Abstract
Pada skripsi ini, penulis mengangkat mengenai permasalahan retribusi pelayanan kesehatan. Pilihan tema tersebut dilatar belakangi oleh adanya masalah pelayanan kesehatan pada masyarakat miskin yang terjadi Kabupaten Ponorogo tepatnya di Desa Munggu Kecamatan Bungkal. Pada dasarnya kesalahan Rumah Sakit Umum Daerah mengenai pelayanan kesehatan terhadap pasien miskin tidak patut dilakukan karena sepihak karena tindakan tersebut akan mengurangi rasa kemanusian dan keadilan, selain itu dalam suatu peraturan perundang-undangan pun juga sudah dijelaskan. Berdasarkan latar belakang tersebut, maka rumusan masalah pada penelitian ini adalah (1) Bagaimana implementasi pasal 3 ayat (1) Peraturan Daerah Nomor 17 Tahun 2011 tentang retribusi pelayanan kesehatan pada Rumah Sakit Umum Daerah Dr. Hardjono S. Kabupaten Ponorogo ? (2) Apa hambatan dan bagaimana solusinya yang dihadapi Rumah Sakit Dr. Hardjono S. Ponorogo terkait dalam memberikan pelayanan kesehatan terhadap pasien tidak mampu? Kemudian jenis penelitian ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis sosiologis. Lokasi penelitian di Kabupaten Ponorogo dan Rumah Sakit Umum Daerah Ponorogo. Jenis dan sumber data adalah data primer dan data sekunder. Data primer diperoleh dengan melakukan wawancara langsung dengan responden. Data sekunder diperoleh studi kepustakaan, studi dokumen dan studi internet. Teknik analisa bahan hukum yaitu menggunakan metode deskriptif kualitatif dan definisi konseptual yang digunakan yaitu retribusi pelayanan kesehatan dan pasien miskin. Dari hasil penelitian dapat diketahui bahwa belum sesuai implementasi Peraturan Daerah Kabupaten Ponorogo nomor 17 tahun pasal 3 ayat (1) dengan hasil lapangan terhadap pelayanan kesehatan pasien miskin. Dapat diketahui Peraturan tersebut mencangkup 1. Pendataan, 2. Mekanisme pelayanan, 3. Pendanaan. Dalam menangani permasalahan retribusi pelayanan kesehatan terhadap pasien miskinterdapat beberapa hamabatan yaitu proses administrasi untuk mendapatkan program pelayanan kesehatan, minimnya tenaga medis dan non medis rumah sakit dalam pelaksanaan pelayanan kesehatan, kurangnya fasilitas kesehatan pasien, ketidakjelasan pembiayaan kesehatan.. Kendala eksternal yaitu masyarakat miskin yang berada di Kabupaten Ponorogo rata-rata memiliki SDM yang rendah. Upaya yang dilakukan Pemerintah dalam mengatasi hambatan eksternal yaitu Pemerintah melalui Dinas Kesehatan melakukan sosialisasi dan pendataan untuk kepentingan warga miskin dalam memperoleh jaminan kesehatan, kebijakan Rumah Sakit Umum Daerah untuk menambah tenaga medis dan nonmedis, Kewenangan Rumah Sakit Umum dalam prasarana dan fasilitas yang diberikan setiap tahun sesuai dengan aturan, Pemerintah atau Pemerintah Provinsi dan/atau kelompok x khusus dalam retribusi pelayanan kesehatan sesuai aturan. Upaya yang dilakukan Pemerintah untuk mengatasi hambatan eksternal denganmembuat sitem informasi yang terpadu dan juga membangun sosialisasi.
English Abstract
In this thesis, the author raised the issue of health care levy. The choice of theme background by the problem of health care in poor communities that occurred precisely in the Village Ponorogo Munggu District of Bungkal. Basically error Regional General Hospital on health care to poor patients should not be committed due to unilateral because such action would reduce the sense of humanity and justice, in addition to a legislation was also already described. Based on this background, the formulation of the problem in this study are (1) how the implementation of article 3, paragraph (1) Regional Regulation No. 17 of 2011 on the health care levy on Regional General Hospital Dr. Hardjono S. Ponorogo? (2) What are the obstacles and how the solution facing the Hospital Dr. Hardjono S. Ponorogo involved in providing health care to patients can not afford? Then this kind of research using empirical juridical sociological juridical approach. The research location in Ponorogo and District General Hospital Ponorogo. Types and sources of data are primary data and secondary data. Primary data were obtained by direct interviews with respondents. Secondary data were obtained literature study, study and study documents the internet. Legal materials analysis techniques that use descriptive method qualitative and conceptual definitions were used that on health services and poor patients. From the results of this research is that not appropriate implementation Ponorogo District Regulation number 17 of article 3 paragraph (1) with field results to health care for poor patients. The regulation covers knowable 1. Data Collection, 2. Mechanism of services, 3. funding. In addressing the problems of health care to patients levy miskinterdapat some hamabatan namely administrative processes to obtain health care programs, the lack of medical personnel and non-medical hospitals in the implementation of health care, lack of patient health facilities, health financing obscurity .. external constraints that poor people who are in Ponorogo average have low human. Efforts made by the Government in overcoming external obstacles that the Government through the Department of Health to disseminate and data collection for the benefit of poor people in obtaining health insurance, policy Regional General Hospital to augment medical and nonmedical, Public Hospital Authority in the infrastructure and facilities provided every year in accordance with the rules, the Government or the Provincial Government and / or special groups in the health care levy according to the rules. Efforts made by the government to overcome external obstacles denganmembuat integrated information system and also build socialization.
