Abstract
Pada skripsi ini, tema yang diangkat oleh peneliti adalah mengenai IUJK yang menjadi syarat khusus bagi perusahaan jasa konstruksi selain berkewajiban memiliki SIUP dan NPWP. Sub-kontraktor merupakan penyedia dan pelaksana usaha jasa konstruksi. Di wilayah Kabupaten Gresik terdidentifikasi adanya subkontraktor yang tidak memiliki Izin Usaha Jasa Konstruksi (IUJK) namun telah melaksanakan pekerjaan jasa konstruksi. Diangkatnya masalah tersebut dikarenakan sebagai penyedia usaha dan pelaksana usaha jasa konstruksi diwajibkan untuk memiliki Izin Usaha Jasa Konstruksi (IUJK). IUJK merupakan syarat wajib bagi setiap badan usaha jasa konstruksi untuk dapat melaksanakan pekerjaan jasa konstruksi sesuai dengan UU Jasa Konstruksi dan peraturan perundang-undangan lainnya. Berdasarkan pada latar belakang penelitian, dirumuskanlah 3 (tiga) rumusalah malah, yakni: (1) Bagaimana efektivitas prngaturan kepemilikan Izin Usaha Jasa Konstruksi (IUJK) bagi sub-kontraktor penyedia usaha jasa konstruksi? (2) Apa hambatan dalam pengaturan kepemilikan Izin Usaha Jasa Konstruksi (IUJK) bagi sub-kontraktor penyedia usaha jasa konstruksi? (3) Apa upaya untuk mengatasi hambatan pengaturan kepemilikan Izin Usaha Jasa Konstruksi (IUJK) bagi subkontraktor penyedia usaha jasa konstruksi? Penelitian ini menggunakan jenis penelitian hukum empiris dengan menggunakan pendekatan yuridis sosiologis. Data primer diperoleh menggunakan metode wawancara dengan pihak Dinas Pekerjaan Umum Kabupaten Gresik, PT. Aneka Jasa Grhadika, Gresik dan sub-kontraktor serta menggunakan teknik pengumpulan data purposive sampling. Data sekunder penelitian diperoleh melalui dokumentasi dan studi kepustakaan. Data primer dan data sekunder dianalisi dengan menggunakan metode desktiptif kualitatif. Hasil penelitian diperolehlah bahwa, setiap badan usaha jasa konstruksi wajib mengurus perizinan di bidang jasa konstruksi, yakni Izin Usaha Jasa Konstruksi (IUJK). Baik BUMS atau BUMN wajib memiliki IUJK. Sub-kontraktor merupakan penyedia dan pelaksana usaha jasa konstruksi, maka diwajibkan pula sebagai penyedia dan pelaksana usaha jasa konstruksi untuk memiliki IUJK sebagai syarat pelaksanaan pekerjaan jasa konstruksi. IUJK yang wajib dimiliki oleh setiap penyedia dan pelaksana usaha jasa konstruksi di wilayah Kabupaten Gresik yang dikeluarkan oleh Pemerintah Kabupaten Gresik melalui Dinas Pekerjaan Umum Kabupaten Gresik. Hambatan dalam efektivitas pengaturan kepemilikan IUJK ini adalah masih dianggapnya sub-kontraktor sebagai xiii perusahaan kecil yang tidak memerlukan IUJK hanya sebatas melihat pada hasil pekerjaan konstruksi yang sesuai ukurannya. Disamping itu masih tidak ketehauinya secara jelas mengenai peraturan perundang-undangan tentang jasa konstruksi. Upaya yang dilakukan Dinas Pekerjaan Umum Kabupaten Gresik selaku pengawas adalah dengan melakukan sosialisasi pentingnya IUJK bagi badan usaha jasa konstruksi dan memaparkan perkembangan mengenai peraturan perundang-undangan tentang jasa konstruksi. Kemudian dilakukan monitoring berdasarkan laporan perusahaan setiap 1 (satu) tahun sekali, yang kemudian dilaporkan oleh Dinas Pekerjaan Umum Kabupaten Gresik ke Bupati Gresik.
English Abstract
In this thesis, the themes raised by the researchers is that a requirement of IUJK specifically for construction services company in addition to the obligation to have License and TIN. Sub-contractors and implementing a provider of construction services business. In the district of Gresik terdidentifikasi their subcontractors who do not have a business license Construction Services (IUJK) but has been carrying out construction work. He raised the issue because as a provider of business and implementing construction services are required to have a business license Construction Services (IUJK). IUJK is a mandatory requirement for any business enterprise to be able to carry out construction work construction services in accordance with the Construction Services Law and other legislation. Based on the research background, dirumuskanlah 3 (three) rumusalah instead, namely: (1) How is the effectiveness of ownership prngaturan Construction Services Business License (IUJK) for sub-contracting construction services provider? (2) What are the barriers to ownership arrangements Construction Services Business License (IUJK) for sub-contracting construction services provider? (3) Any attempt to overcome obstacles ownership arrangements Construction Services Business License (IUJK) for sub-contracting construction services provider? This research uses empirical legal research using sociological juridical approach. Primary data were collected using interviews with the Department of Public Works Gresik, PT. Various Services Grhadika, Gresik and sub-contractors as well as the use of purposive sampling techniques of data collection. Secondary data were obtained through the documentation and study of literature. Primary data and secondary data was analyzed by using descriptive qualitative method. The research result is obtained that, every body construction services required to manage licensing in the field of construction services, namely Construction Services Business License (IUJK). Neither BUMS or SOE shall have IUJK. Sub-contractors and implementing a provider of construction services business, it is required also as a provider and implementer of construction services to have IUJK as a condition of execution of construction work. IUJK that must be owned by each provider and implementer of construction services in the district of Gresik Gresik issued by the Government through the Department of Public Works Gresik. Barriers in the effectiveness of this IUJK ownership arrangement is still considered a sub-contractor as a small company that does not require IUJK merely look at the results of the construction work based on their size. Besides, it is still not clear ketehauinya regarding legislation on construction services. Efforts made Public Works Department Gresik as the supervisor is to xv disseminate the importance of business entities IUJK for construction services and describes the development of legislation on construction services. Then do the monitoring based on reports the company every 1 (one) years, which is then reported by the Department of Public Works to Regent Gresik Gresik.
