Abstract
Pada Skripsi ini, penulis mengangkat permasalahan mengenai pelaksanaan olahTempat Kejadian Perkara (TKP) pada tindak pidana pembunuhan berencana. Hal tersebut dilator belakangi oleh tugas dan wewenang dari pihak kepolisian khususnya penyidik dalam melakukan penyidikan terhadap tindak pidana pembunuhan berencana, dengan pertimbangan bahwa proses penyidikan terhadap tindak pidana pembunuhan berencana diperlukan pelaksanaan olah Tempat Kejadian Perkara yang cukup cermat dan teliti. Dalam mengungkap suatu kasus tindak pidana pembunuhan berencana penyidik perlu bekerjasama dengan berbagai pihak untuk mencapai keberhasilan dari proses penyidikan. Dengan dilakukannya olah TKP bertujuan untuk mencari dan mengumpulkan barang bukti yang akan menjadi titik terang atau petunjuk bagi penyidik dalam mengungkap dan menemukan pelaku pada tindak pidana pembunuhan berencana. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah: (1)Bagaimana pelaksanaan olah TKP yang dilakukan oleh penyidik pada tindak pidana pembunuhan berencana di Kepolisian Resor Malang? (2) Apa kendala yang dihadapi oleh penyidik dalam melakukan pelaksanaan olah TKP pada tindak pidana pembunuhan berencana di KepolisianResor Malang? Kemudian, penulisan karya tulis ini menggunakan metode penelitian empiris dengan metode pendekatan Yuridis Sosiologis. Sumber data terdiri dari data primer dan data sekunder. Data primer diperoleh dengan carawawancara. Data sekunder diperoleh dengan cara studi kepustakaan, studi dokumentasi, dan penelusuran situs-situs internet yang berhubungan dengan olah TKP. Kemudian, seluruh data dan informasi diolah dengan menggunakan teknik analisis data deskriptif kualitatif. Berdasarkan hasil penelitian penulis memperoleh jawaban atas permasalahan yang ada bahwa pelaksanaan olah TKP dimulai dari persiapan penanganan TKP, perjalanan ke TKP, Tindakan Pertama di Tempat Kejadian Perkara (TPTKP), Olah TKP yang terdiri dari pengamatan umum, pemotretan, pembuatan sketsa, pengumpulan barang bukti, penanganan korban,saksi, dan pelaku, pengorganisasian olah TKP dana khir penanganan TKP. Kendala yang dihadapi penyidik terbagi atas 2 (dua) bagian yakni kendala dari luar kepolisian dan dari dalam kepolisian.
English Abstract
In this thesis, the writer concerns on the implementation though of the scene (TKP) in the crime of murder. It is motivated by duty and authority of the police investigators, especially in investigating the criminal offense of premeditated murder, with the consideration of the process oninvestigation in criminal offenses of premeditated murder which takes place in the implementation of the Case Genesis carefully and thoroughly. In the criminal cases, a murder investigator needs to cooperate with other parties to achieve the success of the investigation. By doing a crime scene aim to seek and collect the evidences that will be a clear spot or instructions for the investigator to reveals and found the perpetrators of the murder crime. Based on the background of the study above, the writerformulated the research problems as follow: (1) How is the implementation of crime scene done by investigators on the crime of murder in Malang Police? (2) What are the problems faced by investigators in conducting crime scene on the implementation of the crime of murder in Malang Police? Furthermore, in this thesis the writer uses empirical research methods with sociological juridical approach. The data source consists of primary data and secondary data. Primary data were obtained by interview while secondary data were obtained by means of library research, documentation studies and search from Internet sites related to the crime scene. Moreover, all the data and information were analyzed by using descriptive qualitative techniques. Based on the results of the study,the writer obtained the answers to the existing problems that the execution of the crime scene began from the treatment preparation scene, traveling to the scene, Action First in The Genesis of the Case (TPTKP), Crime Scene consisting a general observation, photography, sketching, collecting evidence, treatment of victims, witnesses, and perpetrators, organizing and handling the crime scene. The problems faced by the investigators is divided into two parts, namely the problems comes from outside and inside of the police
