Abstract
Dewasa ini institusi Kepolisian terutama dalam hal penegakan hukum mendapat banyak tantangan dan ujian, salah satunya yaitu berkenaan dengan penegakan hukum pada tindak pidana narkotika dimana dalam penegakan hukum ini penyidik Kepolisian menangani kasus yang tersangkanya adalah anggota Kepolisian. Kasus tindak pidana yang dilakukan anggota Polri yang berkaitan dengan narkotika. Anggota Polri yang seharusnya sebagai alat negara penegak hukum dalam memberantas tindak pidana khususnya narkotika sangat fatal apabila terlibat langsung maupun tidak langsung melakukan tindak pidana narkotika. Keresahan institusi Polri sebagai penegak hukum cukup beralasan karena dampak yang ditimbulkan adalah membuat nama atau citra institusi Polri di depan masyarakat, bangsa dan negara tercemar akibat ulah segelintir oknum Kepolisian yang tidak bertanggungjawab dan sangat berpengaruh pada kinerja Kepolisian kedepan. Dari hal tersebut, Polri atau Kepolisian Negara republik Indonesia perlu melakukan perubahan terhadap penanganan terhadap tindak pidana narkotika oleh anggota Polri dilapangan, serta Polri perlu melakukan pembinaan dan pengawasan kepada anggota Polri yang sudah maupun belum terjun ke lapangan dalam menjalankan fungsi dan tugas Polri, karya tulis ini mengangkat rumusan masalah (1) Apa penyebab terjadinya tindak pidana narkotika yang dilakukan oleh anggota Polri? (2) Apa upaya Ditreskoba Polda Jatim dalam menangani Tindak pidana narkotika yang dilakukan oleh Anggota Polri? Penulisan karya tulis ini menggunakan jenis penelitian yuridis empiris, penelitian dilakukan dengan terjun ke lapangan agar mengetahui fakta-fakta yang terjadi di lapangan. Karya tulis ini didukung dengan data primer sebagai data utama dan data sekunder sebagai data pendukung. Dari hasil penelitian menunjukan bahwa Penyebab terjadinya tindak pidana Narkotika yang dilakukan oleh anggota Polri di wilayah Polda Jatim adalah karena alasan ekonomi, karena keadaan ekonomi yang lemah mereka cenderung mengambil keuntungan dari menjual narkotika sebagai tambahan hasil, dan yang kedua yaitu adalah alasan lingkungan. Anggota polri sering terjun langsung dalam komunitas pengguna saat melakukan penyamaran, dan dari alasan itulah mereka cenderung lebih mudah terpengaruh untuk ingin mencoba masuk dalam dunia seperti itu dan mulai mencoba menggunakan narkotika. Penulis juga menemukan bagaimana upaya yang dilakukan Direktorat Reserse Narkoba Polda Jatim terhadap anggota Polri yang melakukan tindak pidana narkotika yaitu dengan upaya Pre-emtif, preventif dan Represif.
English Abstract
Today the police force, especially in terms of law enforcement got a lot of challenges and tests, one of which is in respect of law enforcement in narcotic cases where the law enforcement investigators suspect police handling the case are members of the Police. Cases of criminal acts committed by members of the Police relating to narcotics. Police officers should have a state law enforcement tool in combating the crime of narcotics very fatal especially when involved directly or indirectly with a criminal offense of narcotics. Unrest Police institution as law enforcement is quite reasonable because the impact is to make the name or image of the front of the police institution in the community, the nation and the polluted state induced handful of police officers who are not responsible and very influential on the future performance of the police. From this, the Police or the State Police republic of Indonesia needs to make changes to the handling of criminal acts by members of the police narcotics field, and the police need to provide guidance and supervision to members of the police who have or have not entered the field in carrying out the functions and duties of the police, the papers this raised the problem formulation (1) What is the cause of the narcotic crime committed by members of the Police? (2) What efforts Ditreskoba East Java Police in dealing with narcotics criminal acts committed by members of the Police? Writing this paper uses empirical type of juridical research, research carried out by plunging into the field in order to find out the facts on the ground. This paper is supported by the primary data as the primary data and secondary data as supporting data. From the results of the study show that the cause of criminal acts committed by members of the Narcotics Police in the region of East Java Police is due to economic reasons, because of their weak economic conditions are likely to take advantage of selling narcotics in addition to the results, and the second is environmental reasons. Members of the police are often involved directly in the user community while undercover, and of the reason why they tend to be more susceptible to want to try to enter the world as it is and start trying to use narcotics. The author also discovered how the efforts of the East Java Police Drug Investigation Directorate against members of the police who committed the crime of narcotics is to attempt Pre-emptive, preventive and repressive.
