Abstract

Pada skripsi ini mengangkat permasalahan Pelaksanaan Perlindungan Hukum Terhadap Folklore Motif Batik Khas Blitar. Hal tersebut dilatar belakangi kekayaan budaya tradisional dalam bentuk folklore salah satunya adalah motif batik mutlak harus mendapat perlindungan secara hukum. Kondisi peraturan perundangn yang mengatur tentang folklore selama ini dipandang banyak mempunyai permasalahan dan kekurangan. Hal tersebut dikarenakan perbedaan karakteristik antara folklore dengan HKI, yang otomatis tidak akan terakomodasinya perlindungan terhadap folklore . Perlunya sebuah undang-undang yang bersifat sui generis tentang folklore kemudian kembali mencuat dan diharapkan dapat segera disahkan oleh pemerintah yang saat ini masih dalam tahap RUU. Dilain sisi, berbagai macam motif batik yang dimiliki,menunjukkan Blitar juga mempunyai warisan budaya nasional yang perlu dilindungi. Tetapi sayangnya batik tulis khas yang dimiliki masyarakat blitar belum mendapatkan perhatian berupa perlindungan hukum yang memadai oleh pemerintah kabupaten blitar. Penelitian ini menggunakan jenis penelitian yuridis normatif untuk rumusan masalah yang pertama yaitu hendak menganalisis ketentuan UU No. 19 tahun 2002 tentang Hak Cipta. Sedangkan rumusan masalah kedua menggunakan meteode yuridis empiris karena hendak mengkaji tentang pelaksanaan perlindungan hukum terhadap motif batik khas blitar, yaitu mengamati penerapannya., hambatan serta upayanya. Dalam penelitian ini ditemukan bahwa terdapat kekurangan dalam hal normative maupun law enforcement terhadap undang-undang yang mengatur tentang folklore yang terdapat dalam undang-undang hak cipta. Dalam tataran normative, perlindungan hukum melalui sistem HKI sangatlah lemah dan dapat dikatakan tidak sesuai dengan karakteristik yang dimiliki oleh pengetahuan tradisional atau folklore. Pengaturan dalam pasal yang sangat umum dan tidak mengatur secara tegas tentang sistem pembagian kewenangan tentang pengelolaan hak dari pengetauan tradisonal dan folklore . selain itu peraturan perundangan yang mengatur mekanisme penyelesaian sengketa tentang folklore masih sangat lemah. Dalam hal penerapan hukumnya (law enforcement ) terdapat beberapa kesimpulan bahwa pengetahuan mengenai HAKI baik oleh pemerinta maupun pengrajin masih sangat rendah. Selain itu perlindungan hukum belum menjadi prioritas yang utama bagi pemerintah kabuoaten blitar dalam progam kerja tahunananya. Selain itu, belum ada dana alokasi khusus untuk perlindungan budaya tradisional khususnya motif batik khas blitar. Upaya yang dilakuakn oleh pemerintah kabupaten blitar hingga saat ini hanya dalam bentuk pendekatan yang sifatnya bantuan. Rekomendasi untuk pemerintah: a) segera mengesahkan RUU tentnag folklore (RUUPTEBT), b)membuat database tentang folklore, c)menggunakan mekanisme alternative penyelesaian sengketa dalam menyelesaikan sengketa menyangkut folklore, d) Peran aktif Pemerintah Kabupaten Blitar untuk melindungi dan melestarikan motif Batik khas yang ada di Kabupaten Blitar

English Abstract

On this paper I’m raising the issue of the Implementation of legal Protection towards folklore Blitar Signature batik motives. It is against the background of cultural heritage in the form of folklore, one of them is batik motif which needs an absolute protection by the law. The conditions of current regulations governing the conditions of folklore has been seen many problems and weaknesses. This is due to differences in characteristics between folklore with HKI, which will not automatically accommodate towards the protection against folklore. The need for a law of sui-generis nature of folklore then back sticking and is expected to be passed by the current government which until now is still in the stage of the bill (RUU). On the other hand, various kinds of batik owned by Blitar, showed that Blitar also has a national cultural heritage that absolutely needs to be protected . But unfortunately typical batik owned by Blitar society has not received attention in the form of adequate legal protection by the district government of Blitar. This research uses normative research for the first formulation of the problem that is going to analyze the provisions of UU no. 19 of 2002 on Copyright. While the second problem formulation using empirical jurisdiction method that they aimed to learn about the implementation of the legal protection of a typical motif Batik in Blitar, which observes it’s application, Barriers and efforts. In this study it was found that there are deficiencies in terms of normative and law enforcement towards the laws governing folklore contained in copyright law. At the level of normative, legal protection through HKI system is very weak and can be said to be not in accordance with the characteristics possessed by the traditional knowledge or folklore. The settings in the section of the regulation that is very common and do not provide specific about the authority of the management system of the division of rights and traditional knowledge and folklore. Besides that, the legislation governing the dispute settlement mechanism of folklore is still very weak. In terms of the application of the law (law enforcement), there are several conclusions that knowledge about HKI either by government and craftsmen are still very low as well. Besides that the legal protection has not been a major priority for the government of Blitar in their annual program. Moreover, there is no specific allocation of funds for the protection of traditional culture , especially the typical of signature batik motif of Blitar. Efforts that been done by the district government of Blitar that was implemented to date only in the form of assistance approach. Recommendations for government : a) immediately pass the bill (RUU) about folklore ( RUUPTEBT ) , b ) create a database of folklore , c ) use of alternative dispute resolution mechanisms to resolve disputes concerning folklore , d) The active role of Blitar District Government to protect and preserve the Blitar’s signature motif of batik
