Abstract

Dalam permasalahan skripsi ini, penulis membahas tentang permasalahan yang diangkat dalam penelitian ini adalah terjadinya disharmonisasi pada pelaksanaan pasal 5 peraturan rektor universitas brawijaya nomor 438 tahun 2013 terkait hak dosen tetap non pegawai negeri sipil universitas brawijaya di universitas brawijaya malang. Hal ini dilatar belakangi dengan adanya hak dosen tetap non pegawai negeri sipil masih belum terlaksana dengan baik sesuai peraturan universitas brawijaya. Berdasarkan hal tersebut, skripsi ini mengangkat rumusan masalah yang pertama mengapa terjadi disharmonisasi pada pelaksanaan pasal 2 peraturan rektor universitas brawijaya nomor 438 tahun 2013 terkait hak dosen tetap non pegawai negeri sipil universitas brawijaya malang, kedua apa hambatan yang dihadapi oleh universitas brawijaya dalam mengharmonisasikan pelaksanaan pasal 5 peraturan rektor universitas brawijaya nomor 438 tahun 2013 terkait dosen tetap non pegawai negeri sipil universitas brawijaya, dan yang ketiga apa solusi yang diambil oleh universitas brawijaya untuk mengahadapi hambatan dan kendala dalam mengharmonisasikan pelaksanaan pasal 5 peraturan rektor universitas brawijaya nomor 438 tahun 2013 terkait dosen tetap non pegawai negeri sipil universitas brawijaya. Peneliti ini bertujuan untuk mengetahui dan menganalisis menegenai pelaksanaan pasal 5 peraturan rektor universitas brawijaya nomor 438 tahun 2013 terkait hak dosen tetap non pegawai negeri sipil universitas brawijaya, untuk mengetahui dan menganalisis hambatan-hambatan yang dihadapi oleh universitas brawijaya dalam mengharmonisasikan pelaksanaan pasal 5 peraturan rektor universitas brawijaya nomor 438 tahun 2013 terkait dosen tetap non pegawai negeri sipil universitas brawijaya baik faktor penghambat maupun faktor pendukung, dan untuk mengetahui solusi untuk menghadapi hambatan-hambatan yang mempengaruhi pelaksanaan hak dosen tetap non pegawai negeri sipil. Upaya dalam mengetahui pelaksanaan pasal 5 peraturan rektor universitas brawijaya nomor 438 tahun 2013 terkaut hak dosen tetap non pegawai negeri sipil maka metode pendekatan yang dipakai adalah yuridis empiris. Kemudian, seluruh data dianalisa secara deskriptif analisis. Berdasarkan hasil penelitian ini, penulis memperoleh jawaban atas permasalahan yang ada, bahwa pelaksanaan hak dosen tetap non pegawai negeri sipil tidak sesuai dengan peraturan yang ada. Solusi yang dilakukan oleh universitas brawijaya untuk meningkatkan kualitas dan mutu mengenai hak dosen tetap non pegawai negeri sipil agar tidak terjadi kecemburuan sosial antara dosen tetap non pegawai negeri sipil dengan dosen tetap pegawai negeri sipil.

English Abstract

The problems of this thesis, the author discusses the problems raised in this research is the occurrence of disharmonisasi on the implementation of article 5 of regulation to brawijaya university rector number 438 years 2013 related rights lecturer remains non civil servant University of brawijaya University of brawijaya in malang. This event without the existence of the right of non-permanent lecturer civil servants still have not done properly conforms regulation University of brawijaya. As such, the thesis is the first problem formulation raised why is there disharmonisasi on the implementation of article 2 of the regulation to brawijaya university rector number 438 years 2013 related rights lecturer remains non civil servant University of brawijaya malang, both what the obstacles faced by University of brawijaya in harmonize the implementation of article 5 of regulation to brawijaya university rector number 438 years 2013 associated professors remain non civil servant University of brawijaya, and the third is what the solution taken by UB for mengahadapi obstacles and constraints in the implementation of article 5 regulations harmonize the Rector of the University of brawijaya number 438 years 2013 associated professors remain non civil servant University of brawijaya. This research aims to find out and analyze the menegenai implementation article 5 regulation to brawijaya university rector number 438 years 2013 related rights lecturer remains non civil servant brawijaya University, to know and analyze the obstacles faced by University of brawijaya in harmonize the implementation of article 5 of regulation to brawijaya university rector number 438 years 2013 associated professors remain non civil servant University of brawijaya good factors supporting factor or barrier, and to find out solutions to confront the obstacles affecting the implementation of the rights of non-permanent lecturer civil servant. Efforts in the implementation of article 5 of regulation knowing Rector University of brawijaya number 438 years 2013 related rights lecturer remains non civil servant then the method used is the juridical approach was empirical. Then, the data were analyzed by descriptive analysis. Based on the results of this research, the author answers to existing problems, and that implementation of the rights of non-permanent lecturer civil servant incompatible with existing regulations. Solutions conducted by the University of brawijaya in order to improve the quality and the quality of teaching on the rights of non-permanent civil servants not to occur social jealousy between the lecturers remained non civil servant with permanent civil servant lecturers.
