Abstract
Pada skripsi ini, penulis mengangkat permasalahan Kendala Penyidik Dalam Mengungkap Tindak Pidana Penipuan Online Melalui medisa Elektronik Internet. Pilihan tema tersebut dilatar belakangi karena Polisi Resort Malang Kota menemui kendala dalam mengungkap kasus penipuan online melalui media elektronik dan tidak adanya kasus yang dapat terselesaikan di Polres Malang Kota. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah: (1) Apa saja kendala penyidik dalam mengungkap tindak pidana penipuan online melalui media elektronik internet? (2) Bagaimana upaya penyidik Polres Malang Kota dalam menanggulangi tindak pidana penipuan secara online melalui media elektronik internet? Kemudian penulisan karya tulis ini menggunakan metode pendekatan dalam skripsi ini adalah metode pendekatan yuridis sosiologis, yaitu metode pendekatan yuridis digunakan untuk mengkaji permasalahan dari segi hukum dan sistematikanya dan sebagai pedoman pada aturan yang dapat dijadikan dasar untuk menganalisa gejala-gejala hukum yang timbul. Sedangkan pendekatan sosiologis digunakan untuk mengkaji suatu masalah di dalam masyarakat atau lingkungan masyarakat dengan maksud dan tujuan untuk mendapatkan fakta, yang dilanjutkan dengan menmukan masalah, yang selanjutnya pada pengidentifikasian masalah dan untuk mencari penyelesaian masalah. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa Polresta Malang kesulitan dalam mengungkap tindak pidana cyber crime, disamping karena terkendala birokrasi perbankan, kurangnya koodinasi penyidik dengan operator selular atau internet service provider, minimnya personil yang memiliki kemampuan dibidang ITE dan alatalat khusus untuk kejahatan ITE. Sehingga dalam penanggulangannya pihak kepolisian hanya melakukan pemblokiran terhadap nomor rekening yang digunakan untuk kejahatan dan melakukan pencegahan berupa penyuluhan ke masyarakat.
English Abstract
In this thesis, the author raises the issue of constraint Investigators Uncover Crime In Online Fraud Through Electronic Medisa Internet. The theme background choice because police Resort Malang encounter any obstacles in uncovering cases of online fraud through electronic media and the absence of cases that can be resolved in Malang City Police. Based on the above, this paper raised the formulation of the problem: (1) What are the constraints investigators in exposing the crime of online fraud through electronic media internet? (2) How Malang City Police investigator effort in tackling criminal fraud online via Internet electronic media? Then the writing of this paper uses the method of approach in this thesis is a socio-juridical approach, namely the juridical approach is used to study the problems in terms of legal and systematics and as a guide to the rules that can be used as a basis for analyzing the legal symptoms arise. While the sociological approach is used to examine a problem in the community or society with the intent and purpose to get the facts, followed by menmukan problems, which further in identifying the problem and to seek resolution of the problem. From the results of research with the above method, the authors obtained answers to existing problems that Malang Police difficulty in exposing the crime of cyber crime, as well as constrained banking bureaucracy, lack of coordination investigator with the service provider or Internet service provider, the lack of personnel who have the ability and the ITE field special tools for crime ITE. So that the mitigation of the police only to block the account number that is used for the prevention of crime and the form of outreach to the community.
