Abstract
Penulisan skripsi ini bermaksud membahas mengenai pemiliihan cara alternatif untuk menyelesaikan kasus pidana judi togel yang dikenai kepada empat pengecer togel di Kecamatan Gedangan yang terjadi pada medio tahun 2009 – 2011. Latar belakang penelitian ini adalah bahwa di Kecamatan Gedangan, Kabupaten Sidoarjo menganggap judi togel bukan sebagai suatu tindak kejahatan yang patut dikhawatirkan. Pokok permasalahan dari skripsi ini adalah : faktor – faktor yang melatar belakangi penyelesaian perkara judi togel di Kecamatan Gedangan menggunakan proses non litigasi dan realita penyelesaian perkara judi di Kecamatan Gedangan. Metode penelitian yang digunakan untuk membahas permasalahan dalam penelitian ini adalah empiris sosiologis, dengan pendekatan deskriptif kualitatif, lokasi penelitian berada di Kecamatan Gedangan, jenis dan sumber data penelitian ini adalah data primer dan data sekunder, populasi penelitiannya ialah para penjudi togel sedangkan sampelnya adalah penjudi togel yang tertangkap oleh Kepolisian Sektor Gedangan dan menyelesaikan perkaranya pidananya menggunakan metode alternatif, teknik pengumpulan datanya menggunakan metode wawancara terbuka dan tertutup serta analisa datanya dengan metode kualitatif deskriptif. Hasil penelitian kepada sampel, para pengecer togel yang menggunakan metode alternatif penyelesaian perkara di kasusnya menemukan bahwa faktor – faktor pemilihan metode alternatif penyelesaian perkara pidana di kasusnya ialah karena faktor keluarga dan faktor polisi, disertai dengan beberapa faktor minor yang menyertainya. Realita penyelesaian perkara judi togel di Kecamatan Gedangan sendiri tidak semuanya menggunakan metode alternatif penyelesaian perkara pidana, namun juga ada yang sudah diadili dan divonis oleh Pengadilan Negeri Sidoarjo, dianggap telah terbukti bersalah melakukan tindak pidana perjudian sebagaimana dimaksud dalam pasal 303 KUHP.
English Abstract
The author of this thesis intends to discuss four lottery retailers who use alternative ways to resolve their gambling criminal cases that occurred in mid-year 2009 - 2011 in the Gedangan District. The background of this research is that the people in the District Gedangan, Sidoarjo. Assume that lottery gambling is not a crime to worry about. The subject matter of this thesis are: What are the factors behind the use of alternative methods of criminal settlement in the case of lottery gambling occurring in the Gedangan District and the reality of gambling in the Gedangan District. The method used to address issues in this research is empirical sociological, with qualitative descriptive approach, study sites located in the Gedangan District, types and sources of research data is the primary data and secondary data, study population were lottery gamblers and sample is a lottery gamblers that has been arrested by the Police Sector Gedangan but use alternative methods to resolve the case, data collection techniques using interviews with open-type questions and closed-type, and analysis of the data by using descriptive qualitative method. The results on the sample, ie the lottery retailers who use alternative methods of settlement of criminal cases in their case, found that the selection of an alternative method of settlement in the case is a criminal case because of the family and the police factor, along with some accompanying minor factor. Reality of lottery gambling case settlement that occurred in the Gedangan District themselves are not all using alternative methods of settlement of criminal cases, but also some that have been tried and convicted by the District Court of Sidoarjo, as having been convicted of gambling offenses referred to in Article 303 of criminal law books.
