Abstract
Rahn emas merupakan produk jasa gadai yang berlandaskan prinsip syariah dimana nasabah tidak dikenakan bunga atas pinjaman yang diperoleh. Dalam transaksi rahn emas, uang atau dana yang dipinjamkan berbentuk pertolongan yang tidak mengharapkan tambahan atas hutang tersebut. Seiring berkembangnya praktik rahn emas di Indonesia, timbul keraguan dari berbagai kalangan atas kesesuaian praktik rahn emas dengan konsep yang ada. Berbagai opini menyatakan bahwa praktik rahn emas sama saja dengan gadai emas konvensional. Tujuan dari penelitian ini adalah untuk menjawab kesyariahan transaksi rahn emas di pegadaian syariah. Hasil studi ini menunjukkan bahwa secara garis besar pegadaian syariah sudah mematuhi aturan dalam transaksi rahn emas. Namun ada hal-hal yang dianggap kurang sesuai dengan konsep syariah yaitu adanya penggabungan akad rahn dan akad ijarah, penentuan biaya ijarah dan administrasi yang didasarkan pada besarnya pinjaman, serta kurang diperhatikannya status kepemilikan emas. Terlepas dari adanya ketidaksesuaian antara konsep dengan praktik rahn emas di pegadaian syariah, sistem pelelangan yang dilakukan pegadaian syariah sudah sesuai dengan Fatwa DSN-MUI No:25/DSN-MUI/III/2002 tentang Rahn. Kelebihan uang hasil pelelangan setelah dikurangi pinjaman dan biaya-biaya akan dikembalikan ke nasabah sedangkan apabila masih ada kekurangan tetap menjadi kewajiban nasabah untuk melunasi. Inilah keindahan Islam dimana penyelesaian pinjaman atau pelunasan dilakukan secara adil.
English Abstract
Gold pawn is a pawn service product that is based on sharia principles which the customer is not charged interest on loans obtained. In the gold pawn transactions, cash or money owed to help shape who do not expect any extras on the debt. As the development of gold pawn practices in Indonesia, there is doubt on the suitability of various circles of gold pawn practices with existing concepts. The opinions stated that the practice of gold pawn tantamount to conventional gold pawn. The purpose of this study is to answer kesyariahan gold at pawn shops pawn transactions sharia. The results of this study indicate that the shariah mortgage outline already comply with the rules in gold pawn transactions. But there are things that are considered less appropriate to this concept that the merger agreement and the pledge of the rental agreement, rental costs and administrative determination based on the size of the loan, as well as the lack of attention to the status of its gold holdings. Regardless of the discrepancy between the concept and practice of sharia Rahn gold at pawn shops, pawn shops auction system made in accordance with sharia already DSN-MUI No: 25 / DSN-MUI / III / 2002 on Rahn. Excess money from the auction after deducting the loan and the costs will be returned to the customer, while if there is still a shortage remains the clients obligation to repay. This is the beauty of Islam in which the redemption or repayment is done fairly.
