Abstract

Karya tulis ini mengangkat rumusan masalah:(a)Bagaimana pelaksanaan pemberian kredit dengan jaminan fidusia dalam bentuk piutang oleh PT. BRI (Persero). Tbk Cabang Tulungagung?(b) Upaya apa yang dilakukan oleh PT. BRI (Persero). Tbk Cabang Tulungagung untuk menyelesaikan kredit macet dengan jaminan fidusia berupa piutang fiktif? Penulisan karya tulis ini menggunakan jenis penelitian yuridis empiris dengan pendekatan penelitian yuridis sosiologis. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa prinsip kehati-hatian dan prinsip pemberian kredit yang sehat telah diterapkan dalam penyaluran kredit oleh PT. BRI (Persero) Tbk Cabang Tulungagung terutama pada tahap analisis kredit yang dilaksanakan sesuai dengan SK Direksi Bank Indonesia No. 27/162/KEP/DIR dan melakukan penilaian terhadap watak, kemampuan, modal, agunan dan prospek usaha calon debitur. Tidak dapat dilaksanakannya prinsip kehati-hatian dan pemberian kredit yang sehat, antara lain di sebabkan oleh kolusi, ketidaktelitian bank dan iktikad buruk nasabah, lemahnya system informasi kredit serta system pengawasan dan administrasi kredit, nasabah dalam bank, campur tangan yang berlebihan dari pemegang saham bank dalam keputusan pemberian kredit dan pengikatan jaminan yang kurang sempurna. Upaya yang dilakukan untuk mengatasi hambatan tersebut antara lain: memberikan pembebanan dan sanksi, memberikan pembinaan kepada petugas agar konsisten menjalankan prosedur pemberian kredit, tidak membiarkan bahkan berusaha menutupi adanya kredit macet, membuat sistem pengawasan ketat kepada internal bank untuk mengawasi petugas bank, mendaftarkan jaminan fidusia. Penyelesaian kredit macet dengan jaminan fidusia berupa piutang fiktif tidak selalu sesuai dengan Peraturan Bank Indonesia Nomor 2/15/PBI/2000 Tentang Perubahan Surat Keputusan Direksi Bank Indonesia Nomor 31/150/KEP/DIR Tanggal 12 November 1998 Tentang Restrukturisasi Kredit, penyelesaian di tempuh dengan 2 (dua) cara yaitu dengan cara non litigasi atau damai apabila jalur damai tidak bisa dilakukan maka ditempuh cara litigasi atau melalui badan peradilan baik secara perdata maupun pidana.

English Abstract

On the thesis the writer want to bring up the theme of the settlement of non-performing credit with fiduciary guarantee in form of fictional claim because BRI as a creditor has conducted a prudential principle and a credit healthy principle in providing credits as a protection, but in fact there are fictitious credits which inflict a financial loss to creditor.This mini thesisraised the problems:(a) how is the implementation of the provision of credit with the fiduciary guarantee in the form of claim by PT BRI (Persero) Branch of Tulungagung?(b) what is the action has been by PT. BRI (Persero).Tbk the branch of tulungagung to resolve of non-performed credit with the fiduciary guarantee in the form of fictional claim?The writing of this mini thesis is using juridical empirical research with the approachment of juridical sociological research.From the research, the writer got the answers that the prudential principle and healthy credit have been implemented in the distribution of credit by PT BRI (Persero) Branch of Tulungagung especially in the level of credit analysis which conducted as SK BI Directors No. 27/162/KEP/DIR and measuring towards characteristics, the liability, capital, warranty, and business prospect of the debtor applicant. The failure of prudential principle and healthy credit is caused by collusion,inaccuracy of the bank and bad faith of the customer, the lack of credit information and administration systems and supervision of credit, the customer, the massive intervention from the stock holder in decision of credit grant and guarantee binding. The efforts have already been conducted to solve the obstacles, such as :give encumbering and sanction, give a counselling to officers to be consistent in giving credit procedure, transparency in non-performing credit procedure, make a strict system in supervision of internal bank officers,registering the fiduciary guarantee. The settlement of non-performed credit with the fiduciary guarantee in the form of fictional claim by two methods by a non-litigation or peaceful way if the peace cannot be done so it will be taken in a litigation or through the judicial institution both in civil and criminal.
