Abstract
Pada skripsi ini, penulis membahas mengenai Kajian Yuridis Unsur Memberikan Keterangan Tidak Benar Pada Pasal 123 Juncto Pasal 126 Huruf C Tindak Pidana Imigrasi Dalam Undang-Undang Nomor 6 Tahun 2011 Tentang Keimigrasian. Pilihan tersebut dilatar belakangi karena tidak ada penjelasan pasal demi pasal mengenai unsur memberikan keterangan tidak benar dalam Pasal 123 juncto Pasal 126 huruf c Undang-Undang Nomor 6 Tahun 2011 Tentang Keimigrasian dapat menyebabkan terjadinya kekaburan hukum ( vage van normen ) yang berdampak pada tidak adanya kepastian hukum dalam penegakan hukum. Berdasarkan hal tersebut diatas , skripsi ini mengangkat rumusan masalah: (1) Apa yang dimaksud unsur memberikan keterangan tidak benar pada Pasal 123 juncto Pasal 126 huruf c tindak pidana imigrasi dalam Undang - Undang Nomor 6 Tahun 2011 Tentang Keimigrasian terkait dengan kejahatan pemalsuan dalam Pasal 242 ayat (1), dan Pasal 270 KUHPidana? (2) Bagaimana implikasi yuridis adanya unsur memberikan keterangan tidak benar pada Pasal 123 juncto Pasal 126 huruf c tindak pidana imigrasi dalam Undang - Undang Nomor 6 Tahun 2011 Tentang Keimigrasian? Kemudian penulisan skripsi ini menggunakan metode yuridis normatif dengan menggunakan pendekatan perundang-undangan (statute approach ) , pendekatan analitis ( analytical approach ), dan pendekatan perbandingan ( comparative approach). Sumber bahan hukum primer, sekunder, dan tersier diperoleh melalui studi kepustakaan dan akses internet. Teknik analisa bahan hukum menggunakan metode penafsiran hukum, yaitu interpretasi gramatikal dan interpretasi sistematis. Dari hasil penelitian, penulis memperoleh jawaban atas permasalahan yang ada bahwa pengertian unsur memberikan keterangan tidak benar dalam bidang keimigrasian adalah suatu perbuatan yang dilakukan oleh seseorang (pelaku tindak pidana) dalam proses permohonan atau perpanjangan dokumen keimigrasian dengan cara menyerahkan lampiran persyaratan yang diatur dengan ketentuan perundang-undangan, berupa surat-surat dan sebagainya, berisi uraian, penjelasan atau petunjuk (informasi) yang bertentangan atau tidak sesuai dengan keadaan sebenarnya (kebenaran). Implikasi yuridis adanya unsur memberikan keterangan tidak benar pada Pasal 123 juncto Pasal 126 huruf c tindak pidana imigrasi dalam Undang - Undang Tentang Keimigrasian adalah upaya penanggulangan kejahatan bersifat preventif dan represif. Upaya preventif dilakukan dengan tindakan pengamanan terhadap dokumen keimigrasian. Upaya represif terhadap tindak pidana imigrasi dengan unsur memberikan keterangan tidak benar terdiri dari tindakan non litigasi dan tindakan pro justitia .
English Abstract
In this thesis, the author attempt to analyze about elements of criminal offence that provides improper information on article 123 juncto article 126 letter c as arranged in Law number 6 of 2011 on Immigration. The background of choice because there is no explanation for regarding elements of the article about provides information not correct in article 123 in conjunction with article 126 letter c of The Law number 6 of 2011 on Immigration that can cause the occurrence of vagueness law ( vage van normen ) impact to the absence of legal certainty in law enforcement. Based on the above, this thesis raised the problem formulation: (1) What is the element provides information not correct on article 123 juncto article 126 the letter c was a criminal offence under Law number 6 of 2011 on Immigration related forgery crimes in article 242 paragraph (1), and article 270 of Criminal Codes? (2) How the existence of the juridical implications of the elements providing incorrect information on article 123 juncto article 126 letter c was a criminal offence under the Law number 6 of 2011 on Immigration? Then the writing of graduation thesis of this juridical normative method by using approach of legislation (the statute approach), analytical approach, and comparative approach. Primary legal source materials , secondary source materials, and tertiary source material studies is obtained through the library and internet access. The technique analysis of the legal materials using methods of the grammatical interpretation and systematic interpretation. From the research, writer obtain answers to the existing problems that understanding the elements of giving incorrect information in the immigration is an act committed by a person (perpetrator of a criminal offence) in the process of application for or renewal of immigration documents by handing over the attachment requirements that regulated with the provisions of legislations, in the form of letters and other things contains the description, an explanation or instructions (information) who is discontented or not in accordance with the actual circumstances (the truth). Juridical implications of element provides improper information in article 123 juncto article 126 letter c as the criminal act of Law number 6 year 2011 on Immigration is an attempt to cope with crime preventive and repressive efforts . Preventive efforts measures should be conducted by securing immigration documents. Repressive efforts consisting of the act of non litigation and the act of pro justitia.
