Abstract
Pada skripsi ini, penulis mengangkat permasalahan Keabsahan Ijab Kabul Melalui Telepon dan Skype. Pilihan tema tersebut dilatar belakangi oleh adanya kekosongan hukum pada praktik perkawinan tersebut, dimana belum ada pasal dalam peraturan perundang-undangan yang mengatur secara spesifik tentang keabsahan ijab kabul melalui telepon dan skype. Selain itu penulis ingin menggambarkan bagaimana bentuk perkawinan yang ijab dan kabul dilakukan melalui telepon dan skype. Tentunya akan menjadi sebuah kerugian bagi pelaku perkawinan melalui telepon dan skype apabila perkawinan mereka tidak diakui dengan alasan belum ada undang-undang yang secara khusus mengatur terkait pelaksanaannya. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : (1) Apakah Ijab Kabul melalui telepon dan skype sah sesuai dengan ketentuan pasal 27 sampai dengan pasal 29 Kompilasi Hukum Islam? (2) Bagaimanakah bentuk pengaturan Ijab Kabul melalui telepon dan skype. Penulisan karya tulis ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statute approach) dengan menelaah dan memahami peraturan perundang-undang mengenai kedudukan ijab kabul melalui telepon dan skype sebagai syarat sah sebuah perkawinan. Mengenai data penelitian penulis memperoleh data dari menganilisis peraturan perundang-undangan terkait perkawinan Undang-Undang Nomor 1 Tahun 1974, Kompilasi Hukum Islam dan Peraturan Pemerintah Nomor 9 Tahun 1975 dan dari studi kepustakaan. Dari hasil penelitian, penulis memperoleh jawaban atas rumusan masalah yang ada. Ijab Kabul melalui telepon dan skype adalah sah selama semua ketentuan dapat dipenuhi yaitu syarat sah perkawinan, rukun perkawinan, syarat-syarat perkawinan, perkawinan didaftarkan dan dicatat, serta kedua mempelai bukan pasangan yang diharakman untuk kawin. Ijab kabul melalui telepon dan skype tidak bertentangan dengan Pasal 27 sampai dengan Pasal 29 Kompilasi Hukum Islam, dan memenuhi aspek dalam pasal-pasal tersebut. Perkawinan yang ijab kabul melalui telepon dan skype selama memenuhi tata cara perkawinan yang tertuang dalam Pasal 10-11 PP Nomor 9 Tahun 1975 juga dapat dikatakan sah. Persyaratan satu majelis dalam ijab kabul dalam perkawinan yaitu menyangkut tentang kesinambungan waktu antara ijab dan kabul yang tidak boleh diselingi oleh aktifitas lain yang dirasa mengganggu jalannya ijab kabul, bukan diartikan para pihak dalam perkawinan harus bersatu secara fisik dalam suatu ruangan. Dengan adanya penelitian ini diharapkan dapat memberikan kepada masyarakat perihal ijab kabul melalui telepon dan skype, dan dapat dijadikan pertimbangan bagi pembuat kebijakan untuk dapat diatur dalam undang-undang perkawinan terbaru.
English Abstract
On this thesis , raised problems writer ijab the validity of kabul via telephone and skype. The choice of the theme background emptiness by law on practices in the marriage, where there has been no article in local regulations specifically concerning the validity of ijab kabul via telephone and skype. In addition writer want to illustrate how a form of marriage that ijab and kabul conducted over the telephone and skype. Of course it would be a loss for prospective brides by telephone and skype if consummated their marriage not recognized by reason there has been no the act that specifically regulates related to its implementation. Based on it above, a piece of writing this raised synthesis problem: ( 1 ) whether ijab kabul via telephone and skype valid based on the provisions of article 27 Until with article 29 compilation of islamic law ? 2.the how is the form of arrangement ijab kabul via telephone and skype. Writing a piece of writing this using methods of juridical normative method approach with legislation approach ( statute ) with analyses and understand about regulation legilslation ijab kabul via telephone and skype as conditions valid a marriage. Regarding the data research writer obtain data from analyze Undang-Undang Nomor 1 Tahun 1974, Compilation of Islamic law and Peraturan Pemerintah Nomor 9 Tahun 1975 and from the study of literature. From the research, writer obtain an answer for synthesis existing problems. Ijab Kabul via telephone and skype is valid for all the requirements can be met namely qualified valid marriage , unity marriage , the terms of marriage , marriage registered and noted , From the research , the writer received an answer for the formulation problem. Ijab kabul via telephone and skype is valid for all the provisions which could be met legal requirements of marriage, marriage unit, the terms of marriage, marriage registered and noted, and both the bridegroom is not a couple who illegitimate to mate. Ijab kabul through skype phone and not contrary to article 27 to article 29 a compilation of islamic law , and meet aspects in the articles. Marriage ijab kabul via telephone and skype for fulfilling marriage procedures set out in article 10-11 Peraturan Pemerintah Nomor 9 Tahun 1975 can also be said to be valid. The requirements of one assembly ijab in kabul in a marriage that is concerning about the continuity of the time between ijab and kabul could not be interspersed by other activities are disrupt the ijab kabul, not be interpreted the parties in marriage must unite physically in a room. With the research is expected to give to the community regarding ijab kabul via telephone and skype, and could be consideration for policy makers to be arranged in the marriage laws latest.
