Abstract
Dalam penulisan skripsi ini akan dibahas tentang penyebab terjadinya tindak pidana peredaran obat berbahaya (daftar G) jenis Carnophen. Permasalahan yang terjadi di kabupaten Tuban, bahwa polres kabupatenTuban selama tahun 2010 sampai dengan tahun 2013 terdapat kurang lebih 136 kasus yang muncul dan ditangani oleh pihak polres kabupaten Tuban terkait tindak pidana peredaran obat berbahaya (daftar G) jenis Carnophen. Upaya-upaya penanggulangan yang dilakukan oleh pihak polres Tuban terkait peredaran obat berbahaya (daftar G) jenis Carnophen sudah maksimal, akan tetapi masih ditemukan peredaran obat berbahaya (daftar G) jenis Carnophen dilapangan. Tujuan dari penelitian ini adalah untuk mendeskripsikan dan menganalisa apa yang menjadi penyebab terjadinya tindak pidana peredaran obat berbahaya (daftar G) jenis Carnophen di kabupaten Tuban. Dalam penulisan skripsi ini metode penelitian hukum yang digunakan adalah pendekatan yuridis kriminologis. Yuridis yaitu meninjau masalah yang diteliti dari segi ilmu hukum dan dengan melihat keterkaitan antara kenyataan dan implementasinya yang bertujuan untuk mendeskripsikan kegiatan atau peristiwa alamiah dalam praktik sehari-hari. Pendekatan yuridis dimaksudkan untuk mengkaji permasalahan dari segi hukumnya, yaitu tentang aturan-aturan yang berkaitan dengan peredaranobatberbahaya (daftar G) jenis Carnophen, sedangkan pendekatan kriminologis digunakan untuk mendeskripsikan realita dan faktor-faktor penyebab terjadinya tindak pidana peredaran obat berbahaya (daftar G) jenis Carnophen di lapangan. . Terdapat beberapa faktor yang menjadi penyebab terjadinya tindak pidana peredaran obat berbahaya (daftar G) jenis Carnophen di kabupaten Tuban, yaitu faktor dari sisi pengedar obat berbahaya (daftar G) jenis Carnophen dan faktor dari sisi pengguna obat berbahaya (daftar G) Jenis Carnophen. Terdapat dua kendala yang dihadapi oleh pihak kepolisian dalam upaya menanggulangi tindak pidana peredaran obat berbahaya (daftar G) jenis Carnophen, yaitu kurangnya bukti untuk dilakukan penangkapan dan kurangnya laporan dari masyarakat. Terdapat dua upaya penanggulangan yang dilakukan oleh pihak kepolisian resort Tuban, yaitu dengan pencegahan dan penindakan. Upaya pencegahan dengan cara memberikan penyuluhan-penyuluhan kepada masyarakat. Upaya penindakan dengan cara pengintaian, penyelidikan, penyidikan, penangkapan, dan penahanan.
English Abstract
