Abstract
Pada skripsi ini penulis mengangkat permasalahan Upaya Polri Dalam Melakukan Penyidikan Tindak Pidana Penipuan terhadap Calon CPNS. Pilihan tema tersebut dilatar belakangi oleh banyaknya tindak pidana penipuan terhadap calon CPNS yang ada di Indonesia, terutama di Kabupaten Magetan. Salah satu contoh kasusnya adalahdimana korban dengan inisial S telah dijanjikan oleh tersangka, SM, yang mengaku bisa memasukkan anak korban ke Pemerintah Kabupaten Madiun. Namun, ketika hasil tes CPNS diumumkan, anak dari korban S tidak termasuk ke dalam peserta yang lolos. MT tidak mau mengembalikan uang yang korban berikan, akhirnya S melaporkan MT ke Polres Magetan. Dalam penyidikan tersebut ditemukan beberapa kendala, salah satunya adalah rumitnya izin yang harus dilalui ketika penyidik meminta keterangan dari pejabat. Berdasarkan hal diatas, karya tulis ini mengangkat rumusan masalah : (1) Apa saja kendala yang dihadapi penyidik Polri dalam melakukan penyidikan tindak pidana penipuan terhadap calon CPNS (Calon Pegawai Negeri Sipil)? (2) Bagaimana upaya Penyidik Polri dalam menanggulangi kendala yang dihadapi terkait penyidikan tindak pidana penipuan terhadap calon CPNS (Calon Pegawai Negeri Sipil)? Penelitian ini merupakan penelitian yuridis empiris dengan menggunakan metodeyuridis sosiologis. Data primer diperoleh penulis dengan wawancara langsung kepada penyidik yang bekerja di Kepolisian Resort Magetan di bagian unit tindak pidana umum guna memperoleh data-data serta informasiyang akurat, sedangkan data sekunder diperoleh dengan penelusuran bahan-bahan pustaka dengan mengutip dan menganalisa peraturan perundang-undangan, artikel, buku, atau jurnal yang berkaitan dengan tindak pidana penipuan dalam tes CPNS. Dari hasil penelitian dengan metode diatas, ditemukan kendala pada saat penyidik Kepolisian Resort Magetan melakukan penyidikan tindak pidana penipuan terhadap calon CPNS, kendala tersebut antara lain : Kurangnya Pemahaman korban akan hukum, Pemikiran masyarakat yang menghalalkan segala cara untuk dapat lolos dalam tes CPNS, Kurang jelasnya pembagian tugas antar unit Satreskrim, dan sebagainya. Maka, upaya yang dilakukan Kepolisian Resort Magetan memberikan sosialisasi dan pengertian kepada masyarakat, menambahkan SDM pada unit tertentu untuk mengurangi penumpukan kasus, dan sebagainya dengan tujuan untuk mengatasi kendala-kendala yang ada dalam penyidikan tindak pidana penipuan tersebut supaya penyidikan dapat berjalan efektif.
English Abstract
The problem behind POLRI’s efforts in the investigation of deception crime againts civil servant candidate are considered by the author. The background of the selection of theme is because there so many constraints during the investigation of deception crime againts civil servant candidate in Indonesia, especially at Magetan District. One example case is that the victim, intial S, has been promised by the suspect, MT, that the son of thevictim can get ajob at the government office in Madiun district. However, the result of civil servant exam has excluded the son of the victim S. The suspect MT denies to recover the money the victim has been given and as a result, S bring MT to be reported to Magetan Resort Police. During the investigation, some constraints hinder. One of them is the complex clearance that must be acquired by the investigator to obtain statement from related government officers. Problem of research include : (1) What are the constraints faced by Polri investigators during investigation of deception crime againts civil servant candidate? And, (2) How is the efforts of Polri investigators during investigation of deception crime againts civil servant candidate? Research is empirical juridical study with sociological juridical method. Primary data are acquired bt the author through direct interview with the investigators who work for resort police of Magetan District, the division of conventional crime, in order to obtain accurate data or information. Secondary data are obtain by exploring the literature materials by quoting and analyzing the regulations, articles, books or journals related to the deception criminal during the entry exam of civil servant. Result of research has indicated that there are some constraints faced by the investigators of Magetan Resort Police during investigation of deception crime againts civil servant candidate. These constraints include lack of victim’s understanding about the law, community though that civil servant entry exam can be passed with all necesary means, unclear job division between Satreskrim unit, and others. Magetan Resort Police, terefore, takes several efforts to deal with these constraints such by socializing and giving understanding to community or increasing human resource at certain unit to reduce the excessive accumulation of case and others. Therefore, it is expected that the constraints during the investigation of deception crime can be coped effectively.
