Abstract
Pada Skripsi Ini, Penulis Mengangkat Permasalahan Upaya Polri Dalam Penanggulangan Tindak Pidana Perjudian Balap Motor Liar. Pilihan Tema Tersebut Dilatarbelakangi Oleh Adanya Tindak Perjudian Terhadap Balap Motor Liar Yaitu Dalam Bentuk Uang Taruhan Yang Menggiurkan Para Remaja Dan Pemuda Untuk Bergabung Dalam Komunitas Balap Motor Liar Sehingga Hal Tersebut Semakin Meresahkan Masyarakat Serta Aksi Balap Motor Liar Tersebut Dilakukan Tanpa Menggunakan Standart Keamanan Yang Telah Ditentukan Misalnya Seperti Helm Sebagai Pelindung Kepala Pengendara Sepeda Motor Serta Dilakukan Di Jalan Umum Dengan Jumlah Penonton Yang Banyak Memadati Area Tepi Jalan Yang Digunanakan Sebagai Sirkuit Balap Motor Liar Sehingga Aksi Balap Motor Liar Tersebut Sangat Membayahakan, Baik Nyawa Pelaku Maupun Nyawa Penonton Ataupun Nyawa Pengguna Jalan Lainnya. Berdasarkan Hal Tersebut Diatas, Karya Tulis Ini Mengangkat Rumusan Masalah: (1) Bagaimana Upaya Penanggulangan Tindak Pidana Perjudian Balap Motor Liar Oleh Polri Di Kota Kediri? (2) Apa Hambatan Polri Dalam Upaya Menanggulangi Tindak Pidana Perjudian Balap Motor Liar Di Kota Kediri? Kemudian Penulisan Karya Tulis Ini Menggunakan Metode Yuridis Empiris Dengan Metode Pendekatan Yuridis Sosiologis. Data Primer Dan Data Sekunder Yang Diperoleh Penulis Akan Dianalisis Oleh Penulis Dengan Menggunakan Teknik Analisis Deskriptif Analisis, Yaitu Mengungkap Suatu Masalah Atau Keadaan Atau Peristiwa Sebagaimana Adanya, Kemudian Dianalisa Berdasarkan Teori-Teori Dan Peraturan-Peraturan Yang Berkaitan Dengan Masalah Tersebut Sehingga Sampai Pada Suatu Kesimpulan. Dari Hasil Penelitian Dengan Metode Diatas, Penulis Memperoleh Jawaban Atas Permasalahan Yang Ada Bahwa Upaya Yang Dilakukan Oleh Kepolisian Resort Kediri Kota Dalam Penanggulangan Tindak Pidana Perjudian Terhadap Balap Motor Liar Yakni Dengan Mengutamakan Upaya Pencegahan Terhadap Aksi Balap Motor Liar Yang Terjadi Di Kota Kediri, Yaitu Dilakukan Dengan Dua Cara, Antara Lain: Upaya Preventif (Pencegahan) Yang Meliputi: Memberikan Penyuluhan Atau Sosialisasi Mengenai Tertib Lalu Lintas, Melakukan Penling Atau Penerangan Keliling, Melakukan Operasi Kendaraan, Melakukan Patroli Yang Berkelanjutan Atau Berkesinambungan Di Tempat-Tempat Yang Rawan Terjadi Balap Liar, Penjagaan Di Pos-Pos Yang Rawan Terjadi Balap Liar. Sedangkan Upaya Represif (Penindakan) Meliputi: Menindaklanjuti Laporan Dari Masyarakat Tentang Adanya Aksi Balap Liar Yang Digelar Di Suatu Tempat, Mengkoordinasi Dengan Aparat Kepolisian Untuk Melakukan Operasi Penggrebekan, Pelaku Yang Tertangkap Diamankan Di Kepolisian Resort Kediri Kota Untuk Diperoleh Keterangan Dan Dilakukan Penggeledahan Yang Bertujuan Untuk Memperoleh Barang Bukti, Melakukan Pembinaan Di Tempat Yakni Di Kepolisian Resort Kediri Kota Agar Tidak Mengulangi Perbuatannya Yang Menyimpang Dari Aturan Undang-Undang Dan Mengarah Lebih Jauh Lagi Ke Tindak Kejahatan, Menyita Dan Menilang Motor-Motor Yang Digunakan Sebagai Balap Liar Serta Motor-Motor Yang Tidak Dilengkapi Dengan Surat Tanda Nomor Kendaraan Bermotor (Stnk), Serta Surat Ijin Mengemudi (Sim). Adapun Hambatan-Hambatan Yang Dialami Oleh Aparat Kepolisian Resort Kediri Kota Dalam Menanggulangi Tindak Pidana Perjudian Dalam Balap Liar Antara Lain: Rendahnya Tingkat Kesadaran Hukum, Perjudian Balap Liar Dilakukan Secara Terselubung, Kurang Barang Bukti, Sirkuit Balap Liar Yang Digunakan Berpindah-Pindah, Kelihaian Joki Maupun Kelompok Balap Motor Liar Dalam Memacu Sepeda Motor Secara Cepat Untuk Meloloskan Diri, Balapan Liar Dilakukan Pada Malam Hari, Balapan Liar Dilakukan Oleh Sekelompok Anak Muda Yang Jumlahnya Banyak. Walaupun Terdapat Banyak Hambatan Yang Dialami Oleh Aparat Kepolisian Resort Kediri Kota, Namun Upaya Penanggulangan Yang Dilakukan Tersebut Bertujuan Untuk Menghilangkan Kesempatan Dalam Melakukan Tindak Pidana Perjudian Terhadap Balap Motor Liar Sehingga Perjudian Terhadap Balap Motor Liar Serta Balap Motor Liar Yang Terjadi Di Kota Kediri Dapat Ditanggulangi.
English Abstract
In this thesis, the writer raises a problem about Polri’s Effort in Overcoming Gamble of Illegal Motorcycle Racing as a Criminal Act. The background of choosing this theme is the gambling which happens in the illegal motorcycle racing. The gambling can be in the form of money wager which attract teenagers to join with the racing so it makes people worry. In addition, the racers do not use any safety equipment like helmet as the head protector. Moreover the racing is held in a public road with many audiencesin the street side that makes the racing more dangerous to the audiences and another people. Based on the reason above, this thesis raises some problems of the study, such as: (1) How does Polri overcome gambling of illegal motorcycle racing as a criminal act in Kediri? (2) What are the obstacles in overcoming gamble of illegal motorcycle racing faced by Polri in Kediri? The writer uses empirical juridical method with juridical sociologic approach in writing the thesis. Primary and secondary data will be analyzed by using descriptive analysis; that reveals a problem or phenomenon obviously, and then it will be analyzed based on the theories and rules which are related to the problems or phenomena in order to get a conclusion. From the result, the writer found that Kepolisian Resort Kediri Kota do a preventive effort as the priority in overcoming the illegal motorcycle racing in Kediri. The preventive effort is divided into two: preventive act (giving information or socialization about traffic rules, giving lighting in the street, doing vehicle operation, doing patrols continuously and guarding in the street which is potentially used to do illegal racing) and repressive act (giving fast response about people’s report in the case of illegal racing, havingcoordination with police agent to do operation, arresting the illegal racers in Kepolisian Resort Kediri Kota to find information and evidences, giving rehabilitation in Kepolisian Resort Kediri Kota to prevent repeating the diverge acts and avoid doing criminal acts, seizing and giving a traffic ticket to the motorcycles which are used to illegal race and motorcycle which has no driving license and motorcycle license). There are obstacles faced by Kepolisian Resort Kediri Kota in overcoming gamble of illegal motorcycle racing, such as, low consciousness of law, under-covered gambling of illegal motorcycle racing, less of evidences, migratory race circuits, the racers’ skill in escaping from police agent, the race is held in the night, and the number of illegal racers. Although there are so many obstacles, the efforts of Kepolisian Resort Kediri Kota are purposed to omit the chance in gambling of illegal motorcycle racing as a criminal act so it can be overcame and decreased.
