Abstract
Pada skripsi ini, penulis mengangkat tentang pengaturan asas keseimbangan kepentingan pelaku usaha ritel modern dengan pasar tradisional dalam peraturan daerah Kota Surakarta dan Kota Malang. Pilihan tema tersebut dilatarbelakangi dengan semakin tersisihnya pasar tradisional oleh ritel modern akibat kalah bersaing dan kelemahan-kelemahan yang dimiliki oleh pelaku usaha kecil yang berada di dalamnya. Peraturan Daerah Kota Surakarta dan Kota Malang dipilih karena kedua kota ini mengalami perkembangan perekonomian yang pesat terutama di sector ritel. Berdasarkan hal tersebut diatas, skripsi ini mengangkat rumusan masalah: (1) Bagaimana prinsip asas keseimbangan kepentingan antara pelaku usaha ritel modern dengan pasar tradisional dalam hukum persaingan usaha?; (2) Bagaimana Peraturan Daerah Kota Surakarta dan Kota Malang mengatur keberadaan ritel modern dengan pasar tradisional?; dan (3) Bagaimana model pengaturan yang tepat mengenai asas keseimbangan kepentingan di dalam Peraturan Daerah Kota Surakarta dan Peraturan Daerah Kota Malang? Jenis penelitian ini merupakan penelitian yuridis normatif, yaitu penelitian yang dilaksanakan untuk memecahkan masalah hukum secara normatif yang pada dasarnya bertumpu pada penelaahan kritis dan mendalam terhadap norma-norma yang ada dan dokumen-dokumen hukum yang relevan dengan permasalahan yang dikaji. Penelitian yuridis normatif yaitu penelitian yang difokuskan untuk mengiventarisasi dan mengkaji kaidah-kaidah atau norma-norma dalam hukum positif. Berdasarkan hasil penelitian, penulis telah menemukan fakta bahwa prinsip asas keseimbangan kepentingan antara ritel modern dengan pasar tradisional adalah kesempatan berusaha yang sama di antara keduanya sehingga keadilan tercapai. Asas keseimbangan kepentingan dalam hukum persaingan usaha tetap memperhatikan kepentingan pelaku usaha kecil yang sejalan dengan Undang-Undang Nomor 20 Tahun 2008 Tentang Usaha Mikro, Kecil dan Menengah. Di sisi peraturan daerah yang diteliti, Peraturan Daerah Kota Surakarta Nomor 5 Tahun 2011 lebih mengakomodasi asas keseimbangan kepentingan dibandingkan dengan Peraturan Daerah Kota Malang Nomor 8 Tahun 2010, di mana indikator untuk mengukurnya adalah pengaturan terkait keresahan sosial, izin usaha, lokasi usaha, jam pelayanan, dan tata ruang. Dilihat dari perkembangannya, agar tetap menjaga keberlangsungan pasar tradisional, maka tidak cukup hanya dengan indikator-indikator tersebut, tetapi juga mengenai batasan komoditas yang diperjualbelikan di ritel modern agar tidak berbenturan dengan pasar tradisional.
English Abstract
In this paper, the authors discussed about principle of balance of interest between modern retail market with traditional retail market through local regulation in Surakarta and Malang. The motivation to choose the theme because the more traditional retail market exclusion even bankruptcy due to less competitive and weaknesses. Local regulation of Surakarta and Malang are chosen because of rapid economic development especially on retail sector. Based on the above, this paper identified several problems: (1) How does the principle of the principle of balance of interests between modern retail businesses with traditional market in competition law?; (2) How Regulation and Surakarta City Malang regulate the presence of modern retail market and traditional?, and (3) How to model the proper settings on the principle of balance of interests in the Regulation of Surakarta City and Regional Regulation Malang?? The type of research is a juridical empirical research. Juridical-empirical research is reviewed through a legal aspect, in this case the rules are correlated with reality or practice in the field. Juridical-empirical research is a study conducted in the community with the intent and purpose to find the facts, and then forwarded to locate the problem, then headed to the identification of problems, and the latter to seek to address the problem. Based on this research, the author has found that the principle of balance of interests between modern retail market and traditional retail market is the same business opportunities between the two so that justice is achieved. The principle of a balance of interests in competition law taking into account the interests of small businesses that are in line with Act Number 20 Year 2008 on Micro, Small and Medium Enterprises . On the regulatory side of the researched area , Surakarta City Regulation Number 5 Year 2011 accommodate the principle of balance of interests more than regulation of Malang City Number 8 Year 2010, in which indicators to measure social unrest is related settings , business license , business location , hours of service , and spatial . Judging from the development , in order to maintain the continuity of traditional markets , it is not enough just to these indicators , but also the limits of commodities are bought and sold in modern retail in order not to clash with the traditional market
