anak tersebut telah sesuai dengan tujuan pengangkatan anak yang terdapat dalam Undang-undang Nomor 35 Tahun 2014 Tentang Perubahan Atas Undang-undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak, yaitu untuk kepentingan terbaik bagi anak. Masa depan anak tersebut akan lebih terjamin ketika ia dirawat oleh orangtua angkatnya yang mampu secara ekonomi dan finansial, dibandingkan jika ia tetap dalam pengasuhan ibu kandungnya yang merupakan ibu tunggal dan masih belum siap untuk menjadi orangtua.
English Abstract
In this thesis, the author raises the issue of Basic And Considerations of the Judge In Granted Adjuration of Adoption which is Ineligible-Term Prospective Adoptive Parents. The theme is choice motivated by the adoption adjuration is granted by a judge with the register case No. 1019 / PDT / P / 2013 / PN.PBR, although is not qualify the terms of prospective adoptive parents as contained in Article 13 letter g of Government Regulation No. 54 Year 2007 on the Implementation of Adoption that the prospective adoptive parents should have not had children or just had only one children, while the prospective adoptive parents in this case has had three previous children. Therefore, this thesis attempt to analyze the problem: How is the accordance between the base and the consideration of the judges in the Determination No. 1019 / PDT / P / 2013 / PN.PBR and the Article 13 of Government Regulation No. 54 of 2007 on the Implementation of the Adoption? Then this thesis using normative juridical method which is statute approach and case approach. Primary legal materials, secondary, and tertiary obtained by the author is analyzed using grammatical analysis technique, which is a method of analysis of legal materials by means of interpreting the words of the law according to the rules of language and grammar rules of law, or formulate laws invitation to use language that is understood by society which is the purpose of the law’s regulation itself . From the results of this thesis by the above method, the authors obtained the answers to the problems show that basis and consideration of the judge in the Judge’s Determination No. 1019 / PDT / P / 2013 / PN.PBR is not in accordance with Article 13 letter g of Government Regulation No. 54 of 2007 on the Implementation of Adoption. However, the regulation is not appropriate to the issues in this case, because her biological mother is a single mother, that’s why the judge may find law by themselves. Although the adoption is not accordance with Article 13 letter g of Government Regulation No. 54 of 2007 on the Implementation of Adoption about the terms of prospective adoptive parents, but the application for removal of the child in accordance and suitable with the purpose of adoption contained in Act No. 35 year 2014 about changes in the Act No.23 Year 2002 on Child Protection , which is in the best interest for the adopted child. The future of the child will be more secure when she was treated by adoptive parents who are economically and financially well, than if she remained in the care of her biological mother who is a single mother and still not ready to be parents.
