Abstract
Pada skripsi ini, penulis mengangkat permasalahan berkenaan dengan keterkaitan posisi Komisi Pengawas Persaingan Usaha (KPPU) sebagai pihak dalam upaya keberatan pelaku usaha terhadap putusan KPPU. Pemilihan tema tersebut dilatarbelakangi oleh pengaturan dalam Perma No. 3 Tahun 2005 yang menyatakan dalam hal diajukan keberatan KPPU adalah sebagai pihak yang mana sebelumnya KPPU merupakan lembaga yang memiliki fungsi quasi judicial. Dalam hal ini, penulis beranggapan bahwa pengaturan terkait dengan makna pihak yang terkandung dalam Perma No. 3 Tahun 2005 tidak sepenuhnya bermakna pihak, karena walaupun dalam upaya keberatan KPPU merupakan pihak, namun dalam perjalanan penanganan upaya keberatan tersebut, KPPU dalam melakukan pemeriksaan tambahan apabila hakim menganggap perlu adanya pemeriksaan tambahan terhadap pelaku usaha. Berdasarkan hal tersebut diatas, penulisan skripsi ini mengangkat rumusan masalah : (1) Bagaimana makna posisi KPPU sebagai pihak dalam upaya keberatan menurut pasal 6 ayat (1) Perma Nomor 3 Tahun 2005? (2) Bagaimana keterkaitan posisi KPPU sebagai pihak dalam pemeriksaan tambahan oleh Pengadilan Negeri terhadap upaya keberatan dengan azas Audi Et Alteram Partem? Kemudian penulisan skripsi ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statute approach). Bahan hukum primer dan sekunder yang diperoleh penulis kemudian akan dianalisa. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa makna posisi KPPU sebagai pihak telah mengalami penyempitan makna, yakni kedudukan posisi KPPU sebagai pihak adalah hanya sebatas pada penyerahan putusan dan berkas acara pemeriksaan kepada pengadilan negeri terhadap upaya keberatan pelaku usaha terlapor. Makna posisi KPPU sebagai pihak yang terdapat dalam Perma No. 3 Tahun 2005 mengalami penyempitan makna pula yang membedakan penafsiran makna pihak diluar hukum acara persaingan usaha, seperti dalam hukum acara perdata yang mana pihak dalam hukum acara perdata dipersamakan kedudukannya di muka pengadilan. Kemudian apabila ditelaah lebih lanjut berdasarkan azas Audi Et Alteram Partem, kedudukan KPPU dalam upaya keberatan khususnya dalam pemeriksaan tambahan, hal ini bertentangan dengan Pasal 4 Ayat (1) Undang-Undang No. 48 Tahun 2009 yang mana dalam pasal tersebut juga mengandung azas Audi Et Alteram Partem. Penulis menyandingkan pasal yang ada dalam Perma No. 3 Tahun 2005 dengan Undang-Undang No. 48 Tahun 2009, dikarenakan dalam Perma No. 3 Tahun 2005 menyatakan bahwa upaya keberatan diajukan di pengadilan negeri dimana kedudukan hukum usaha pelaku usaha, sehingga sudah seyogyanya setiap perkara yang ada di pengadilan negeri berdasarkan Undang-Undang No. 48 Tahun 2009.
English Abstract
In this paper, the authors raised the concern with respect to linkage position Business Competition Supervisory Commission (KPPU) as a party in an attempt objection against the decision of KPPU. The theme was motivated by settings in Supreme Court Regulation No. 3 of 2005 which provides that if the KPPU filed an objection which is as a party before KPPU is an institution that has a quasi-judicial function. In this case, the authors assume that the arrangements relating to the meaning contained in Supreme Court Regulation No. 3 of 2005 is not fully meaningful party, because despite the efforts of objections KPPU is a party, but in the course of handling the appeal efforts, KPPU in conducting additional checks if the judge considers the need for additional checks to businesses. Based on the above, this thesis raised formulation of the problem: (1) How is the meaning of KPPU position as a party in an attempt objection under article 6, paragraph (1) Supreme Court Regulation No. 3 of 2005? (2) How does this position within the Commission as an additional examination by the District Court of the effort objection to the principle of Audi Et Alteram Partem? Then the writing of this method with the approach of normative juridical law (statute approach). Primary and secondary legal materials obtained by the authors then analyzed. interpretation of the results of research by the above method, the authors obtained the answers to the problems that exist that sense the position of KPPU as the party has experienced throttling meaning, ie the position of KPPU position as the party is limited to the submission of the decision and the file of the examination to the district court to attempt objection offender businesses reported. Meaning the position of KPPU as contained in Supreme Court Regulation No. 3 of 2005 narrowed the meaning also distinguishes unlawful interpretation of the meaning of the competition events, such as the law of civil procedure in which a party to the civil law equivalent position in court. Then when explored further by the principle of Audi Et Alteram Partem, the position KPPU in mind in particular the efforts of additional examination, it is contrary to Article 4 Paragraph (1) of Law No. 48 of 2009 which in the article also contains the principle of Audi Et Alteram Partem. Author reconcile the article is in Supreme Court Regulation No. 3 of 2005 by Law No. 48 In 2009, due to the Supreme Court Regulation No. 3 of 2005 states that efforts objections filed in the district court where the legal position of business entrepreneurs, so it is a must that every case in the district court under the Act No. 48 of 2009.
