Abstract
Pada skripsi ini, penulis mengangkat tentang permasalahan dalam hal perlindungan hukum hak cipta atas software/program komputer bajakan yang diperjualbelikan secara luas dimana program komputer merupakan salah satu ciptaan yang dilindungi oleh hak cipta. Penelitian ini dilatarbelakangi karena banyak software bajakan yang dijual dengan harga yang murah tanpa izin dari pencipta dan/atau pemegang hak cipta. Dengan adanya software bajakan maka pencipta dan/atau pemegang hak cipta dirugikan, dan keuntungan ada pada penjual software bajakan. Padahal pencipta dan/atau pemegang hak cipta mempunyai hak ekonomi yang berkaitan dengan keuntungan ekonomi yang didapatkan atas suatu karya ciptaannya. Berdasarkan latar belakang tersebut di atas, permasalahan hukum yang dikemukakan dalam penelitian ini adalah bagaimana implementasi perlindungan hukum hak cipta atas software dan hambatan apa yang dialami pihak kepolisian dalam memberantas software bajakan serta upaya yang dapat dilakukan untuk memberantas software bajakan yang marak beredar saat ini. Metode yang digunakan dalam penelitian ini adalah metode yuridis empiris, yang didasarkan atas fakta-fakta yang diperoleh dari hasil observasi di lapangan, dimana data primer diperoleh dari penelitian di lapangan dengan menggunakan metode wawancara terhadap para pihak terkait mengenai topik pembajakan software dalam penulisan laporan hasil penelitian ini. Data sekunder diperoleh dari penelitian kepustakaan yang berasal dari peraturan perundangundangan, dokumen, jurnal dan artikel yang berkaitan dengan permasalahan yang diteliti. Hasil dari penelitian menunjukan bahwa implementasi perlindungan hak cipta terkait hak ekonomi pencipta dan/atau pemegang hak cipta masih belum berjalan dengan baik. Hambatan-hambatan yang dialami pihak kepolisian baik dari aspek substansi hukum yang berkaitan dengan perubahan sifat delik dari delik biasa menjadi delik aduan, struktur dari pihak kepolisian sendiri maupun PPNS HKI dan kultur yang berkaitan dengan user/pengguna, pelaku/penjual software bajakan, pihak pengelola mall, dan pencipta maupun pemegang hak cipta sendiri menyebabkan sulit untuk memberantas jual beli software bajakan, sehingga diperlukan upaya untuk memberantas software bersama-sama baik dari substansi, struktur maupun kulturnya.
English Abstract
In this research, the authors raised about the problem in terms of copyright protection of pirated software / computer programs are widely traded where the computer program is one of creation that is protected by copyright. This research is motivated because many pirated software is sold with a cheap price without permission from the creator and / or the copyright holder. With the existence of pirated software, creators and / or copyright holders are disadvantaged, and the advantage exists with pirated software vendors. Whereas the creator and / or the copyright holder have economic rights related to the economic benefits gained on a work of his creation. Based on the background mentioned above, the legal issues raised in this research is how the implementation of the protection of copyright law on software and obstacles faced by the police in combating pirated software and efforts that can be done to eradicate pirated software that is rampant in circulation today. The method used in this research is empirical juridical method, based on the facts obtained from field observations, where the primary data obtained from research in the field by using the method of interviewing the parties concerned about the topic of software piracy in the writing of research reports this. Secondary data obtained from literature research derived from legislation, documents, journals and articles relating to the problems studied. The results of the research show that the implementation of copyright protection related to the economic rights of creators and / or copyright holders is still not going well. The obstacles faced by the police either from the aspect of legal substance related to the change of the nature of the offense of the normal offense into complaints, the structure of the police itself and the PPNS HKI and the culture related to the user / users, the perpetrators / sellers of pirated software, the mall manager , and creators and copyright holders themselves make it difficult to eradicate the sale and purchase of pirated software, so efforts are needed to
