Abstract

Pada skripsi ini, penulis mengangkat permasalahan pemindahan pencari suaka dalam Hukum Internasional. Pemilihan tema tersebut dilatarbelakangi oleh adanya tindakan Australia yang memindahkan pencari suaka yang datang ke wilayahnya ke negara ketiga, yaitu Malaysia dan Papua Nugini. Adanya pemindahan pencari suaka ini dinilai banyak pihak telah melanggar prinsip non-refoulement dan juga tindakan ini dianggap sebagai upaya Australia menghindari kewajiban internasionalnya dalam Hukum Internasional. Berdasarkan hal tersebut di atas, skripsi ini mengangkat rumusan masalah: (1) Apakah tindakan Australia yang melakukan pemindahan pencari suaka (transfer of asylum seeker) dibenarkan menurut Hukum Internasional? (2) Bagaimana tanggung jawab Australia sebagai the Transferring State serta Malaysia dan Papua Nugini sebagai the Receiving States dalam Hukum Internasional? Kemudian penulisan skripsi ini menggunakan metode penelitian yuridis normatis dengan metode pendekatan Statute Approach dan Case Approach. Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis melalui Library Research akan dianalisis dengan menggunakan teknik deskriptif analitis yaitu suatu metode analisis bahan hukum dengan cara menentukan makna aturan hukum dari konvensi internasional, protokol tambahan konvensi internasional, deklarasi internasional, statuta international, dan pendapat para ahli hukum internasional, yang kemudian dijadikan rujukan dalam menyelesaikan permasalahan hukum yang menjadi objek kajian. Dari hasil penelitian dengan metode tersebut di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa tindakan pemindahan pencari suaka yang dilakukan Australia dibenarkan menurut Hukum Internasional selama tindakan tersebut sesuai dengan unsur-unsur dalam Guidance Note yang dikeluarkan UNHCR serta unsur-unsur kebiasaan internasional negara-negara di dunia. Selain itu, baik Australia maupun Malaysia dan Papua Nugini tetap bertanggung jawab terhadap para pencari suaka sesuai dengan Hukum Internasional, khususnya Konvensi tentang Status Pengungsi tahun 1951. Untuk selanjutnya, penulis memberikan saran agar nantinya disusun sebuah instrumen Hukum Internasional yang mengatur tentang pemindahan pencari suaka dan juga perlu tanggung jawab para pihak yang terlibat, baik negara pengirim maupun negara penerima.

English Abstract

In this paper, the author raised the issue of the transfer of asylum seeker under International Law. The reason beyond this theme was motivated by the action of Australia that moved the asylum seekers who came to its territory to the third country, namely Malaysia and Papua New Guinea. Many parties considered the existence of the transfer of asylum seeker have violated the principle of non-refoulement and this action was also regarded as Autralias attempt to avoid its international obligations under International Law. Based on those reasons, this paper raised two problems: (1) Is the action of Australia to transfer the asylum seeker justified under International Law? (2) What about the responsibility of the Australia as the Transferring State as well as Malaysia and Papua New Guinea as the Receiving States? Furthermore, this paper used the normative judicial method with Statute and Case approaches. Primary, secondary, and tertiary legal materials obtained by the author through the Library Research that will be analyzed using the analytical descriptive technique; is a legal materials analysis method by determining the meaning of international conventions, additional protocol of international conventions, international declarations, international statutes, and international law experts opinions, which then used as reference in resolving the legal issues. From the research results, the author came up with the answers for the following issues that the Australia’s action to transfer the asylum seeker is justified by the International Law in accordance with the elements written in the Guidance Note issued by the UNHCR and the customary international elements by the internationals. In addition, Australia, Malaysia, and Papua New Guinea still have the responsibility to protect the asylum seekers in accordance with the International Law, especially the Convention on the Status of Refugees on 1951. At last, the author suggested the public to create an international law instruments which govern the action of transfer of asylum seeker and also the responsibilities from the parties involved, both the Transferring State and the Receiving State.
