Abstract
Pada skripsi ini, penulis mengangkat permasalahan mekanisme The Special Court for Sierra Leone (SCSL) yang merupakan salah satu hybrid tribunal yang dibentuk berdasarkan kesepakatan antara Perserikatan Bangsa Bangsa (PBB) dengan pemerintah Sierra Leonne untuk mengadili para pelaku kejahatan terhadap kemanusiaan selama perang sipil di Sierra Leone pada tahun 1991-2002. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : (1) Bagaimanakah mekanisme pelaksanaan The Special Court for Sierra Leone (SCSL) dalam menyelesaikan kasus kejahatan terhadap kemanusiaan pada civil war 1991-2002? (2) Apa saja faktor-faktor penghambat yang mempengaruhi efektifitas The Special Court for Sierra Leone (SCSL) dalam menyelesaikan kasus kejahatan terhadap kemanusiaan pada civil war 1991-2002? Kemudian penulisan karya tulis ini menggunakan metode yuridis normatif dengan metode pendekatan undang-undang (Statute approach), pendekatan kasus (case approach) dan pendekatan konsep (Conceptual Approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan teknik deskriptif-analisis yaitu suatu metode analisis bahan hukum dengan mengaitkan pada asas-asas hukum dan berdasar teori-teori hukum yang terait dengan permasalahan yang ingin penulis bahas. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahn yang ada bahwa Mekanisme The Special Court for Sierra Leone (SCSL) berjalan tidak efektif dalam menyelesaikan kasus kejahatan terhadap kemanusiaan pada civil war 1991-2002 karena beberapa aspek tidak mendukung seperti sumber daya manusia dan kebudayaan hukum masyarakat setempat mengenai respon serta partisipasi terhadap keberadaan The Special Court for Sierra Leone (SCSL) dalam menyelesaikan kasus kejahatan terhadap kemanusiaan pada civil war 1991-2002.
English Abstract
In this thesis, the author raised the issue of The Mechanism of The Special Court for Sierra Leone (SCSL) to Solve The Gross Human Right Violation Case during Sierra Leone’s Civil War 1991-2002 as part of international hybrid tribunal established by United Nation and the government of Sierra Leone according to the agreement. Based on the above, this thesis raised the formulation of the problems: (1) How is the mechanism of The Special Court for Sierra Leone (SCSL) to solve the problem during Sierra Leone’s civil war 1991-2002? (2)What the problems influencing the effectiveness of The Special Court for Sierra Leone (SCSL) to solve the problem during Sierra Leone’s civil war 1991-2002? Then the writing of this thesis used the method of normative juridical with a statute approach, a case approach and a conceptual approach. Primary legal materials, secondary, and tertiary obtained by the authors will be analyzed using descriptive-analytical technique is a method of analysis of legal materials by linking the principals of law and legal theories based on the issues that the author wants to discuss. From the results of research by the above method, the authors obtained answers to existing problems that The Special Court for Sierra Leone (SCSL) work ineffectively to solve the problem during Sierra Leone’s civil war 1991-2002 due to the human resources and culture to participate in the process of trial which are held in The Special Court for Sierra Leone (SCSL).
