Abstract
Pada skripsi ini, penulis mengangkat permasalahan Perlindungan Tenaga Kerja Indonesia Oleh Pemerintah Berdasarkan Undang-Undang Nomor 39 Tahun 2004 Tentang Penempatan Dan Perlindungan Tenaga Kerja Indonesia Di Luar Negeri. Pilihan tema terseebut dilatar belakangi oleh makin banyaknya penduduk Indonesia yang bekerja di luar negeri yang berasal dari Kabupaten Kediri, yang ingin memperbaiki perekonomian rumah tangganya deengan bekerja di luar negeri dengan pengetahuan yang sangat minim dan tanpa prosedur yang sesuai dengan Perundang-undangan. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : (1) Bagaimana bentuk perlindungan yang dapat diberikan oleh Pemerintah Indonesia dalam hal melindungi Tenaga Kerja Indonesia di luar negeri yang berasal dari Kabupaten Kediri? (2) Apa kendala yang dihadapi oleh Pemerintah Indonesia dalam hal perlindungan terhadap Tenaga Kerja Indonesia yang bekerja di luar negeri yang berasal dari Kabupaten Kediri? Kemudian penulisan karya tulis ilmiah ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis-sosiologis. Sumber data primer dan sekunder yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisisdeskriptif kualitatif, yaitu data yang diperoleh di sajikan secara deskriptif dan di analisis secara kualitatif artinya baik data primer maupun data sekunder akan di analisis dengan menggunakan pendekatan content analisis/analisis isi agar mencapai kejelasan dalam masalah penelitian yang sedang di bahas. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa perlindungan yang dilakukan oleh Pemerintah Indonesia terhadap Tenaga Kerja Indonesia ada tiga tahap, yaitu sebelum penempatan, pada saat penempatan, dan purna penempatan. Pasal 1 ayat (4) Undang-undang Nomor 39 Tahun 2004 tentang Perlindungan dan Penempatan Tenaga Kerja Indonesia Di Luar Negeri, menjelaskan bahwa Perlindungan Tenaga Kerja Indonesia adalah upaya untuk melindungi kepentingan Tenaga Kerja Indonesia dalam hal mewujudkan terjadinya pemenuhan hak-hak yang sesuai dengan peraturan perundang-undangan, yaitu, baik sebelum, selama maupun sesudah bekerja. Dalam penerapannya pemerintah mengalami kendala, yaitu : Pemerintah dinilai masih sangat lamban untuk pemberian pembekalan terhadap Tenaga Kerjanya, minimnya pengetahuan dasat Tenaga Kerja tersebut mengenai hukum yang berlaku di negara mereka bekerja, penanganan yang sangat lamban di lakukan Peerintah ketika Tenaga Kerja Indonesia tersebut tersandung suatu masalah di negara ia bekerja, penaganannya harus step by step. Dari kendala tersebut, seharusnya Pemerintah merubah sistim penanganan Tenaga Kerja Indonesia tidak step by step, lalu pembekalan pengetahuan dasar Tenaga Kerja Indonesia dilakukan dengan baik yang sesuai dengan peraturan Perundangundangan.
English Abstract
In this paper, the authors raised the issue of Protection of Indonesian Workers By Government Based on Law Number 39 Year 2004 concerning the Placement and Protection of Indonesian Workers Abroad. Terseebut theme choice motivated by the increasing number of Indonesian population are working abroad originating from Kediri regency, who want to improve their household economy deengan working abroad with very minimal knowledge and without procedures in accordanc.. Based on the above, this paper raised the formulation of the problem: (1) What sort of protection that can be provided by the Government of Indonesia in terms of protecting Indonesian Workers abroad originating from Kediri Regency? (2) What are the constraints faced by the Government of Indonesia in the protection of Indonesian Workers who work abroad originating from Kediri Regency? Then writing scientific papers using empirical juridical method with sociojuridical approach. Primary and secondary data sources were obtained by the author will be analyzed using qualitative analisisdeskriptif technique, ie the data obtained in the present descriptive and qualitative analysis of data means that both primary and secondary data will be analyzed using content analysis approach / content analysis in order to achieve clarity in the matter of research beingdiscussed. From the results of research by the above method, the authors obtain answers to existing problems that protection by the Government of Indonesia for Indonesian Workers there are three stages, namely prior to placement, at the time of placement, and after placement. Article 1 (4) of Law No. 39 of 2004 on the Protection and Placement of Indonesian Workers Abroad, explained that the Protection of Indonesian Workers is an attempt to protect the interests of Indonesian Workers in realizing the fulfillment of rights in accordance with the regulations legislation, that is, both before, during and after work. In practice the government have constraints, namely: the government is still very sluggish for giving a briefing to the Work Force, the lack of knowledge of the Labor Dasat of applicable law in the country they work, handling is very slow in doing Peerintah when the Indonesian Workers stumbled a problem The countries he worked, penaganannya must step by step. From these constraints, the government should amend the handling system of Indonesian Workers do not step by step, then debriefing basic knowledge of Indonesian Workers done in accordance with the regulations Legislation.
