Abstract

Banyaknya jumlah penduduk dan terbatasnya lapangan pekerjaan di Indonesia menjadi salah satu faktor pendorong banyaknya masyarakat yang ingin bekerja diluar negeri. Keingian untuk memperbaiki kualitas hidup seakan menutup bayangan akan kekerasan, eksploitasi dan deportasi yang sewaktu waku dapat terjadi kepada mereka. Salah satu negara yang menjadi negara tujuan adalah Taiwan. Dimulai dengan adanya faktor pendorong adanya program penempatan Buruh Migran Indonesia di Taiwan . Adanya Buruh Migran Indonesia yang bekerja di luar negeri mendorong pemerintah untuk membuat aturan yang berguna untuk melindungi para Buruh Migran Indonesia. Melihat permasalahan yang terjadi kepada Buruh Migran Indonesia yang berada di Negara Taiwan. Maka tentu menimbulkan pertanyaan bagaimana cara mengantisipasi atau menyelesaikan permasalahan yang terjadi pada Buruh Migran Indonesia yang berada di Taiwan, dan sejauh mana pemerintah Indonesia menyelesaikan permasalahan Buruh Migran Indonesia di Taiwan. Jenis penelitian yang digunakan yaitu penelitian Normatif. pendekatan yang digunakan di dalam penelitian hukum adalah pendekatan perundang-undangan (Statute Approach) dan pendekatan Kasus (Case Approach). Perlindungan Tenaga Kerja di Taiwan antara Recruitment Agreement Between Indonesia Labor Agency (PJTKI/PJTKIS) And Taiwanese Labor Agency Dengan Konvensi PBB Tahun 1990 Tentang Perlindungan Hak Semua Pekerja Migran Dan Keluarganya (International Convention of Protection of the Human Rights of All Migrant Workers and Member of Their Families) adalah telah berjalan selaras, walaupun masih ada hak-hak yang belum diatur di dalam Perjanjian Rekrut Tenaga Kerja Indonesia antara Perusahaan Jasa Tenaga Kerja Indonesia (PPTKIS) dengan perusahaan Jasa Tenaga Kerja Taiwan (Recruitment Agreement Of Indonesian Manpower Between Indonesia Labor Agency (PJTKI/PPTKIS) And Taiwanese Labor Agency )).

English Abstract

A large numbe of the population and the limited employement opportunities in Indonesia become one of the factors driving the number of people want to work abroad. The desire to improve the quality of life as if crossing them. One of the contries that become the destination is Taiwan. Starting with the driving factors is the placement program of Indonesian migrant workers in Taiwan. The prescent of Indonesia migrant workers, who work abroad prompted the government to make rules that are usefull for the protection of Indonesia migrant workers. Seeing the problems that happened to Indonesian migrant workers who are in Taiwan, then of course raises the quietion of how to anticipate or resolve the problems that occurred in Indeonesian migrant workers who are in Taiwan, and the extent to which the Indonesian government to solve the problems of Indonesian migrant workers in Taiwan. This research is using normative method the approach used in this study of law is the approach is legislation the requitment agreement that win Indonesia labor agency (PJTKI/PJTIKS) and Taiwanese labor agency with the UN convention of 1990 on the protection of the rights of all migrant workers and their families (international convention of protection of the human rights of all migrant workers and member of their familes) is running in synch, although they are right that are Indonesia (PPTKIS) with firm manpower service Taiwan (requitment agreement of Indonesia manpower between Indonesia labor agency (PJTKI/PJTIKS) and Taiwanese labor agency)
