Abstract
Pada skripsi ini, penulis mengangkat permasalahan Perlindungan Hak Eksklusif Pencipta terkait Hak Moral dan Hak Ekonomi dalam Perjanjian Royalti dengan Penerbit Buku . Pilihan tema tersebut dilatar belakangi oleh adanya pelanggaran yang terjadi yang dilakukan oleh oknum tidak bertanggung jawab atas suatu karya milik pencipta. Pelanggaran dilakukan terkait dengan hak eksklusif pencipta yang tidak lepas juga dengan adanya hak moral dan hak ekonomi . Sebagaimana yang diketahui perlindungan hukum sangat penting diberikan terhadap suatu karya cipta pencipta ini dilakukan untuk dapat memberikan rasa aman sekaligus melindungi karya ciptanya tersebut. Berdasarkan hal tersebut dalam skripsi ini mengangkat rumusan masalah :(1) Bagaiamana perlindungan terhadap hak eksklusif pencipta terkait hak moral dan hak ekonomi dalam perjanjian royalti di UB Press, UM Press dan Penerbit Bayumedia? (2) Bagaimana penerapan hak moral dan hak ekonomi dalam perjanjian royalti terkait dengan hak eksklusif pencipta di UB Press, UM Press dan Penerbit Bayumedia ? Dalam penulisan skripsi ini penulis menggunakan jenis penelitian yuridis empiris, dengan menggunakan metode pendekatan yuridis sosiologis dengan lokasi penelitian di UB Press Malang, UM Press Malang dan Penerbit Bayumedia Malang.Kemudia data yang diperoleh diolah dan dianalisis secara deskriptif kualitatif.Dimana metode yang dilakukan dengan menganalisis data yang diperoleh dari hasil wanwancara dilapangan yang kemudia dijabarkan dan setelah itu untuk ditarik kesimpulan. Dari hasil penelitian yang dilakukan dengan menggunakan metode di atas ,penulis memperoleh jawaban atas permasalahan yang ada yaitu Bentuk perlindungan hukum yang diberikan untuk melindungi hak eksklusif pencipta dalam perjanjian royalti dilakukan melalui perlindungan preventif dan juga perlindungan represif. Perlindungan preventif yang diberikan disesuaikan menurut UUHC yaitu terkait dengan pasal 2 ayat (1), pasal 35 ayat (4), pasal 37 dan juga dari perjanjian royalti yang dilakukan dengan adanya pemenuhan hak moral dan hak ekonomi, hal ini sebagai bentuk perlindungan untuk mencegah adanya pelanggaran terhadap hak eksklusif. Sedangkan perlindungan represif yang diberikan disesuaikan menurut UUHC yaitu terkait dengan pasal 56 ayat (1), pasal 72 ayat (1),(2),(6) dan juga pasal 73 ayat (1) .Tetapi terkait dengan perlindungan represif masih belum sepenuhnya telah diberikan sebagaimaa ketentuan yang ada di dalam UUHC seperti halnya tidak adanya klausul tentang perlindungan represif dalam perjanjian royalti. Terkait dengan penerapan hak moral dan hak ekonomi telah dilakukan oleh UB Press, UM Press dan Penerbit Bayumedia sebagaimana yang ada di dalam perjanjian royalti. Terkait dengan penerapan hak moral yang dilakukan sudah sesuai dengan pasal 24 UUHC yang mana pencipta mempunyai hak atas karya cipta yang diterbitkan, sedangkan penerapan hak ekonomi berbeda-beda setiap penerbit baik dari UB Press, UM Press dan Penerbit Bayumedia. Dalam hal ini penerapan hak ekonomi yang besar diberikan oleh UB Press karena tidak hanya royalti yang diberikan melainkan juga adanya pemberian insentif atas karya cipta pencipta.
English Abstract
In this thesis, the author raised the issues of protection of the exclusive rights of Creators associated Moral rights and economic rights in the agreement Royalties with book publishers. The theme of the event will choice by the existence of abuses committed by persons not responsible for a work belongs to the creator. Violations carried out related to the exclusive rights of creators who are not also loose-leaf with the existence of moral rights and economic rights. As it is known is a very important legal protection afforded to a creator of a copyrighted work is done to provide a sense of security while protecting the work of publication. Based on such matters in this thesis raised the formulation problems:(I) How protection of the exclusive rights of creators associated moral rights and economic rights in the agreement a royalty in UB Press, UM Press and publisher of Bayumedia? (2) How the application of moral rights and economic rights in the agreement royalties related to the exclusive rights of creators in the UB Press, UM Press and publisher of Bayumedia? In the writing of this thesis the author uses this type of research is empirical juridical method, by using the juridical sociological approach to the location of the research at the UB Press Malang, UM Press and publisher of Poor Unfortunate Bayumedia. Then the data obtained were processed and analyzed by qualitative descriptive.Where the method is done by analyzing the data obtained from the results of the real wanwancara who then spelled out and afterwards to drawn the conclusion. From the results of research conducted by using the above methods, the author answers to existing problems, namely a form of legal protection provided to protect the exclusive rights of creators in the royalty agreement is done through preventive and protection as well as protection of the repressive. Preventive protection customized according to given UUHC is related to article 2 paragraph (1), article 35, paragraph (4), article 37 of the Treaty and also the royalties made by the fulfillment of the economic rights and moral rights, it is as a form of protection to prevent the infringement of proprietary rights. Whereas the protection of the given adjusted according to repressive UUHC is related to article 56, paragraph (1), article 68, paragraph (1), (2), (6) and article 73, paragraph (1).But linked with repressive protection is still not fully been granted sebagaimaa provision in the UUHC as does the absence of a clause on the protection of the royalty agreement repressive. Associated with the application of moral rights and economic rights has been done by UB Press, UM Press and publishers Bayumedia as there is in the royalties. Associated with the application of moral rights has been carried out in accordance with article 24 UUHC which the creator has the right to copyright the work published, whereas the application of economic rights vary each Publisher both from UB Press, UM Press and publisher of Bayumedia. In this case the application of economic rights granted by UB great Press because not only royalties but also provided a grant of copyright on the work incentives of creators.
