Abstract
Dalam penulisan skripsi ini, penulis membahas mengenai implementasi pasal 8 (a) dan (b) Peraturan Daerah Kota Madiun nomor 08 tahun 2010 tentang perubahan atas Peraturan Daerah Kota Madiun nomor 04 tahun 2006 tentang penyelenggaraan ketentraman dan ketertiban umum. Pilihan tema judul tersebut dilatarbelakangi oleh ketidakefektifan pada pelaksanaan Peraturan Daerah nomor 04 tahun 2006 karena didalamnya belum ada peraturan hukum yang tegas khususnya bagi masyarakat pengguna jalan agar dapat mematuhinya. Maka dari itu peraturan daerah ini diperbarui menjadi Peraturan Daerah nomor 08 tahun 2010 tentang penyelenggaraan ketentraman dan ketertiban umum dikhususkan bagi masyarakat pada pasal 8 (a) dan (b) yaitu dilarang mengamen, meminta-minta dan berjualan di sekitar lampu lalu lintas (traffic light) dan (b) memberi uang atau dalam bentuk apapun kepada pengamen, pengemis maupun anak jalanan di sekitar lampu lalu lintas (traffic light). Berdasarkan hal tersebut, penelitian ini mengangkat rumusan masalah : 1) Bagaimanakah implementasi penyelenggaraan ketentraman dan ketertiban umum khususnya pada pasal 8 (a) dan (b) Peraturan Daerah Nomor 08 Tahun 2010 tentang perubahan atas Peraturan Daerah Nomor 04 Tahun 2006 Kota Madiun?, 2) Faktor-faktor apa saja yang mempengaruhi implementasi tersebut dan bagaimanakah upaya yang dilakukan oleh Pemerintah Kota Madiun dalam mengatasi penertiban anak jalanan dan gelandangan pengemis di Kota Madiun termasuk faktor-faktor pendukung dan penghambatnya?. Jadi tujuan dari penelitian ini adalah untuk memahami dan menganalisis implementasi penyelenggaraan ketentraman dan ketertiban umum khususnya pada pasal 8 (a) dan (b) Peraturan Daerah Nomor 08 Tahun 2010 tentang perubahan atas Peraturan Daerah Nomor 04 Tahun 2006 Kota Madiun. Serta untuk menemukan dan menganalisis faktor-faktor yang mempengaruhi implementasi dan upaya yang dilakukan oleh Pemkot Madiun dalam mengatasi penertiban anjal dan gepeng di Kota Madiun termasuk faktor-faktor pendukung dan penghambatnya. Kemudian penulisan karya tulis ini menggunakan jenis penelitian yuridis empiris dengan metode pendekatan yang digunakan adalah yuridis sosiologis, dalam hal ini adalah peraturan yang dikorelasikan dengan kenyataan di lapangan. Kemudian seluruh data dianalisa secara deskriptif analitis yaitu prosedur pemecahan masalah yang diteliti dengan cara menganalisis kemudian memaparkan atau menggambarkan atas data yang diperoleh dari hasil pengamatan di lapangan dan studi pustaka kemudian dianalisis dan diintrepretasikan dengan memberikan kesimpulan.Berdasarkan hasil penelitian, penulis memperoleh jawaban atas permasalahan yang ada, bahwa implementasi Peraturan Daerah Kota Madiun nomor 08 tahun 2010 tentang perubahan atas Peraturan Daerah Kota Madiun nomor 04 tahun 2006 tentang penyelenggaraan ketentraman dan ketertiban umum ini belum efektif dalam melaksanakan implementasi peraturan daerah tersebut sehingga terjadi perubahan peraturan daerah dari tahun 2006 ke tahun 2010 khususnya pada pasal 8. Serta upaya dan faktor-faktor pendukung dan penghambat yang dilakukan pemerintah Kota Madiun dalam mengatasi penertiban anak jalanan dan gelandangan pengemis agar berjalan dengan lancar dan tertib. Saran dari penulis adalah supaya pelayanan sosialisasi dari Satpol PP ke masyarakat lebih ditingkatkan lagi, serta diharapkan supaya Satpol PP dan Disnakersos lebih intensif lagi bekerjasama dalam hal pembinaan sosial dan pengawasan terhadap anak jalanan dan gelandangan pengemis.
English Abstract
In writing this paper, the authors discuss the implementation of article 8 (a) and (b) the City of Madison Regional Regulation number 08 year 2010 on amendments to the City of Madison Regional Regulation number 04 year 2006 on the organization of public peace and order. Title theme choice is motivated by the ineffectiveness of the implementation of the Regional Regulation number 04 in 2006 because in it there is no strict legal regulations, especially for road users in order to comply. Thus the regulation of this area is updated into the Regional Regulation number 08 year 2010 on the organization of public peace and order to society devoted to the section 8 (a) and (b) is prohibited from busking, begging and selling around the traffic lights (traffic light ) and (b) give money or in any form to buskers, beggars and street children around the traffic lights (traffic light). Accordingly, this study raised the formulation of the problem: 1) How is the implementation of the implementation of peace and public order in particular in Article 8 (a) and (b) Regional Regulation No. 08 Year 2010 concerning amendments to the Regional Regulation No. 04 of 2006 the City of Madison?,2) What factors are affecting the implementation and how the efforts made by the Government of the City of Madison in addressing policing of street children and homeless beggars in the City of Madison including the factors supporting and inhibiting?. So the purpose of this research is to understand and analyze the implementation of the implementation of peace and public order in particular in Article 8 (a) and (b) Regional Regulation No. 08 Year 2010 concerning amendments to the Regional Regulation No. 04 of 2006 the City of Madison. As well as to find and analyze the factors that affect the implementation and the efforts made by the city administration in addressing policing Madiun springy and sprawl in the City of Madison including the factors supporting and inhibiting. Then the writing of this paper uses empirical research type juridical approach is used socio-juridical, in this case the rules are correlated with the reality on the ground. Then all the data were analyzed by descriptive analytical problem-solving procedure is examined by analyzing and then expose or describe on the data obtained from the field observations and literature study then analyzed and interpreted to provide kesimpulan.Berdasarkan results of the study, the authors obtained answers to the problems there, that the implementation of the City of Madison regional Regulation number 08 year 2010 on amendments to the City of Madison regional Regulation number 04 year 2006 on the organization of public peace and order is not effective in carrying out the implementation of the local regulations so that local regulation changes from 2006 to 2010, especially and efforts to Article 8 and the factors supporting and inhibiting the governments control of the City of Madison in addressing street children and homeless beggars in order to run smoothly and orderly. Advice from the author is that the socialization of municipal police services to the community to be much higher, as well as municipal police are expected to be more intensive and Disnakersos cooperate in terms of social development and supervision of street children and homeless beggars.
