Abstract
Sistem pemasyarakatan yang berawal dari “kepenjaraan” kemudian berubah menjadi system pemasyarakatan. Lembaga pemasyarakatan sudah tidak lagi menjadi tempat balas dendam, namun merupakan tempat pembinaan narapidana. Setiap narapidana mempunyai hak-hak, dan Remisi merupakan hak setiap narapidana, bahkan narapidana narkotika juga berhak untuk mendapatkan remisi. Peraturan mengenai remisi dimulai dari PP No 32 tahun 1999, kemudian dirubah dalam PP No 28 tahun 2006, dan saat ini PP No 99 tahun 2012, dimana dalam PP No 99 tahun 2012 menambah syarat dalam pemberian remisi, salah satunya kepada narapidana narkotika. Tujuan penelitian ini untuk mengetahui dan menganalisa kendala pemberian remisi berdasarkan PP No 99 tahun 2012, dan upaya untuk mengatasi kendala tersebut. Hasil penelitian ini adalah terdapat perbedaan proses pengajuan remisi. Untuk narapidana yang terkena PP no 28 tahun 2006, cukup di ajukan sampai di Kanwil saja, sedangkan untuk narapidana yang terkena PP no 99 tahun 2012, pengajuan remisi di ajukan sampaike Menteri Hukum dan HAM. Narapidana yang di pidana lebih lima tahun akan terkena PP no 99 tahun 2012, jika putusan penjatuhan hukumannya setelah tanggal 12 November 2012. Jika penjatuhan hukuman sebelum tanggal 12 November 2012 akan terkena PP no 28 tahun 2006. Untuk mengantisipasi surat bekerjasama dengan penegak hukum untuk membongkar tindak pidana yang dilakukannya, pihak Lapas membuatkan surat pernyataan terlebih dahulu kalau narapidana yang di ajukan tersebut telah mengajukan surat Keterangan bersedia bekerjasama dan masih dalam proses.
English Abstract
Community institutionalization system begins from the expression of “detention”. The community institution is not a place for retaliation but represents a place to foster the convict into the better person. Every convict has rights and one such right is for remission. It is then possible that narcotic convict also has right for remission. Regulation over remission has been acknowledged through Government Regulation No. 32 of 1999 which then amended into Government Regulation No. 28 of 2006. Then, Government Regulation No. 99 of 2012 underscores the provision of this remission for narcotic convict. The objectives of this research are to understand and to analyze the provision of remission based on Government Regulation No. 99 of 2012 and to deal with the barrier. Result of research indicates that the process of submitting for remission may vary. For the convict subjected to Government Regulation No. 28 of 2006, they can submit the request for remission to Regional Office, but for the convict subjected to Government Regulation No. 99 of 2012, the submission for remission is sent into The Minister of Law and Human Rights. The applicant convict with five years in prison will be subjected to Government Regulation No. 99 of 2012 but under condition that the verdict of the punishment is dated after November 12th of 2012. If the verdict is given before November 12th of 2012, the applicant convict will be subjected to Government Regulation No. 28 of 2006. To anticipate the note of cooperation with the legal officer in revealing the criminal action, the management of community institution will equip the applicant convict with the letter of statement which informs that the applicant convict is on-going to register for the note of cooperation.
