Abstract
Kurangnya Polisi mengamalkan prinsip moral dan kode etik profesi pada diri mereka yang mengakibatkan masih adanya pelanggaran yang dilakukan oleh anggota Polri. Sehingga dalam hal ini Kepolisian harus lebih tegas dalam menggunakan Kode Etik Profesi Kepolisian agar lebih meningkatkan profesionalisme para anggotanya. Berdasarkan hal tersebut, skripsi ini mengangkat rumusan masalah tentang bagaimana penanganan pelanggaran kode etik profesi kepolisian di Polres Malang, apa kendala Polri dalam menegakan Kode Etik Profesi Kepolisian terhadap anggotanya dan bagaimana upaya Polri dalam mengatasi kendala menegakan kode etik profesi kepolisian terhadap anggotanya. Untuk mencapai tujuan tersebut peneliti menggunakan jenis penelitian yuridis empiris. Di dukung data dengan primer dan sekunder. Dari hasil penelitian tersebut, ditemukan jawaban dari masalah yang dirumuskan peneliti. Dalam pembahasan dikemukakan dua realita pelanggaran Kode Etik Profesi Kepolisian, yaitu polisi yang melakukan pelanggaran berupa tindak pidana dengan menjual narkotika golongan I dan polisi yang melakukan pelanggaran disiplin kerja dengan meninggalkan tugas secara tidak sah selama 30 (tiga puluh) hari kerja berurut-turut yang dilakukan anggota Kepolisian di Polres Malang. Untuk itu pelanggaran yang dilakukan oleh anggota Kepolisian ini dapat diadili dengan cara sidang pengadilan umum atau negeri terlebih dahulu untuk masalah tindak pidana kemudian dilakukan sidang Komisi Kode Etik Profesi sedangkan untuk pelanggaran disiplin kerja secara tidak sah selama 30 (tiga puluh) hari kerja berurut-turut dapat langsung di sidang Komisi Kode Etik Profesi. Kendala Polri dalam menegakan kode etik profesi kepolisan di Polres Malang ini, antara lain: tidak hadirnya terduga pelanggar, lamanya proses persidangan di pengadilan umum atau negeri, tidak adanya bidang pertanggungjawaban profesi di tingkat Polres, tidak hadirnya saksi dalam pelaksanaan sidang KKEP serta kurangnya kesadaran, kepatuhan dan penerapan oleh anggota Polri dalam mentaati kode etik profesi. Kendala yang dihadapi Polri dalam menegakan kode etik profesi kepolisan di Polres Malang membuat upaya yang digunakan dalam mengatasi kendala, sebagai berikut pertama, peningkatan status terduga pelanggar menjadi DPO, persiapan pelaksanaan sidang KKEP lebih awal, pengusulan dibentuknya bidang pertanggungjawaban profesi di tingkat Polres, penyidik mendatangi kediaman saksi serta pembinaan terhadap kinerja Polri.
English Abstract
Lack of moral principles and code of profession ethics by police caused the violations committed by its members. Thus in this case the police should be more explicitin using the police profession ethics code in order to improve the professionalism of its members. Based on it, this thesis raised the problem formulation as follows how to handle violations of police profession ethics code in Polres Malang, what are the constraints for the Polri who establish the proffesion ethics code to its members and how does the Polri effort in overcoming constraints to establish the police profession ethics code to its members. To reach these goal, the researcherused the kind of research called juridical-empirical research. Supported by primary and secondary data. From this research, found the answer of problems which was formulated by researcher. In the discussion mentioned two violations of the police profession ethics code, the police who violated a criminal law by selling narcotics group I and the police who violate work discipline by leaving dutiesil legally for 30 (thirty) working days sequantially. For the violations committed by members of the police can be judged in public orstatecourt proceeding to criminal acts issue then done the Proffesion Ethics code Commission (KKEP) hearing for work disciplinary offen illegally for 30 (thirty) working days can bedirectly hearing at Proffesional Ethics code Commission (KKEP). Constraints of Polri in establishing profession ethics code in Polres Malang, such as the absence ofthe unexpected offender, the profession responsibility in the field of Polres, the absence of a witness in the KKEP hearing execution and lack of awareness, compliance and implementation by members of the Police in obeying profession ethics code. The constraints faced by the police in establishingt he code of professional ethics of the police in Polres Malang made the effort used inovercoming constraints, as follows the increase inunexpected offenders status into DPO, early preparation for KKEP hearing execution, proposing the establishment of the field of professional responsibility in the field of Polres, investigators went to the witnesses residence and gave guidance on the performance of Polri.
