Abstract
Skripsi ini mengangkat permasalahan inkonsistensi pengaturan tentang pembentukan dan pembubaran serikat pekerja/serikat buruh dalam UU No. 21 Tahun 2000 tentang Serikat Pekerja/Serikat Buruh terhadap UU No. 17 Tahun 2013 tentang Organisasi Kemasyarakatan. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : Mengapa terjadi inkonsistensi pengaturan tentang pembentukan dan pembubaran serikat pekerja/serikat buruh dalam UU No. 21 Tahun 2000 tentang Serikat Pekerja/Serikat Buruh terhadap UU No. 17 Tahun 2013 tentang Organisasi Kemasyarakatan ? Penelitian ini merupakan jenis penelitian normatif yang dilakukan dengan menggunakan metode pendekatan perundang-undangan, pendekatan perbandingan hukum, dan pendekatan sejarah. Berdasarkan hasil penelitian dengan metode-metode tersebut, diperoleh jawaban atas permasalahan yang ada bahwa alasan utama yang mengakibatkan terjadinya inkonsistensi tersebut adalah kerancuan pembentuk undang-undang dalam membuat rumusan mengenai definisi ormas yang terlalu luas dalam UU Ormas yang menimbulkan pengertian bahwa serikat pekerja/serikat buruh merupakan salah satu bentuk ormas. Alasan ini juga menimbulkan adanya alasan-alasan lainnya yang didasarkan pada sejarah terbentuknya UU No. 17 Tahun 2013 tentang Organisasi Kemasyarakatan, penggolongan serikat pekerja/serikat buruh sebagai sebuah ormas pada saat sebelum dan sesudah berlakunya UU No. 21 Tahun 2000 tentang Serikat Pekerja/Serikat Buruh, analisis dengan menggunakanasas-asas hukum umum (asas Lex Posteriori Derograt Legi Priori dan asas Lex Specialis Derograt Legi Generalis), serta adanya ketidakrelevan-an antara maksud dan tujuan dibentuknya UU No. 17 Tahun 2013 tentang Organisasi Kemasyarakatan. Alasan-alasan tersebut pada akhirnya berdampak pada adana hakhak masyarakat untuk berserikat, berkumpul, dan mengemukakan pendapat menjadi terganggu.
English Abstract
of Workers Union/Labor Union in Law number 21 Year 2000 respecting to Workers Union/Labor Union against Law number 17 Year 2013 respecting to Civil Organization. Based on the statements above, this paper raised an issue about: Why regulation inconsictence happens regarding to formation and dismission of Workers Union/Labor Union in Law number 21 year 2000 respecting to Workers Union/Labor Union against Law number 17 Year 2003 respecting to Civil Organization? This research is a normative research which is being done with statuta approach, comparative approach, and historical approach. Based on this research results, obtained answers to existing problems that the main reason that led to the inconsistency is ambiguity in the law makers to make a statement about the organizations that are too broad definition in the Law Society Organizations which give rise to the notion that the union / labor union is one form of organization. This reason also gave rise to other reasons based on the history of the formation of Law. 17 Year 2013 on Community Organisations, the classification of trade unions / labor unions as an organization at the time before and after the entry into force of Law Number 21 Year 2000 on the Trade Union / Labour Union, an analysis using the general principles of law (principle of Lex Derograt Legi Priori and Posteriori principle Lex Specialist generalist Derograt Legi), as well as the late irrelevance between the intent and purpose of the establishment of Law Number 17 Year 2013 on Community Organisations. Those reasons have impact in emergence of people rights to associate, gathering, and speak one’s mind to be disrupted.
