Abstract
Pada skripsi ini penulis mengangkat permasalahan mengenai kemiripan satu varietas yang sama dan mirip tetapi terdapat dua sertifikat Hak Perlindungan Varietas Tanaman yang berbeda dan pemegang yang berbeda sementara berdasarkan pasal 2 ayat (2) dan (3) hanya varietas baru dan unik saja yang bisa mendapatkan sertifikat Hak PVT, karena itu penulis ingin mengaji lebih dalam lagi mengenai kriteria atau batasan baru dan unik sebagai syarat suatu varietas bisa mendapatkan sertifikat Hak Perlindungan Varietas Tanaman. Berdasarkan permasalahan yang ada diatas penulis mencoba menarik dua rumusan masalah yaitu: 1. Bagaimanakah bentuk kriteria atau batasan baru dan unik yang dipakai sebagai syarat permohonan sertifikat Hak Perlindungan Varietas Tanaman?, 2. Bagaimanakah bentuk akibat hukum terhadap pemegang sertifikat Hak PVT yang berbeda tetapi ternyata varietas yang didaftarkan merupakan satu varietas yang sama secara visual dan genetik? Jenis penelitian yang dipakai dalam penelitian ini adalah yuridis normatif. Penulis menggunakan pendekatan pendekatan perundang-undangan (Statute Approach). Penulis membagi sumber hukum menjadi tiga, yaitu: bahan hukum primer, bahan hukum sekunder, bahan hukum tersier dan bahan hukum tersier. Penelitian ini diperoleh penulis melalui teknik penelusuran bahan hukum dengan mengunjungi berbagai tempat yang menyediakan bahan hukum tersebut. Metode penafsiran yang dipilih dan akan digunakan oleh penulis adalah penafsiran gramatikal dan penafsiran sistematis. Hasil dari penelitian penulis menunjukan perlunya kesadaran pemerintah dalam melihat permasalahan hukum yang ada saat ini, dalam hal ini terkait dengan keputusan menjadi anggota UPOV atau tidak karena ini sangat berpengaruh pada proses uji keunikan yang dilakukan Pusat PVTPP, khususnya kesulitan dalam pengambilan sampel-sampel varietas yang berasal dari luar negeri, kemudian terkait masalah jika terjadi kemiripan varietas dengan sertifikat hak PVT yang berbeda maka konsekwensi hukumnya adalah sertifikat yang paling baru akan dibatalkan secara hukum hal ini didasarkan atas asas firs to file yang dianut dalamm sistem pendaftaran hak PVT.
English Abstract
In this research the authors raised the issue of the similarityof the same variety and are similar but there are two certificates Plant Variety Rights Protection distinct and defferent holders while based on article 2 verse (2) and (3) only new and unique varieties are able to obtain a certificate PVP rights, therefore, the outhor want to take your lessons more deeply about the criteria of the new and unique restriction as a condition of a variety be certified Plant Variety Protection rights. Based on the existing problems in the above authors tried to draw two formulation of the problem, namely: 1. What kind of criteria new and unique constraints are used as a requirement for a certificate of Plant Variety Protection Rights ?, 2. What kind of legal consequences against the certificate holder PVP different but turned out to be registered varieties of the same variety is visually and genetic? This type of research used in this research is normative. Author approaches using legislation (Statute Approach). The author divides into three sources of law, namely: primary legal materials, secondary legal materials, tertiary legal materials and tertiary legal materials. This study obtained by the author through search techniques of legal materials by visiting various places that provide the legal material. Methods of interpretation that have been and will be used by the authors is the interpretation of grammatical and systematic interpretation. The results of this research reveals the need for awareness of the government in view of the legal issues that exist today, in this case related to the decision of a member of UPOV or not because this is very influential in the process uniqueness test conducted PVTPP, particularly difficulties in taking samples varieties from abroad, then related problems in case of similarity varieties with different PVP right certificate, the legal consequences are the most recent certificate will be canceled by law it is based on the principle of firs to file registration system adopted dalamm PVP.
