Abstract
Efektivitas pencatatan perkawinan terhadap penghayat kepercayaan dirasa perlu diketahui karena pada awal disahkan Undang-Undang No 23 Tahun 2006 tentang Administrasi Kependudukan serta Peraturan Pemerintah No 37 Tahun 2007 tentang Pelaksanaan Undang-Undang No 23 Tahun 2006 belum efektif. Penelitian ini merupakan penelitian hukum empiris, dengan metode pendekatan yuridis sosiologis untuk mengetahui efektivitas pencatatan perkawinan terhadap penghayat kepercayaan di Kota Surabaya. Indikator efektivitas pencatatan perkawinan di kota Surabaya pada penelitian ini menggunakan tiga indicator yaitu structural indicator, process indicator, dan out come indicator. Pada structutral indicator diketahui bahwa peraturan perundang-undangan yang mengatur tentang pencatatan perkawinan pada skala nasional telah terpenuhi dengan adanya Undang-Undang No 23 Tahun 2006 tentang Adiminstrasi Kependudukan, Peraturan Pemerintah No 37 Tahun 2007 Pelaksanaan Undang-Undang No 23 Tahun 2006, serta Peraturan Presiden No 25 Tahun 2008 tentang Persyartan dan Tata Cara Pendaftaran Penduduk dan Pencatatan Sipil. Indicator yang kedua yaitu process indicator. Pengukuran efektivitas melalui indicator yang kedua dilihat dari terpenuhinya komponen-komponen seperti adanya Peraturan Daerah Kota Surabaya No 5 Tahun 2011 tentang Penyelenggaraan Administrasi Kependudukan yang diantaranya mengatur tentang persyaratan pencatatan perkawinan bagi penghayat kepercayaan sebagai peraturan dalam skala daerah, adanya tiga kali pencatatan perkawinan secara kepercayaan selama kurun waktu 2008-2011 pada Dinas Kependudukan dan Catatan Sipil Kota Surabaya, ketersediaan pejabat pencatat perkawinan, adanya sistem kerja dalam Dinas Kependudukan dan Catatan Sipil Kota Surabaya untuk melaksanakan pencatatan perkawinan bagi penghayat kepercayaan, serta sosialisasi yang dilakukan kepada lingkungan penghayat kepercayaan dan pejabat pencatat perkawinan tentang peraturan pencatatan perkawinan terhadap penghayat kepercayaan. Indicator yang ketiga yaitu outcome indicator, pada indicator ini efektivitas diukur melalui penikmatan dari penghayat kepercayaan terhadap peraturan tentang pencatatan perkawinan bagi penghayat kepercayaan. Penghayat kepercayaan di kota Surabaya telah mengetahui adanya peraturan tentang pencatatan perkawinan bagi penghayat kepercayaan, mereka setuju terhadap peraturan tersebut dan mau untuk mencatatkan perkawinannya. Dari ketiga indicator tersebut pencatatan perkawinan penghayat kepercayaan pada Dinas Kependudukan dan Catatan Sipil Kota Surabaya terhadap perkawinan yang dilaksanakan setelah disahkannya Peraturan Pemerintah No 37/2007 berjalan efektif, namun terhadap perkawinan penghayat kepercayaan yang dilaksanakan sebelum adanya Pemerintah Pemerintah No 37/2007 tidak efektif karena tidak ada permohonan pencatatan selama kurun waktu yang diberikan yaitu 2007-2009.
English Abstract
The effectiveness of marriage registration to the instiller of faith society are bound to be measured, since the early stage of ratification of the Law No. 23 in 2006 about the Administration of Population and the Government Regulation No. 37 in 2007 about the Practice of Law No.23 in 2006 is considered as ineffective. This study is a research of empirical law, by using a sociological and juridical approach to discover the effectiveness of marriage registration to the instiller of faith society in Surabaya. This study use three kinds of indicator to the effectiveness of marriage registration in Surabaya, which are structural indicator, process indicator and also out come indicator. Structural indicator is used to discover whether the legislation that oversees the marriage registration on a national level have already been fulfilled by the Law No. 23 in 2006 about the Administration of Population, the Government Regulation No. 37 in 2007 about the Practice of Law No. 23 in 2006, and also the Presidential Regulation No. 25 in 2008 about the Requirements and Procedure of Inhabitant Registration and Civil Records. Process indicator able to measure the level of effectiveness by overseeing the fulfillment of components such as Regional Regulation of Surabaya No.5 in 2011 about the Effectuation to the Administration of Population, in which regulate about the requirements of marriage registration to the instiller of faith society as a regulation on a regional scale, an internal registration of marriage process for three times in a row during 2008-2011 to the Department of Population and Civil Records of Surabaya, the availability of official marriage registrar, a system in the Department of Population and Civil Records of Surabaya to provide the registration of marriage process to the instiller of faith society, and also socialization process; both to the instiller of faith society and the official marriage registrar, about the regulation of marriage registration to the instiller of faith society. Outcome indicator is used to measure the level of satisfaction to the regulation about the marriage registration. The instiller of faith society in Surabaya has already noticed about this regulation, they are agreeing to the content of the regulation and willing to register their marriage. From those indicators, it is concluded that the marriage registration process for the instiller of faith society to the Department of Population and Civil Records of Surabaya to all the marriages held after the adoption of Government Regulation no.37/2007 are functioning properly, but not to the marriages held before the adoption of the Government Regulation no.37/2007 since there was no registration application process during 2007-2009.
