Abstract
Pada skripsi ini penulis mengangkat permasalahan mengenai Urgensi Pengaturan Pemberian Hadiah Berupa Layanan Seks sebagai Bentuk Tindak Pidana Gratifikasi. Pemilihan judul tersebut dilatarbelakangi oleh beberapa kasus suap yang terjadi di Indonesia terkait adanya pemberian hadiah berupa layanan seks kepada pegawai negeri atau penyelenggara karya tulis ini mengangkat rumusan masalah sebagai berikut: (1) Apakah pemberian hadiah berupa layanan seks dapat dikualifikasikan sebagai gratifikasi terkait dengan Pasal 12B Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi? (2) Apa urgensi pengaturan pemberian hadiah berupa layanan seks sebagai bentuk gratifikasi? Penulisan karya tulis ini menggunakan jenis penelitian yuridis normatif dengan metode pendekatan perundang-undangan (statute approach). Bahan hukum yang digunakan meliputi bahan hukum primer, sekunder dan tersier yang dikumpulkan penulis dengan melalui studi dokumen, studi kepustakaan, dan studi internet. Bahan hukum yang diperoleh kemudian dianalisis dengan cara memberikan gambaran objek kajian, kemudian melakukan interpretasi dan yang yang terakhir memberikan kesimpulan serta saran. Dari hasil penelitian, diperoleh hasil bahwa pemberian hadiah berupa layanan seks merupakan bentuk gratifikasi terkait dengan Pasal 12B Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi karena beberapa alasan (1) pemberian hadiah berupa layanan seks sebagai gratifikasi sesuai dengan tujuan dibuatnya Undang-Undang Nomor 20 Tahun 2001 yaitu bertujuan untuk mencegah dan memberantas tindak pidana korupsi, (2) pemberian hadiah berupa layanan seks sebagai gratifikasi sesuai dengan penafsiran ekstensif kata fasilitas lain dalam penjelasan Pasal 12B Undang-Undang Nomor 20 Tahun 2001dengan memperluas arti kata fasilitas lain, (3) pemberian hadiah berupa layanan seks sebagai gratifikasi telah diterapkan di Negara lain yaitu di Negara Singapura yang telah menjerat sejumlah pejabat tinggai dengan Pasal tentang gratifikasi. Sedangkan urgensi pengaturan pemberian hadiah berupa layanan seks sebagai bentuk tindak pidana korupsi tentang gratifikasi (1) pemberian layanan seks telah terjadi di Indonesia dengan adanya 2 contoh kasus suap pemberian layanan seks yaitu kepada hakim pengadilan tipikor Bandung dan kasus terkait proyek PLTU, (2) mempermudah upaya pembuktian oleh Komisi Pemberantasan Tindak Pidana Korupsi (KPK) dalam kasus pemberian hadiah berupa layanan seks karena memperkuat dasar hukum bagi KPK untuk melakukan upaya pembuktian serta KPK bekerjasama dengan Corrupt Practice Investigation Bureau (CPIB) Singapura dalam mempelajari upaya mengungkap kasus pemberian hadiah berupa layanan seks.
English Abstract
In this paper the authors raised concerns about the urgency of setting Gift Giving Sex as a Form of Service Gratuity Form of Crime . The selection of titles is motivated by several cases of bribery that occurred in Indonesia related to the provision of sexual services in the form of a gift to an official or organizer of this paper raised the formulation of the problem as follows : ( 1 ) whether the gift of service to qualify as sexual gratification associated with Article 12B Law No. 20 of 2001 on the Amendment of the Law No. 31 Year 1999 on Eradication of Corruption ? ( 2 ) What is the urgency of giving a gift of service settings as a form of sexual gratification ? Writing this paper uses this type of research with a normative juridical approach law ( statute approach) . Legal materials used include primary legal materials , secondary and tertiary collected by the author through the study of documents , literature studies , and internet studies . Legal materials obtained and analyzed by the study gives an overview of the object , and then do the interpretation and the latter gives conclusions and suggestions . From the research , the results showed that giving a gift of service is a form of sexual gratification associated with Article 12B of Act Number 20 of 2001 on the Amendment of the Law No. 31 Year 1999 on Eradication of Corruption for several reasons ( 1 ) awarding a prize of sex as a gratuity in accordance with the purpose of the Act No. 20 of 2001 which aims to prevent and combat corruption , ( 2 ) the provision of sexual services as a gift of gratification in accordance with the extensive interpretation of the word of other facilities in the explanation of Article 12B of Act Number 20 Years 2001dengan expand the meaning of other facilities , ( 3 ) the provision of sexual services as a gift of gratification has been applied in other countries , namely in Singapore that has ensnared State officials tinggai with Article on gratification . While the urgency of setting giving a gift of sex as a form of corruption of gratification ( 1 ) the provision of sexual services has occurred in Indonesia in the presence of 2 bribery case that the provision of sexual services to the Bandung Corruption Court judges and cases related to the power plant project , ( 2 ) facilitate verification efforts by the Corruption Eradication Commission ( KPK ) in the case of gifts in the form of sex because it strengthens the legal basis for the Commission to make the effort of proof and the Commission in cooperation with the Corrupt Practices Investigation Bureau ( CPIB ) of Singapore in an effort to uncover a case study in the form of gift-giving sexual services .
