Abstract
Pada skripsi ini, Peneliti menulis mengenai Pengaruh Revised Draft International Code of Conduct for Outer Space Activities Terhadap Posisi Indonesia Pada Aspek Space Security. Pilihan tema ini dilatar belakangi meningkatkan kegiatan keantariksaannya, namun hal ini tidak diimbangi dengan susunan pengaturan keamanan kegiatan keantariksaan yang memadai. Munculnya ide tentang CoC OSA didasari dengan terjadinya kebuntuan pembahasan terkait masalah keamanan kegiatan keantariksaan dan non-proliferasi, sebagai dua masalah kunci yang saling terkait dalam rangka mencegah perlombaan persenjataan antariksa. Setelah berubah judul menjadi Revised Draft ICoC OSA, peraturan ini memiliki makna sebagai seperangkat peraturan best practices. Berdasarkan hal tersebut di atas, karya tulis ini mengangkat rumusan masalah: (1) Apa pengaruh Revised Draft International Code of Conduct for Outer Space Activities terhadap posisi Indonesia pada aspek space security? (2) Bagaimana Indonesia menyikapi Revised Draft International Code of Conduct for Outer Space Activities? Kemudian penulisan karya tulis ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum primer, sekunder, tersier yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis deskriptif-analisis. Dari hasil penelitian dengan metode di atas, Penulis memperoleh jawaban atas permasalahan yang ada bahwa pengaruh Revised Draft International Code of Conduct for Outer Space Activities terhadap posisi Indonesia pada aspek space security terletak pada Transparency and Confidence Building (TCBM) pada Revised Draft ICoC OSA dimana ketentuan Cooperation Mechanism menguntungkan Indonesia apabila benar-benar akan dilaksanakan oleh Negara-negara Peserta. Selain itu akan lebih baik berada dalam posisi menahan diri untuk secara langsung menyatakan sebagai pihak dalam Revised Draft ICoC OSA. Indonesia menyambut baik inisiatif dan upaya-upaya yang telah dilakukan oleh Uni Eropa yang membawa Revised Draft ICoC OSA dalam pembahasan dengan melibatkan berbagai negara di luar Uni Eropa. Indonesia menentukan sikap untuk tidak terburu-buru meyatakan dukungan terhadap Revised Draft ICoC OSA ini karena harus mencermati materi muatan lebih lanjut.
English Abstract
In this paper, Author wrote about The Impact of Revised Draft International Code of Conduct for Outer Space Activities to Indonesia’s Posiition in Space Security Aspect. This theme was chosen because the increasing of space activities which not balanced by space security regulatory framework. The idea of CoC OSA was based on the deadlock discussion of space security and non-proliferation as two major problems that mutually related in order to prevent arms race of outer space. After changed into Revised Draft ICoC OSA, means that this regulation as a set of best practice regulation. Based on the explanation above, this paper appoint problems: (1) What is the impact of Revised Draft International Code of Conduct for Outer Space Activities to Indonesia’s position in space security aspect? (2) What is Indonesia’s attitude toward Revised Draft International Code of Conduct for Outer Space Activities? Author was using normative juridical method with statute approach and conceptual approach. Legal materials (primary, secondary, tertiary) which Author had, were analyzed with descriptive-analytic methods. From the research explained above, Author found that the impact of Revised Draft ICoC OSA to Indonesia’s position in space security aspect is placed in Transparency and Confidence Building (TCBM) in Revised Draft ICoC OSA in which Cooperation Mechanism beneficial to Indonesia if Subscribing States really commit to this regulation. Moreover, it will be better if Indonesia refrain to state its side in this regulation. Indonesia welcomed initiatives and efforts that Europe Union has done which brought Revised Draft ICoC OSA into a discussion with other countries outside Europe Union. Indonesia decided to not hastily declare its support toward Revised Draft ICoC OSA because it needs to learn the substances of this regulation thoroughly.
