Abstract

Dalam rangka mewujudkan perlindungan hak buruh migran di kawasan ASEAN, pada tahun 2007 negara-negara ASEAN sepakat menandatangani ASEAN Declaration on the Protection and Promotion of the Rights of Migrant Workers. Secara ideal, deklarasi yang juga dikenal dengan sebutan Deklarasi Cebu ini seharusnya mampu menjadi sebuah instrumen hukum dalam mewujudkan kondisi kerja yang adil dan layak bagi buruh migran. Indonesia sebagai salah satu negara pengirim BMI kerap kali dihadapkan pada kasus-kasus pelanggaran hak yang menimpa BMI di beberapa negara tujuan. Mulai dari kekerasan fisik, pelecehan, kekerasan seksual, kriminalisasi, penembakan, hingga bentuk yang sampai menghilangkan nyawa BMI termasuk ancaman hukuman mati. Penelitian ini akan menganalisa mengenai ASEAN Declaration on the Protection and Promotion of the Rights of Migrant Workers. Ada dua permasalahan yang diangkat dalam skripsi ini, yakni: 1) Apakah ASEAN Declaration on the Protection and Promotion of the Rights of Migrant Workers sudah mampu menjadi isntrumen hukum dalam mewujudkan kondisi kerja yang adil dan layak bagi BMI di Malaysia; 2) Bagaimana upaya pemerintah RI dalam menegakkan ASEAN Declaration on the Protection and Promotion of the Rights of Migrant Workers untuk menjamin kondisi kerja yang adil dan layak bagi BMI di Malaysia. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan metode pendekatan undang-undang (statute approach), yakni dengan menelaah undang-undang dan regulasi yang bersangkut paut dengan isu hukum yang sedang ditangani. Dalam penulisan hukum ini, kasus yang diangkat penulis akan dianalisa berdasarkan Peraturan Perundang-undangan yang berlaku di tataran internasional, di ASEAN, dan Indonesia. Hasil analisa dalam penelitian ini menunjukkan bahwa Deklarasi Cebu belum mampu dilaksanakan secara maksimal dalam mewujudkan kondisi kerja yang adil dan layak bagi BMI yang bekerja di luar negeri. Deklarasi Cebu dalam substansinya masih terkesan terlalu umum dan tidak secara detail menjelaskan aspek-aspek hak-hak buruh migran yang harus dilindungi. Di sisi lain, peran pemerintah Indonesia dan Malaysia terkesan masih belum cukup serius dalam memperjuangkan hak-hak buruh migran sebagaimana yang termaktub dalam semangat Deklarasi Cebu. Semua hal tersebut diindikasikan dengan masih maraknya pelanggaran-pelanggaran atas hak BMI di Malaysia yang tak jarang hingga berujung pada penyiksaan, pemerkosaan, dan bentuk pelanggaran hak asasi manusia yang lain, hingga kematian BMI di Malaysia hingga mencapai angka 910 jiwa dalam kurun 1 tahun selama 2013.

English Abstract

In order to realize the protection of the rights of migrant workers in the ASEAN region, in 2007, ASEAN countries agreed to sign the ASEAN Declaration on the Protection and Promotion of the Rights of Migrant Workers. Ideally, the declaration which is also known as the Cebu Declaration is supposed to be able to become a legal instrument in creating fair working conditions and fair to migrant workers. Indonesia as one of the sending countries BMI is often confronted with cases of rights violations affecting BMI in some destination countries. Ranging from physical violence, harassment, sexual violence, criminalization, shooting, to shape their lives to eliminate the threat of the death penalty, including BMI. This study will analyze the ASEAN Declaration on the Protection and Promotion of the Rights of Migrant Workers. There are two issues raised in this paper, namely: 1) Are the ASEAN Declaration on the Protection and Promotion of the Rights of Migrant Workers has been able to become a legal instrument of accession in creating decent and fair working conditions for BMI; 2) The effort of the Indonesian governments efforts in establishing the ASEAN Declaration on the Protection and Promotion of the Rights of Migrant Workers to ensure decent and fair working conditions for BMI. The method used in this research is the normative approach (statute approach), ie by examining the laws and regulations that has to do with the legal issues that are being addressed. In writing this law, the authors raised the case will be analyzed based on the legislation in force at the international level, in ASEAN, and Indonesia. The results of the analysis in this study showed that the Cebu Declaration has not been able to be implemented optimally in creating fair working conditions and decent for BMI were working abroad. Cebu Declaration in substance still seem too general and do not explain in detail the aspects of the rights of migrant workers should be protected. On the other hand, the role of the Indonesian government and BMI recipient countries seem still not serious enough in fighting for the rights of migrant workers as embodied in the spirit of the Declaration of Cebu. All that is indicated by the still widespread violations of the right BMI in the ASEAN region is not uncommon to lead to torture, rape, and other forms of human rights abuses others, until the death of BMI in Malaysia until reaching 1,249 souls within 1 year for , 2013.
