Abstract
Dalam penulisan skripsi ini penulis membahas tentang implementasi diversi pada tingkat penyidikan terhadap tindak pidana penganiayaan yang dilakukan anak (studi di polres madiun kota ) . Hal ini dilatarbelakangi bahwa masih banyak adanya anak yang berhadapan dengan hukum. Salah satunya adalah yang terdapat di kota madiun yang melakukan tindak pidana penganiayaan. Pada tahun 2014 telah diberlakukannya diversi, yaitu salah satu perwujudan dari keadilan restoratif (restorative justice) yang terdapat pada undang-undang nomor 11 tahun 2012. Penelitian ini merupakan penelitian empiris dan menggunakan metode pendekatan yuridis sosiologis. Penelitian dilakukan terhadap keadaan nyata di masyarakat dengan maksud dan tujuan untuk menemukan fakta kemudian mengidentifikasi masalah, dan pada akhirnya memperoleh penyelesaian masalah. Hasil data penelitian tersebut diolah dan dianalisis secara diskriptif analisis. Pada penelitian yang dilakukan di polres madiun kota, unit perlindungan perempuan dan anak satreskrim polres madiun kota telah menyelesaikan 2 kasus pada tahun 2012, 2 kasus pada tahun 2013, 4 kasus pada tahun 2014 dan nihil pada tahun 2015. Selama 4 tahun tersebut unit perlindungan perempuan dan anak satreskrim polres madiun kota melakukan 2 kali diversi pada tahun 2014 dikarenakan berlakunya undang-undang sistem peradilan pidana anak yaitu undang-undang no 11 tahun 2012 baru berlaku 31 juli 2014. Dalam melakukan diversi penyidik mengalami beberapa kendala. Namun kepolisian juga melakukan upaya untuk menangani kendala yang di hadapi. Salah satunya adalah tersitanya waktu. Penyidik diberi waktu 30 hari untuk melakukan diversi, dan waktu tersita 7 hari untuk dibuatnya penelitian masyarakat yang dilakukan bapas. Upaya yang dilakukan adalah bekerja sama dengan bapas dan berkoordinasi dalam menyelesaikan secara tepat waktu.
English Abstract
In this research, the writer talks about the diversion of implementation in investigation level of a criminal law against child maltreatment (a case study at a Police Resort of Madiun). The background of this case is there are still a lot a of children who against the rule/law. One of them is located in Madiun who had done the maltreatment. In 2014, diversion has been applicable, which is one of the embodiment of restorative justice contained in Law No. 11 of 2012. This research is an empirical research and using the method of sociological juridical approach. The research is conducted on the real situation in society with intent and purpose of finding facts and then identify problems, also ultimately acquire problem solving. The results of the research’s data were processed and analyzed by descriptive analysis. In the research which is conducted at the police stadion of Madiun, women and child Protection police units of Satreskrim of Madiun has completed two cases in 2012, 2 cases in 2013, 4 cases in 2014 and nil in 2015. For 4 years, the women and child protection police units of Satreskrim of Madiun did 2 times of diversion in 2014 due to the effect of the law juvenile criminal justice system that is the law No. 11 of 2012 newly enacted 31 July, 2014. In doing the diversion, investigators encountered some obstacles. But the police are also making efforts to address the obstacles they faced. One of them is the waste of their time. Investigators were given 30 days to do diversion, and for 7 days out, community research was made by Bapas. The efforts is cooperating with Bapas and coordinating in completing the work on time.
