Abstract
Pada skripsi ini, peneliti mengangkat permasalahan Pengawasan Bagian Hukum Sekretariat Daerah Dalam Proses Pembentukan Peraturan Desa. Pilihan tema tersebut dilatar belakangi oleh pengalaman peneliti ketika melaksanakan Praktek Kerja Lapang di Bagian Hukum Sekretariat Daerah Kabupaten Jombang, melihat beberapa kali perangkat desa datang ke Bagian Hukum untuk meminta nomor Peraturan Desa Sehingga muncul pertanyaan bagaimana bentuk pengawasan yang dilakukan Bagian Hukum Sekretariat Daerah terhadap proses pembentukan Peraturan Desa. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : (1) Bagaiamana pelaksanaan pengawasan Bagian Hukum Kabupaten Jombang terhadap pembentukan Peraturan Desa berdasarkan peraturan perundang-undangan? (2) Bagaimana bentuk pengawasan pembentukan Peraturan Desa agar lebih optimal dan efektif? Menggunakan metode yuridis empiris dengan metode pendekatan yuridis sosiologis. Sumber data primer, dan sekunder yang diperoleh peneliti akan dianalisis dengan menggunakan teknik analisis deskriptif kualitatif dengan menggabungkan data primer dan sekunder hasil penelitian dan dideskripsikan sesuai dengan undang-undang, kemudian menarik kesimpulan dan saran sesuai dengan permasalahan tentang pengawasan dalam pembentukan Peraturan Desa. Pengawasan yang dilakukan oleh Bagian Hukum Sekretariat Daerah Kabupaten Jombang memiliki 2 macam yakni berupa pengawasan dan pembinaan yang bisa berupa (1) bagian hukum merupakan salah satu anggota Tim Evaluasi dan Klarifikasi terhadap Peraturan Desa, (2) melakukan pembinaan berupa pelaksanaan agenda Bimbingan Teknis terkait penyusunan Peraturan Desa. Namun dalam pelaksanaannya masih terdapat kendala dan permasalahan. Pengawasan yang dilakukan oleh Bagian Hukum sudah sesuai dengan Pasal 115 huruf b dan e Undang-Undang Nomor 6 Tahun 2014 tentang Desa, pasal 84 PP Nomor 43 Tahun 2014 tentang peraturan pelaksanaan UU Desa, serta Pasal 66 dan 70 Peraturan Bupati Jombang Nomor 2 Tahun 2015 tentang Tupoksi Setda. Dalam pelaksanaannya masih terdapat oleh kendala yakni (1) sumber daya manusia di bagian hukum, (2) anggaran dari Pemerintah Kabupaten yang minim, (3) bentuk pengawasan yang masih belum tertata rapi. Sehingga peneliti memberikan rekomendasi untuk kedepannya adalah (1) menerbitkan buku pedoman penyusunan Peraturan Desa, (2) progam konsultasi hukum, (2) pembinaan berupa pelatihan penyusunan Perdes. Untuk saran dari peneliti bagi Pemerintah Kabupaten agar lebih konsisten dan serius dalam melaksanakan pengawasan baik secara preventif maupun represif.
English Abstract
In this thesis, the researchers raised the problem of the legal section of the Secretariat of The Supervision in the process of formation of the Regulation of the village. The theme of the event will choice by the experience of researchers when conducting Field work practice in the legal secretariat, saw several times Councilor coming to the Legal Department to request a number of village Regulations so that it appears the question what kind of control do the legal secretariat of The process of formation of the regulations of the village. This thesis raises issues of formulation: (1) how the supervision of the Legal Department Jombang District to the formation of village regulations based on laws and regulations? (2) how of oversight of the establishment of the rule of the village to be more optimal and effective? This thesis using methods empirical juridical method of the juridical with sociological approach. The primary data source, and the secondary researchers will be analyzed using descriptive qualitative analysis techniques by combining primary and secondary data research results and described in accordance with the law, and then draw conclusions and suggestions according to the problems of the research on supervision in the formation of rules of the village. The researchers get answers to existing problems that the supervision carried out by the legal secretariat has 2 kinds, i.e. in the form of supervision and coaching can be either (1) the Legal Department is one of the members of the evaluation team and the clarification of the Rules of the village, (2) perform a execution of coaching agendas technical guidance related to drafting regulations for the village. However, in practice there are still constraints and problems. The supervision carried out by The Law is in compliance with Article 115 letters b and e Act No. 6 by 2014 about Village, article 84 PP number 43 by 2014 about regulations implementing the Act the village, as well as Article 66 and 70 Regulation Regent Jombang No. 2 2015 about Basic Tasks And Functions of the Secretariat of the Jombang Region. In practice there is still by the constraints that (1) the human resources on the Legal Department, (2) the budget of the District Government are minimal, (3) a form of supervision that has still not arranged neatly. So the researchers provide recommendations for the future is to (1) publish the manual preparation of Regulations of the village, (2) the legal consultation progam, (2) coaching in the form of training preparation regulations of village. For advice from researchers for the County Government to make it more consistent and serious in exercising oversight of both preventive and repressive
