Abstract
Suami sebagai kepala keluarga dalam rumah tangga bertanggung jawab untuk memenuhi semua kebutuhan baik pakaian, nafkah, tempat tinggal serta biaya bagi anak-anaknya guna tercipta keluarga yang sakinah, mawaddah dan rahman, namun saat ini sering ditemui di masyarakat ditemui beberapa masalah keluarga salah satunya adanya kelalaian tanggung jawab suami dimana suami lalai tidak memberi nafkah kepada istri dan anaknya karena alasan-alasan tertentu baik disengaja maupun tidak disengaja. Suami yang tidak mampu menafkahi isteri bisa dianggap berhutang dan isteri berhak menuntut pengembalian atas nafkah madliyah tersebut. Seorang suami yang tidak memenuhi kewajibannya dan tidak bisa memberikan nafkah kepada isterinya, maka isteri bisa memohon ke pengadilan untuk meminta pembayaran nafkah yang telah menjadi hutang bagi suaminya tersebut namun di dalam pasal 116 huruf g Kompilasi Hukum Islam hal ini dapat berakibat pada perceraian. Dalam penelitian ini akan dibahas mengenai permasalahan bagaimana kajian yuridis terhadap Nafkah Madliyah dalam perkara perceraian menurut Kompilasi Hukum Islam bagi istri dan bagi anak (sah)
English Abstract
The husband as head of the family in the household is responsible for fulfilling all the needs of both clothing, livelihood, shelter and fees for the children to create a family that sakinah, mawaddah and rahman, but today is often encountered in the community met some family problems one of them for negligence where the husband's responsibility is not inattentive husband provide for his wife and children because of certain reasons both intentional and accidental. Husband and wife who are unable to feed could be considered debt and wife entitled to claim refund of the living madliyah. A husband who does not meet its obligations and can not provide maintenance to his wife, then the wife can apply to the court to request payment which has become a living for her husband's debts, but in the Article 116 letter g Compilation of Islamic Law this can result in divorce. In this study will be discussed on how to study juridical problems of the Livelihoods Madliyah in their divorce case according to Islamic Law Compilation for his wife and for children (legitimate).
