Abstract
Pasal 16 Undang-undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional mengatur tentang hak peserta untuk memperoleh manfaat dan informasi tentang pelaksanaan program jaminan sosial yang diikuti. Badan Penyelenggaraan Jaminan Sosial (BPJS) berkewajiban untuk memenuhi hak peserta tersebut. Implementasi pasal 16 tersebut menjadi penting untuk diteliti ketika pada 1 Januari 2014 BPJS dibentuk berdasarkan pasal 5 ayat (2) huruf a, Undang-undang Nomor 24 Tahun 2011 tentang BPJS. Selain implementasinya, penting juga untuk meneliti tentang hambatan dan upaya untuk mengatasi hambatan dalam mengimplementasikan pasal 16 tersebut. Penelitian ini merupakan penelitian empiris yang menggunakan pendekatan yuridis sosiologis. Lokasi penelitian di Kota Malang, data primer dan data sekunder didapat dari BPJS Kesehatan Kota Malang dan perusahaan-perusahaan yang menjadi pesertanya. Hasil penelitian menunjukkan bahwa implementasi pasal 16 Undang-undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional mengatur tentang hak peserta untuk memperoleh manfaat dan informasi tentang pelaksanaan program jaminan sosial yang diikuti masih jauh dari tujuan sebagaimana yang diharapkan dalam pasal 3-nya, yaitu pemenuhan kebutuhan dasar hidup yang layak bagi peserta jaminan sosial khususnya dalam hal kesehatan. BPJS Kesehatan memang telah memberikan informasi kepada peserta, tetapi masih dalam bentuk media elektronik yang berupa situs BPJS tersebut. Secara manual khususnya pada kantor BPJS Kota Malang pernah mengundang perusahaan-perusahaan yang menjadi peserta BPJS. Pemberian informasi kepada perusahaan tersebut diharapkan akan dibagikan kepada peserta yang menjadipekerja dari perusahaan-perusahaan yang diundang. Tapi dalam praktiknya hal tersebut tidak dilakukan oleh perusahaan-perusahaan yang menghadiri undangan. Jadi tujuan pemberian informasi tersebut belum berhasil. Hambatan yang dihadapi oleh BPJS Kesehatan Kota Malang dalam mengimplmentasi pasal 16 Undang-undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional dapat dikategorikan menjadi 2, yakni hambatan eksternal dan internal. Hambatan eksternal merupakan hambatan dari pihak pekerjanya di mana Dibagi menjadi 2 hambatan yaitu hambatan ekternal dan hambatan internal, hambatan eksternal dilihat dari sisi pekerja dalam menggunakan jaminan pemeliharaan kesehatan sedangkan hambatan internal dilihat dari sisi BPJS Kesehatan. Berbagai upaya maksimal telah dilakukan, misalnya mensosialisasikan pasal 16 Undang-undang Nomor 40 Tahun 2004 tentang SJSN kepada pekerja melalui serikat-serikat pekerja, paling tidak kepada para pengurus serikat pekerjanya. Hal ini tidak akan membutuhkan banyak biaya, tetapi penambahan jumlah personal di BPJS Kesehatan memang sangat penting.
English Abstract
Article 16 of Act No. 40 of 2004 on National Social Security Systems set up on the rights of the participant to obtain benefits and information on the implementation of the social security program that followed. The Organization of the Social Security Agency (BPJS) the obligation to fulfil the rights of the participants. The implementation of article 16 becomes critical to researched when on 1 January 2014 BPJS formed under article 5 paragraph (2) letter a, Law Number 24 year 2011 about the BPJS. In addition to the implementation, it is important also to research on barriers and overcome obstacles in their efforts to implement the aforementioned article 16. This research is empirical research that uses the juridical sociological approach. Location research in the city of Malang, primary data and secondary data obtained from Health BPJS Malang and companies become participants. The results of research shows that the implementation of article 16 of the law number 40 in 2004 about the system of national social security set about the rights of participants to obtain benefits and information about the implementation of social security program that followed are still far from a goal as expected in article 3-nya , which is fulfilling basic needs decent living for all the social security particularly in terms of health .Health is bpjs have provided information to participants , but still in the form of electronic media of the bpjs .Manually especially in the city poor bpjs ever invited companies to become participants bpjs .The provision of information to the company is expected to be distributed to participants who menjadipekerja of companies invited .But in practice this is not done by companies who attend the invitation .So the purpose of the provision of information the berhas not Obstacles faced by poor health in the city BPJS implement article 16 of the law number 40 in 2004 about the system of national social security can be categorized to 2 , namely external and internal obstacles .The external constraints is the resistance of workers in which is divided into 2 external barriers and obstacles internal obstacles , external obstacles in using seen from the side of workers health insurance while internal barriers bpjs seen from the side of health .Maximum efforts had done , for example socialize article 16 of the law number 40 years 2004 to workers about sjsn through trade unions , at least to the management of the states workers .This would not need a lot of the cost of , but the additional personal bpjs is very important in health .
