English Abstract
In this thesis, the author take problem from the the effectiveness of giving legal aid to defendant who are not financially capable by advocate. The theme options above comes from the author who want to see how far the realization of giving legal aid to defendant who are not financially capable by advocate based on the laws and also difficult to find peoples who will voluntary work without rewards. From the statement above, the writing of this thesis resulted the problem identification : (1) How the effectiveness of giving legal aid to defendant who are not financially capable by advocate at PERADI Cabang Malang? (2) What the obstacle faced of giving legal aid to defendant who are not financially capable by advocate at PERADI Cabang Malang?Then this minor thesis using empirical juridicalmethod. The primary law, secondary materials obtained in the analysis in descriptive kualitative.From the result or research with the above methods, the author answers to existing problems that the realization of giving legal aid to defendant who are not financially capable by advocate yet effective because review from five factor the are the laws, law enforcement, facilities and tools, society and culture. Some cases handled by advocate at PERADI Cabang Malang already completed based on procedure. There are some obstacles in realization of giving legal aid to defendant who are not financially capable from the society or from the advocates. Some eforts also do to anticipate the obstacles thatixhappened starting from socialiszation and increase quality resources the professional advocates
