Abstract
Pada skripsi ini, penulis mengangkat permasalahan perlindungan hukum bagi penggugat secara perdata yang mengalami kerugian tindak pidana penipuan. Pilihan tema tersebut dilatar belakangi oleh adanya tindakan tindak pidana penipuan dan perbuatan melawan hukum yang dilakukan oleh tergugat I yang dimana perbuatan tersebut dilakukan secara bersama-sama dengan istrinya sebagai tergugat II, kepada salah satu pihak penggugat. Dalam hal ini baik putusan perdata dan putusan pidana telah mempunyai kekuatan hukum tetap, namun perlindungan ganti kerugian dan pertanggung jawaban terhadap korban atau penggugat masih belum dengan sesuai perbuatan yang dilakukan oleh para tergugat. Berdasarkan hal tersebut diatas, penulisan karya tulis ini mengangkat rumusan masalah : (1) Bagaimana perlindungan hukum yang didapatkan oleh Penggugat khususnya, mengenai perlindungan hukum secara Keperdataan atas suatu kerugian perbuatan Tindak Pidana Penipuan dan Perbuatan Melawan Hukum yang telah dilakukan oleh pihak Tergugat ? (2) Apa yang menjadi dasar hukum dalam menentukan hukum waris yang berlaku terhadap pemisahan harta kekayaan waris untuk dijadikan sita jaminan atas suatu perbuatan Tindak Pidana Penipuan dan Perbuatan Melawan Hukum yang telah terjadi ? Kemudian penulisan karya tulis ini menggunakan metode hukum normatif, dengan pendekatan kasus (case approach) dan pendekatan perundang-undangan (statute approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan teknik interpretasi gramatikal dengan cara melakukan penafsiran atau penjelasan yang paling sederhana mengenai pengaturan tentang perlindungan hukum kepada penggugat, serta putusan hakim, dan pengaturan warisan untuk dijadikan sita jaminan yang telah diputuskan untuk mengetahui dalam menyelesaikan permasalahan hukum yang menjadi obyek kajian. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa perlindungan hukum bagi penggugat mutlak harus dilakukan oleh pengadilan, dimana perlindungan hukum yang dimaksud baik perdata maupun pidana adalah perlindungan ganti kerugian dan pertanggung jawaban yang telah diderita oleh penggugat atau pihak korban. Pengaturan perlindungan hukum mengenai perbuatan melawan hukum diatur di dalam pasal 1365 KUH Perdata dan pertanggung jawaban atas perbuatan tindak pidana penipuan diatur di dalam pasal 378 KUH Pidana, serta perlindungan hukum juga diatur didalam UUD RI 1945 pasal 28D (1) yang dimana menjamin perlindungan hukum setiap orang secara adil di hadapan hukum. Penyelesaian yang dapat dilakukan adalah melalui penyelesaian di pengadilan namun penyelesaian secara perdata terlebih dahulu, baru dapat dilakukan penyelesaian secara pidana. Harta waris yang belum dibagi oleh si pewaris kepada ahli warisnya dapat dilakukan penyitaan terhadap warisan tersebut jika memang si pewaris terbukti melakukan suatu perbuatan pelanggaran hukum
English Abstract
In this thesis, the author raises the issue of legal protection for civil plaintiffs who suffered losses of criminal fraud. Options theme background by the actions of criminal fraud and criminal activities carried out by the first defendant in which the act was done jointly with his wife as the second defendant, to one of the plaintiff. In this case the decision of civil and criminal decisions have had permanent legal force, but the protection of indemnity and accountability to the victim or plaintiff still with appropriate actions committed by the defendant. Based on the above, the writing of this paper raised the formulation of the problem: (1) How does the legal protection acquired by the plaintiff in particular, on the basis of civil law protection act upon a loss of Crime Fraud and Illegal Acts that have been made by the defendant ? (2) What is the legal basis in determining the inheritance law applicable to the separation of assets of inheritance to be used for sequestration of an act of the Crime of Fraud and Illegal Acts that have happened ? Then the writing of this paper uses the method of normative law, with the approach of the case and approach to legislation. Primary legal materials, secondary, and tertiary obtained by the author will be analyzed by using grammatical interpretation by way of interpretation or explanation of the simplest of settings on the legal protection to the plaintiff, as well as the judges ruling, and the legacy settings to be used for sequestration has been decided to know in resolving legal issues that become the object of study. From the results of the study with the above method, the authors obtained the answers to the problems that exist that legal protection for the plaintiff absolutely must be done by the court, where the legal protection that is both civil and criminal is the protection of indemnity and accountability that has been suffered by the plaintiff or the victim. Setting the legal protection of a tort under article 1365 Civil Code and accountability for the actions of criminal fraud under article 378 of the Criminal Code, as well as legal protection is also regulated under UUDNRI 1945, Article 28D (1) that which guarantees legal protection of everyone in fair before the law. Settlement can be done is through a settlement in a civil court, but completion of the first, and can be done in the criminal settlement. An estate that has not been shared by the heir to his heir can be a foreclosure against the inheritance if the heir guilty of an act of lawlessness.
