Abstract
Pada skripsi ini penulis mengangkat permasalahan tentang batasan dana kampanye dalam sistem pemilu di Indonesia. Pilihan tersebut dilatar belakangi oleh ketidak setaraan dan peluang menang bagi masing-masing peserta pemilu. Untuk itu perlunya pengaturan tentang batasan dana kampanye untuk menyetarakan peluang menang bagi para peserta pemilu agar dapat menciptakan sistem pemilu yang demokratis. Berdasarkan latar belakang di atas, karya tulis ini mengangkat tiga rumusan masalah, yaitu: (1) Bagaimana pengaturan dana kampanye di Indonesia? (2) Apakah batasan dana kampanye perlu diatur? (3) Bagaimana pengaturan dana kampanye untuk menciptakan sistem pemilu yang demokratis? Penulisan karya tulis ini menggunakan jenis penelitian yuridis-normatif. Pendekatan penelitian menggunakan pendekatan Undang-Undang (statute approach) dan pendekatan konsep (concept approach). Bahan hukum yang digunakan dalam penelitian ini terdiri dari bahan hukum primer yaitu Undang- Undang, bahan hukum sekunder yaitu bahan hukum yang menjelaskan bahan hukum primer, dan bahan hukum tersier yaitu bahan yang memberikan petunjuk maupun penjelasan terhadap bahan hukum primer dan bahan hukum sekunder. Dari hasil penelitian berdasarkan metode di atas, penulis memeroleh jawan atas permasalahan yaitu dimana dana kampanye merupakan faktor penting dalam rangka untuk memenuhi kebutuhan-kebutuhan kampanye, namun dana kampanye bukan merupakan faktor terpenting untuk dapat memenangkan pemilu, karena selain faktor dana kampanye ada pula faktor pendukung lain yaitu efisiensi dana kampanye, strategi pemenangan, organisasi parpol dan juga peran dari caleg. Untuk itu perlunya konsep tentang batasan kampanye yang sesuai adalah konsep dimana batasan untuk parpol yaitu membatasi sumber dari korporasi, sedang untuk caleg yaitu membatasi secara proporsional tergantung dari karakteristik daerah pemilihan masing-masing. Untuk bentuk pengawasan yaitu pengawasan yang dapat menjangkau parpol maupun caleg, karena dalam sistem proporsional daftar terbuka peran parpol maupun caleg sama pentingnya. Kemudian untuk ketentuan sanksi yaitu dengan menggunakan sanksi administrasi bagi peserta pemilu yang melanggar ketentuan tentang dana kampanye. Sanksi tersebut adalah denda bagi peserta pemilu yang terlambat melaporkan dana kampanye dan diskualifikasi bagi peserta pemilu yang melakukan manipulasi dana kampanyenya.
English Abstract
In this thesis the author raises concern about the limitation of campaign funds in the election system in Indonesia. the choice of background by the inequality and the opportunity to win for each participant of the election. to that and the necessity of setting about the limitation of campaign finance for equalizes opportunities for participants to win the election in order to create a democratic election system. Based on the above background, this paper raises three problem formulation, namely: (1). How funds campaign in Indonesia? (2). Whether the limit on campaign funds need to be regulated? (3). How regulating campaign funds to create a democratic electoral system? Writing this paper using types of juridical normative researc. the research approach used the approach of law(statute approach) and approach the concept (concept approach). Legal materials used in this study consist of primary legal material, namely legislation, legal secondary materials namely legal materials that explain the primary legal materials and legal materials tertiary namely legal materials that provide guidance and explanation on legal materials of primary and secondary legal materials. of reseach result based on the above method, authors obtained answers where problem of campaign finance is an important factor in order to meet the need of the campaign, but campaign finance is not the most important factor to able to win the election, because in addition to the campaign fund of factors there are also other supporting factors, namely the efficiency of fund campaign, winning strategies, organisation on the centre as well as the role of parliamentary candidates. for that the necessity of the concept about the limitations of the appropriate campaign is a concept where the limits for political parties which restrict the source of the corporation, currently for parliamentary candidates, namely limiting proportionally depending on the charateristics of each electoral district. for form control, namely the supervision that can reach out to political parties and parliamentary candidates, because in an open list proportional systems the role of political parties and parliamentary candidates are equally important. later for a provision of sanctions that is by using an administrative sanction for breaching election participants about campaign finance. the sanctions are fines for late election participants reported campaign finance and disqualification for election participants who do the manipulations of his campaign funds
